Paying that penalty does not erase the obligation to surrender the missing allowances. The company can also be publicly named, and persistent non-compliance can ultimately lead to ships being excluded from EU Member State ports or, in some cases, detained.
The immediate legal consequences
The European Commission’s maritime ETS rules create two separate obligations after a missed surrender: a financial penalty and the continuing duty to deliver the allowances that should have been surrendered. One consequence does not replace the other.

Excess-emissions penalty
The statutory penalty is EUR 100 per tonne of CO2-equivalent, corrected for inflation. The EUR 100 figure is the base amount stated in the Commission’s maritime ETS FAQ, not necessarily the exact cash amount applicable on a particular date. The official material does not state the current indexed figure, so it would be misleading to describe EUR 100 as the final inflation-adjusted amount.
The penalty is tied to the company’s failure to surrender the required allowances by the applicable deadline. It is not a substitute purchase of allowances and does not bring the account into compliance.

The missing allowances remain due
After paying the penalty, the shipping company must still surrender the required allowances. The debt therefore continues until the shortfall has been delivered through the Union Registry. A company cannot choose between paying the penalty and surrendering allowances; both duties apply.
Public disclosure
The Commission says that the names of companies penalized for failing to surrender allowances are disclosed publicly. That publication consequence is separate from any national enforcement action and can create a lasting compliance and counterparty record.
Additional national measures
Member State authorities enforce the maritime ETS. They must set penalties and enforcement measures that are effective, proportionate and dissuasive. The Commission’s FAQ does not provide a single harmonized schedule for every additional national penalty. The administering authority, the relevant national implementing rules and the facts of the case therefore matter.

When allowances must be surrendered
The surrender deadline for maritime emissions is 30 September of the year after the reporting year. The surrender is made at company level using the company’s verified aggregated emissions data.
| Deadline | Emissions covered by that deadline | Phase-in share |
|---|---|---|
| 30 September 2025 | Reported maritime emissions from 2024 | 40% |
| 30 September 2026 | Reported maritime emissions from 2025 | 70% |
| 30 September 2027 and later | Reported emissions from 2026 onward | 100% |
The 40% and 70% stages are transitional surrender requirements, not reductions in the obligation to monitor and report emissions. From the 2027 deadline onward, the obligation reaches 100% for emissions from 2026 onward.

The Commission has clarified that the excess-emissions penalty applies when a company fails to meet the 30 September surrender deadline under the revised maritime calendar. A company should not assume that the phase-in gives it extra time after 30 September or that an uncompleted surrender is automatically treated as a later correction.
Which emissions determine the shortfall?
Before calculating a potential shortfall, the company must establish whether each voyage and port stay falls within the maritime ETS scope. The coverage rules are not simply “all fuel burned by every ship.”

- 100% of emissions are covered for voyages between EU ports.
- 100% of emissions within EU ports are covered.
- 50% of emissions are covered for a voyage connecting an EU port with a non-EU port, whether the ship is entering or leaving the EU.
These percentages determine the covered emissions used in the surrender calculation. They do not authorize a company to omit the underlying voyage from its monitoring system.
Gases covered
Carbon dioxide has been covered since 2024. Methane (CH4) and nitrous oxide (N2O) join CO2 in the maritime ETS from 1 January 2026. For reporting periods affected by the expanded gas coverage, the company must use the verified CO2-equivalent total relevant to the applicable rules rather than looking only at carbon dioxide.
Route derogations
Specified island, outermost-region and public-service routes have temporary derogations affecting surrender duties. A derogation may change whether allowances must be surrendered for a particular route, but it should not be treated as a general exemption from emissions monitoring and reporting. The company must document the route and the legal basis for relying on any derogation.

Can ships be barred from EU ports?
Port exclusion is a conditional escalation, not the automatic result of one missed deadline. The Commission describes a threshold involving all of the following:
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Scan for outdated or missing drivers - takes under a minute3Clear out junk files and repair common Windows errors- The shipping company has failed to surrender allowances in at least two consecutive reporting periods.
- Other enforcement measures have failed to secure compliance.
- The company has first been given an opportunity to submit observations.
Once those conditions are met, authorities may order the company’s ships to be excluded from EU Member State ports until the company complies. The measure is aimed at persistent non-compliance and follows the earlier penalty and enforcement process.
Detention of an EU-flagged ship
A ship flying the flag of an EU Member State that enters, or is found in, one of that state’s ports may instead be detained until compliance. Detention is a ship-level operational measure; it is not the same legal consequence as the company-level excess-emissions penalty.
The rules do not mean that every ship is detained after a first missed surrender. The consecutive-period threshold, unsuccessful prior enforcement and opportunity to make observations are central safeguards in the Commission’s description.
Who is responsible when a ship changes company?
Responsibility follows the period during which a ship was under a company’s responsibility. If a ship changes company partway through a year, each shipping company surrenders allowances for the emissions attributable to the period when it was responsible for that ship.

This allocation makes handover records essential. The outgoing and incoming companies should preserve the effective date and time of the transfer, the ship’s verified emissions data, the responsible company recorded for the relevant period and the surrender calculation used by each party. A disagreement about ownership or management does not by itself remove the surrender duty for the period assigned to a company.
What a company should do after missing 30 September
There is no general grace period stated in the Commission material. A company that discovers a missed deadline should treat the matter as an active compliance incident.
- Confirm the administering authority. Identify the Member State and authority responsible for the company’s maritime ETS compliance. National procedures and any additional penalties depend on that authority.
- Freeze the relevant records. Preserve verified emissions reports, monitoring plans, voyage and port-call data, company-account information, ship responsibility periods and correspondence with verifiers and authorities.
- Recalculate the covered amount. Separate EU-to-EU voyages, EU-to-non-EU voyages, emissions within EU ports, gases covered in the relevant year and any route derogations. Do not apply the 50% rule to an EU-to-EU voyage or treat a derogation as an emissions-reporting exemption.
- Reconcile the surrender account. Compare the allowances actually surrendered with the amount required for the applicable phase-in percentage. Have the verified aggregation checked before submitting a corrective surrender.
- Acquire and surrender the missing allowances. The continuing allowance obligation remains even if an excess-emissions penalty is assessed. Complete the surrender through the Union Registry using the procedure directed by the administering authority.
- Contact the authority promptly. Ask what notification, payment, corrective filing or evidence it requires. Do not assume that a voluntary payment or late surrender closes the case without written confirmation.
- Assess company and ship exposure. Determine whether the failure is a first missed period or part of two or more consecutive reporting periods, and whether any prior enforcement measures have failed. This assessment indicates whether the port-exclusion provisions could become relevant.
- Document the remediation. Keep proof of the corrective surrender, any penalty payment, communications, revised calculations and controls introduced to prevent recurrence.
Controls that prevent a repeat failure
- Set an internal surrender date well before 30 September and assign a named owner.
- Use a calendar that distinguishes the 40%, 70% and 100% phase-in requirements.
- Reconcile verified aggregated data to the ship-level records before the Union Registry transaction.
- Track EU-port calls, EU-to-EU voyages and EU-to-non-EU voyages separately.
- Update the emissions inventory for methane and nitrous oxide from 1 January 2026.
- Maintain a route-derogation register showing the legal basis, dates and supporting evidence.
- Record every change in the company responsible for a ship and split emissions at the handover date.
- Require a second compliance review before submitting the surrender.
- Retain transaction confirmations and authority correspondence in an auditable file.
Worked examples
One missed deadline
Suppose a company does not complete the surrender due on 30 September 2026 for its 2025 emissions. The applicable phase-in share is 70% of the reported 2025 emissions. The company may face the inflation-corrected EUR 100-per-tonne CO2-equivalent excess-emissions penalty, public disclosure of its name and a continuing obligation to surrender the required allowances. A single missed deadline does not, by itself, satisfy the stated threshold for port exclusion.
Two consecutive failures
If the company also fails to surrender for the next reporting period, the failure may reach the “at least two consecutive reporting periods” threshold. Port exclusion still is not automatic: authorities must have tried other enforcement measures without securing compliance, and the company must have an opportunity to submit observations before an exclusion order is made.
A mixed EU and non-EU itinerary
A voyage between two EU ports is subject to 100% coverage. A voyage between an EU port and a non-EU port is subject to 50% coverage under the stated maritime rules. If the ship also emits while berthed in an EU port, those in-port emissions are covered at 100%. The company must keep the legs and port emissions distinct rather than applying one percentage to the entire voyage record.

A mid-year transfer
If responsibility transfers on 1 July, the former company surrenders for the emissions attributable to its period and the new company surrenders for emissions attributable to the period after the transfer. The parties should use verified data and a documented allocation rather than assigning the whole year to whichever company holds the ship at the deadline.
What is still uncertain in an individual case?
The base penalty and escalation framework are established at EU level, but the outcome for a particular company depends on facts that must be verified. Those facts include the administering Member State, the ship’s flag and route history, the reporting year, verified emissions, the surrender record, any applicable derogation, the dates of company responsibility and national implementing measures.
The Commission has also referred to a targeted ETS revision proposal dated 17 July 2026. A proposal is not the same as a rule already in force. Companies should apply the legislation and official guidance effective for the relevant reporting period unless and until a later measure is adopted and applicable.
Practical bottom line for fleet managers
Missing the surrender deadline creates an accumulating compliance problem, not a one-time bill. Calculate the covered emissions correctly, complete the late surrender, engage the responsible Member State authority and preserve evidence of the correction. Treat repeated failures as an operational risk because the enforcement path can move from a company-level penalty and public naming to measures that restrict a ship’s access to EU ports.
