What the U.S. Investigation Into Chinese-Made Smart Cars Became

The 2024 inquiry into connected vehicles led to a binding rule on specified hardware, software, and supply-chain relationships—not a blanket ban on Chinese-made cars.

The February 29, 2024, announcement was the start of a Commerce Department inquiry—not an immediate ban on Chinese-made cars. That process later produced a binding rule restricting certain connected-vehicle hardware and software transactions tied to the People’s Republic of China (PRC) or Russia. The rule took effect March 17, 2025, with key restrictions phased in by model year.

What did the Biden administration announce in February 2024?

On February 29, 2024, the U.S. Department of Commerce announced an advance notice of proposed rulemaking (ANPRM) and invited public comment on information and communications technology and services (ICTS) used in connected vehicles. The announcement opened an inquiry; it did not prohibit the sale or import of Chinese-made cars. Commerce’s announcement described the department’s concern that connected-vehicle technology could gather extensive data or allow a vehicle to be remotely disabled or manipulated.

Then-Commerce Secretary Gina Raimondo said the inquiry was intended “to investigate the national security risks of connected vehicles, specifically PRC-manufactured technology in the vehicles.” Those statements explain the government’s risk rationale; they are not evidence that a particular vehicle had been exploited. The cited agency materials do not give a measured incidence or probability of such exploitation.

How did the inquiry become a rule?

The process moved from the February 2024 request for comment to a proposed rule in September 2024, and then to a final rule announced in January 2025. The final rule took effect on March 17, 2025. The distinction matters: the 2024 announcement asked for information, while the later rule established restrictions on defined transactions and technologies.

What technology and vehicles does the rule cover?

The rule focuses on specified Vehicle Connectivity System (VCS) hardware and covered software, including software integrated into Automated Driving Systems (ADS), when the required foreign-adversary nexus applies. BIS describes VCS as systems that let a vehicle communicate externally, including telematics control units and Bluetooth, cellular, satellite, and Wi-Fi modules. ADS means components that collectively enable a highly autonomous vehicle to operate without a driver. The initial scope covers passenger vehicles weighing less than 10,001 pounds. BIS said commercial vehicles, including trucks and buses, were reserved for a separate rulemaking because of supply-chain complexity; consult BIS for any later changes to that position. The rule’s initial vehicle scope therefore should not be generalized to every type of road vehicle.

Does “Chinese-made” automatically mean prohibited?

No. The rule is not a blanket prohibition based solely on where a vehicle is assembled, nor does it make every vehicle connected to a Chinese employee or supplier automatically unlawful. It addresses defined technologies, transactions, and ownership, control, or jurisdictional relationships that create the specified PRC or Russian nexus. In some circumstances it restricts imports or sales involving covered VCS hardware or software and vehicles made by manufacturers with that nexus. The particular legal test depends on the transaction and rule definitions, so a country-of-assembly label alone does not resolve compliance.

For that reason, the agency’s policy should not be used to label individual brands or models as prohibited without evidence about the relevant technology, manufacturer relationships, and transaction. The rule is aimed at supply-chain and access risks, not a finding that every affected technology has been used to conduct surveillance or remote interference.

When do the restrictions begin?

The final rule’s effective date is March 17, 2025, but the principal prohibitions are phased in by model year and transaction type. BIS identifies these dates:

  • Model year 2027: Software-related prohibitions begin. These include restrictions on sales of connected vehicles by manufacturers with the specified PRC or Russian nexus and vehicles using covered software.
  • Model year 2030: VCS hardware import restrictions begin for vehicles with a model year.
  • January 1, 2029: VCS hardware import restrictions begin for units without a model year.

These are regulatory phase-in dates, not the date the 2024 inquiry began. The distinction between model-year timing and the rule’s effective date is important when assessing a particular vehicle or transaction. BIS provides current details on its Connected Vehicles page.

What must manufacturers and importers do?

BIS says affected importers and manufacturers that are not engaging in prohibited transactions involving covered VCS hardware or software must submit annual Declarations of Conformity. The rule also provides general and specific authorizations and an advisory-opinion process. These are compliance mechanisms for businesses in the supply chain, not steps consumers need to take when buying or owning a car. Manufacturers, importers, and suppliers should consult the rule and current BIS guidance for requirements that apply to their activities.
