There is no single rule that makes every post-sale traffic fine automatically the seller’s or the buyer’s responsibility. After handover, the buyer normally controls and uses the car, but a challan can still be associated with the seller when the registration record has not been updated. The notice identifies a vehicle, recorded owner, driver or alleged offence; it does not, by itself, prove who was driving or decide personal liability. Responsibility depends on the offence, its date, the evidence, the issuing jurisdiction and the status of the ownership transfer.
If you sold the car, respond rather than ignore the notice. Report the sale within the statutory time, preserve dated handover and transfer records, verify the challan through an official channel, and ask the issuing authority to review the chronology.

Why a challan can still reach the seller
Indian vehicle records are central to how enforcement notices are generated. When an automated camera, traffic officer or other enforcement system records an alleged offence, the notice may be linked to the registration number and the owner data available to the authority. If the buyer has possession but the registering authority still shows the seller, the seller may receive the notice or see it connected with the vehicle.

A driver-specific notice, a vehicle-registration notice and an allegation supported by a photograph or video can involve different facts and procedures. The official material currently available does not establish one nationwide rule covering every post-sale offence in every state. The particular notice, the actual driver, the offence law and the local dispute process must be examined together.

For that reason, two statements are both unsafe: “the seller is always liable until the RC changes” and “the buyer is always liable as soon as money and keys change hands.” The seller may still need to explain the sale because the record points to them, while the buyer’s use after handover remains an important factual issue.
What Section 50 requires from the seller and buyer
Section 50 of the Motor Vehicles Act, 1988 sets reporting duties for both sides. The statutory text is available from the Government of India’s India Code copy of the Act. The Supreme Court’s 31 July 2019 judgment also reproduces these transfer provisions, but it should not be read as a universal decision on every later traffic challan: Supreme Court judgment (31 July 2019).

MoRTH’s Parivahan guidance identifies Form 29 as the transferor’s report and Form 30 as the transferee’s application. Its explanation of the normal sale process is at Parivahan Sewa: Transfer of Ownership. Meeting a deadline does not guarantee that an authority will cancel a challan, but an acknowledgement helps establish when each party acted.
The statute also provides for consequences when reporting requirements are not met, including an amount prescribed within the statutory framework and possible action under section 177 if that amount is not paid. The current payable amount can depend on the applicable State Government rule and current law; do not treat an old figure or a generic online number as the amount due in your case.

How the timing changes the analysis
Build the chronology before deciding how to respond. Compare the alleged offence with the exact sale and handover dates, and use the handover time if your documents record it.

A private sale receipt or a message saying “keys delivered” is useful, but it does not itself change the government registration entry. The strongest chronology normally combines the sale agreement or receipt, payment record, dated handover acknowledgement, buyer identity and contact details, insurance or delivery records where relevant, and Form 29/Form 30 submission acknowledgements.
What to do when a challan arrives

Verify that the notice is genuine
Use the official MoRTH eChallan grievance page or the issuing authority’s official website rather than an unsolicited payment link. Check the challan number, vehicle registration, alleged offence, date, location, department, amount and any photograph or video. Write the timeline down
Record the contract or sale date, the exact handover date and time, the alleged offence date and time, when Forms 29 and 30 were signed or submitted, and when the registration entry changed, if it has changed. A violation before handover is materially different from one after handover.

Collect a focused evidence bundle
- Sale agreement, invoice or receipt showing the parties and date.
- Handover note, delivery acknowledgement or other dated proof of possession.
- Buyer’s name, address and contact details as recorded in the transaction.
- Copies of Form 29 and Form 30, submission receipts and transport-office acknowledgements.
- Messages, emails or letters about the transfer and any request that the buyer complete it.
- The challan number, notice copy, location, offence description and available image or video.

Submit a documented grievance
Explain the chronology in a short factual statement. Identify the sale and handover dates, state whether the offence was after handover, list the attached documents, and ask the competent authority to review the vehicle association and driver evidence. The national eChallan page provides a grievance route; its instructions direct Delhi matters to Delhi Traffic Police and listed states or territories to the relevant NextGen eChallan channel.

Keep the acknowledgement and monitor the case
Save the complaint number, screenshots, uploaded files and every reply. Filing a grievance is a request for review; the cited official pages do not promise that submission automatically cancels, transfers or stays a challan. Continue to observe any payment, hearing or response deadline shown on the notice unless the competent authority tells you otherwise.

Use the stated legal contest route if review does not resolve it
Delhi Traffic Police’s FAQ says a person who believes a challan is unjust may file an online grievance at traffic.delhipolice.gov.in against the issued challan or contest it in court: Delhi Traffic Police FAQ. Outside Delhi, follow the procedure printed on the notice or published by the issuing city or state authority. Court procedure, filing windows and required documents can differ by location and offence.

Finish the ownership-record update
If the record remains in your name, contact the registering authority and the buyer with the documentary proof and ask what is missing from the transfer file. Parivahan’s transfer guidance describes the standard process, but a local office may require additional current forms, fees or verification. Keep proof of every submission and visit.

How to deal with common problem cases
The buyer has not transferred the RC
Notify the buyer in writing that the registration transfer is pending and give a clear deadline for cooperation. Send a copy of the sale and handover evidence to the registering authority and retain delivery proof. If a challan is already issued, do not wait for the buyer to act before lodging your own grievance; your records can show when possession changed and what steps you took.
The notice has no usable photograph or driver detail
Ask the issuing authority what evidence is available and whether the notice is vehicle-based or driver-specific. A missing image does not automatically invalidate a notice, and an image of the vehicle does not automatically identify the seller as the driver. Let the authority explain the offence-specific process.
The offence happened before the sale
State plainly that the alleged event predates handover and attach documents proving the relevant date and time. If the vehicle was still being used by someone else before delivery, identify that fact accurately; do not name a driver without supporting evidence.
The buyer cannot be contacted
Preserve the buyer’s transaction details, failed contact attempts and any address used in the sale. Give those details to the registering and issuing authorities. Do not alter documents or make a statement that goes beyond what you can prove.

The seller already paid the challan
Payment may close the particular notice in the authority’s system, but it does not by itself correct the ownership record or prove who was driving. If you believe the payment was made in error, ask the issuing authority what review or refund process, if any, applies to that offence and jurisdiction.
Records to keep after every vehicle sale
- Signed sale agreement or receipt with the vehicle registration number and date.
- Handover document showing when possession and keys changed hands.
- Buyer’s verified identity and contact information used for the transfer.
- Copies of Forms 29 and 30 and all acknowledgements, courier receipts or portal transaction numbers.
- Messages requesting completion of the transfer and responses from the buyer or transport office.
- Copies of insurance, tax, permit or other documents that establish the vehicle’s status at handover, where relevant.
- Every challan, grievance acknowledgement and authority response connected with the vehicle.
These records help establish chronology and support a request for correction. They are not a guaranteed cancellation or immunity from an offence proved against a particular driver.
What the official sources do—and do not—establish
The Motor Vehicles Act and Parivahan guidance establish reporting duties and the Form 29/Form 30 framework. The eChallan material explains how notices and evidence may be presented and where grievances are routed. Delhi’s published FAQ confirms an online grievance and court-contest option for that jurisdiction. None of those sources creates a blanket all-India answer that every post-sale challan belongs to one party regardless of the driver, offence, transfer status or state procedure.

The legally safer approach is therefore evidence-led: identify the offence and date, establish possession and reporting history, respond to the authority that issued the notice, and complete the registration transfer instead of treating a private sale as the end of the process.
