Utah Physicians for a Healthy Environment (UPHE), a nonprofit group, sued the Diesel Brothers and related companies under the federal Clean Air Act, alleging that they removed emissions equipment, sold defeat devices, and operated or supplied diesel trucks with disabled pollution controls.
The case produced a permanent injunction, an $851,450 civil-penalty judgment, and a separate attorneys’ fees award. David “Heavy D” Sparks was later arrested in 2025, but that arrest arose from alleged civil contempt and failure to comply with post-judgment orders—not from a new criminal emissions conviction. By February 2026, UPHE said Sparks and his companies had paid the outstanding attorneys’ fees and costs, while approximately $200,000 in civil penalties remained unpaid.

Why did UPHE sue the Diesel Brothers?
UPHE filed a private federal Clean Air Act citizen suit in January 2017 after giving notice of its intent to sue in July 2016. The defendants included David Sparks, Joshua “Redbeard” Stuart, Keaton “The Muscle” Hoskins, Diesel Power Gear LLC, and B&W Auto LLC, the company operating as Sparks Motors.

- Selling or operating trucks after their emissions controls had been rendered inoperative
The legal issue was not merely whether a modified truck produced more pollution than a clean truck. UPHE argued that federal law prohibits tampering with required emissions systems and prohibits defeat devices designed to bypass them.
The Tenth Circuit later agreed that these anti-tampering and defeat-device requirements can qualify as enforceable Clean Air Act emission standards or limitations. That point mattered because the defendants challenged whether UPHE could use a citizen suit to pursue those alleged violations.
What did the court find?
After a four-day bench trial in November 2019, the district court ruled for UPHE. The court entered a permanent injunction barring the defendants from tampering with diesel emissions systems and from selling or installing defeat parts.

The trial evidence also included striking pollution comparisons. UPHE and the district court cited evidence that one diesel truck with federally required emissions equipment removed could emit nitrogen oxides at approximately 36 times its original certified rate and particulate matter at approximately 21 times its original certified rate.
Those figures describe the truck and evidence at issue in the case. They should not be treated as a guaranteed multiplier for every deleted or modified diesel pickup. Results vary with the engine, calibration, hardware removed, operating conditions, and the condition of the truck.
How much money did the Diesel Brothers owe?
Several different financial figures are associated with the lawsuit, which is why summaries of the case often become confusing.

| Amount | What it represented |
|---|---|
| $851,450 | Civil penalties entered by the district court on March 10, 2020 |
| $928,602.23 | Original attorneys’ fees and costs awarded to UPHE in January 2021 |
| $843,602.23 | Fees and costs remaining after Keaton Hoskins’ separate settlement reduced the obligation by $85,000 |
| Approximately $200,000 | Civil-penalty balance that UPHE said remained outstanding in February 2026 |
The $851,450 was not an EPA fine, and it was not the attorneys’ fee award. It was a civil-penalty judgment imposed by the court in the private Clean Air Act case. The fees and costs were a separate obligation resulting from the litigation.
Did the Diesel Brothers win on appeal?
Not in the broad sense sometimes reported online. On December 28, 2021, the Tenth Circuit largely affirmed the liability findings.
The appellate court rejected arguments that UPHE lacked standing to pursue the anti-tampering claims. It also rejected arguments that certain sweepstakes trucks or vehicles sold “as is” fell outside the Clean Air Act’s reach. The court described the emissions-control conduct as “flagrant misconduct” in its discussion of the case; that phrase was a judicial description of the conduct, not a criminal conviction.
The Tenth Circuit did remand limited issues concerning the penalty calculation. Specifically, the district court had to exclude penalties for violations that did not cause pollution in the Wasatch Front and reconsider the seriousness factor used for portions of the Utah State Implementation Plan penalties.
That limited remand did not erase the verdict, eliminate the injunction, or declare the defendants compliant. Saying that the case was “thrown out on appeal” is inaccurate.
Why was Heavy D arrested?
David Sparks’ 2025 arrest involved enforcement of the court’s post-judgment orders. It was not a new criminal emissions charge.

By June 2024, the district court had found Sparks and other defendants in civil contempt for failing to comply with the attorneys’ fees order. The court continued to require financial disclosures and other information relevant to collecting the judgment.
On October 2, 2025, the court found Sparks remained in civil contempt. The order cited alleged failures to pay court-ordered fees and to comply with enforcement requirements. It also found that he had violated restrictions connected to an asset-liquidation sale, failed to deposit required sale proceeds, and transferred at least two vehicles without court permission: a Tesla Cybertruck and a Dodge Ram.
The court ordered the U.S. Marshals Service to arrest and incarcerate Sparks until he purged the contempt. He was taken into federal custody on October 7, 2025. He was released after the parties reached a stipulation requiring disclosures to UPHE within 10 days.

Describing it as an arrest “for emissions violations” leaves out the central legal distinction: the underlying emissions case was civil, while the later custody order enforced compliance with the court’s judgment.
What happened to the other Diesel Brothers?
The original litigation involved more than Sparks. Joshua Stuart, Diesel Power Gear LLC, and B&W Auto LLC were also defendants in the appellate proceedings. Keaton Hoskins settled separately, and his settlement reduced the remaining attorneys’ fees-and-costs obligation by $85,000. David Kiley and DieselSellerz.com were originally named but were not parties to the appeal.
The case therefore should not be described as a single personal fine imposed only on Heavy D. The litigation involved individual defendants, business entities, the Sparks Motors operation, and different rulings affecting different parties.

What is the Diesel Brothers’ legal status now?
In February 2026, UPHE announced that it and Sparks had reached a settlement resolving their long-running dispute. According to UPHE, Sparks and his defendant companies paid their full attorneys’ fees and costs debt.

The settlement did not give the companies permission to delete trucks again. UPHE said the permanent injunction remains in effect. Sparks and his companies remain prohibited from:
- Removing or disabling required emissions systems
- Installing or selling defeat devices or defeat parts
- Owning or operating vehicles with disabled emissions controls
UPHE also said approximately $200,000 in civil penalties remained outstanding. Consequently, “the Diesel Brothers paid the $850,000 fine” is an incomplete description. The fees-and-costs debt was paid under the settlement, while a civil-penalty balance remained according to UPHE’s update.

The case is a warning that emissions tampering can create legal exposure beyond a failed inspection or a state registration problem. Under the Clean Air Act, removing a diesel particulate filter, disabling an exhaust-gas-recirculation system, installing a defeat tuner, or replacing emissions hardware with a straight pipe can trigger federal consequences.
That applies even when a vehicle is sold “as is” or modified for an apparent commercial, promotional, or giveaway purpose. The Tenth Circuit’s decision also shows why marketing, selling, installing, and operating a modified vehicle may all matter separately from the owner’s personal use of it.
For a truck owner, the safer approach is straightforward:
Best Value
- Holds More Before It Clogs: Deep embossed pleats pack in extra media, so the filter captures more dirt and dust and lasts longer between changes than a shallow-pleated economy filter.
- Fits The Whole 6.7 Cummins RAM: Confirmed for 2007 to 2026 RAM 2500, 3500, 4500, and 5500. One engine air filter covers every 6.7L Cummins RAM from the first year to the latest, so ordering is simple.
- Sealed And Verified: Efficiency is confirmed by an independent lab under the ISO 5011 standard, and the heavy-duty silicone gasket holds a tight seal so unfiltered air cannot slip past in rough, dusty conditions.
- Ten-Minute Change: This drops into the factory airbox with no cutting or extra hardware, and most owners swap it in five to ten minutes. Replace it every 5,000 to 10,000 miles per your service schedule.
- Direct OEM Fit: Spec'd to meet or exceed the factory filter, so it drops in with no changes and keeps your new-vehicle warranty intact. The full cross-reference is in the product details.
- Keep the factory emissions equipment installed and functional.
- Use replacement parts that are legal for the vehicle and its intended emissions jurisdiction.
- Do not rely on a tuner seller’s claim that a device is legal for “off-road use” if the truck is driven on public roads.
- Keep records for emissions-related repairs and calibrations.
- Before buying a used diesel, inspect for missing filters, altered exhaust plumbing, unplugged sensors, and nonfactory tuning.
A performance modification can affect warranty coverage, inspection compliance, registration, insurance, and federal law. The Diesel Brothers case shows that the financial consequences can be much larger than the price of returning a truck to its original configuration.
FAQ
Were the Diesel Brothers sued by the EPA?
No. Utah Physicians for a Healthy Environment, a private Utah nonprofit, brought a federal Clean Air Act citizen suit. The case was not an EPA prosecution.
Were the Diesel Brothers criminally convicted for emissions violations?
The underlying case resulted in civil judgments and a permanent injunction, not a criminal conviction. Heavy D’s 2025 incarceration order concerned civil contempt, payment, disclosures, and other court-order violations.

It was a civil-penalty judgment entered by the federal district court in March 2020. It was separate from the attorneys’ fees and costs, which were originally awarded at $928,602.23.
Can the Diesel Brothers legally delete diesel trucks again after settling?
No. UPHE said the February 2026 settlement preserved the permanent injunction prohibiting emissions tampering, defeat parts, and ownership or operation of vehicles with disabled emissions controls.
The Bottom Line
The Diesel Brothers’ controversy centered on alleged diesel emissions tampering, defeat devices, and the sale or operation of trucks with disabled pollution controls. UPHE—not the EPA—brought the civil Clean Air Act case. The courts largely upheld the liability findings, imposed an $851,450 civil-penalty judgment and separate attorneys’ fees, and maintained a permanent injunction. Heavy D’s 2025 arrest followed alleged civil contempt and failure to comply with collection-related orders, not a new criminal emissions prosecution. In February 2026, UPHE said the attorneys’ fees and costs had been paid, but the emissions restrictions remained in force and approximately $200,000 in civil penalties was still outstanding.
