To transfer a car after its registered owner dies, first use the motor-vehicle agency for the state that issued the title. That state’s rules determine who may sign, whether probate is required, which forms are valid, and what evidence is accepted. A death certificate by itself does not give a relative authority to sign the title. Identify the ownership pattern and the legally authorized person before submitting anything.
Start with the title, not the death certificate
The deceased owner’s state of title controls the transfer procedure. Registration in another state, the vehicle’s current location, or the applicant’s residence does not automatically change which rules apply. State agencies use different forms, value limits, waiting periods and proof-of-authority requirements, so a process that works in one state may be rejected in another.

- Every owner named on the title and whether ownership is joint.
- Whether a transfer-on-death beneficiary is recorded.
- Whether a lienholder is listed.
- Whether the title is available, lost, damaged or held electronically.
- Whether the title is from another state.
If the title is out of state and still lists the deceased owner, do not assume the local state’s deceased-owner affidavit can be used. New York, for example, specifically says its in-state forms cannot transfer an out-of-state title that remains in a deceased owner’s name.

Determine who has legal authority to receive or sign
The registered owner’s death does not establish that a spouse, child or other relative may sign the title. The proper route depends on the title’s ownership pattern, beneficiary designation, estate documents and the law of the titling state.
Surviving joint owner
A title showing joint ownership may allow the surviving owner to apply under a survivorship procedure. The agency normally requires the title and authenticated proof of death, but the exact wording on the title and required forms matter. The District of Columbia describes a surviving joint-owner route, while Illinois says its documentation depends on whether the title was individual or joint. These procedures are examples only; use the issuing state’s checklist.
Named transfer-on-death beneficiary
Some jurisdictions record a vehicle transfer-on-death beneficiary. California recognizes vehicle TOD beneficiaries. A named beneficiary may have a route that differs from both probate and a small-estate affidavit, but the beneficiary must still provide the state-required title, death documentation and application.
Executor or administrator of a probated estate
If a court appointed a personal representative, that person generally must prove the appointment before assigning or transferring the vehicle. Texas identifies original or certified letters testamentary or letters of administration for a probated estate. New York likewise requires court authority documents in the circumstances described by its DMV. The representative should sign only in the capacity and format required by the agency, not as though signing personally for the deceased.

Heir using a non-probate affidavit
Some states allow a vehicle to pass without a full probate proceeding when strict conditions are met. Texas lists a notarized VTR-262 Affidavit of Heirship for a Motor Vehicle for certain non-probated estates. California’s REG 5 is another example, but it applies only to qualifying California-titled vehicles or vessels and requires specific statements about probate, creditors, entitlement and estate value.
Will, trust, minor heir or disagreement
A will does not automatically replace the titling agency’s proof-of-authority requirements. A trust, minor beneficiary, competing heirs, unpaid debts or disagreement about who should receive the vehicle can require court documents, additional signatures or a court order. Before assigning the title in a contested or unusual estate, obtain state-specific probate guidance.
Choose the correct transfer route
| Situation | Person who normally acts | Typical evidence identified by state agencies | Important limitation |
|---|---|---|---|
| Surviving joint owner | Surviving owner | Title and authenticated death documentation | Survivorship wording and forms vary by state |
| Recorded vehicle TOD beneficiary | Named beneficiary | State TOD documentation, title and proof of death | Available only where the state recognizes and records vehicle TOD |
| Probated estate | Court-appointed executor or administrator | Original or certified letters testamentary or letters of administration, title and state application | Authority must match the state’s signing requirements |
| Non-probated estate | Qualifying heir or other person allowed by state law | State affidavit, notarization where required, title, death evidence and heir information | Eligibility can depend on estate value, waiting period, debts and consent |

Step-by-step process
- Identify the issuing state. Use the state named on the title, not merely the state where the vehicle is parked.
- Read the ownership line. Determine whether the title is individual, joint, TOD-designated or subject to a lien.
- Establish the actor. Confirm whether the applicant is a surviving owner, named beneficiary, executor, administrator or heir eligible for a simplified procedure.
- Check probate status. Find out whether a probate case is open, whether a representative was appointed and whether the vehicle is included in the estate.
- Verify a non-probate option. Compare the estate’s facts with every condition on the state affidavit, including waiting periods, value limits, creditor status and required consents.
- Contact the titling agency before signing. Request the current form set and written checklist for a deceased-owner transfer. Confirm how an out-of-state title, lost title or electronic title is handled.
- Resolve liens. Ask the agency and lienholder whether a payoff, lien release or lienholder authorization is required. Texas title guidance expressly calls for a lien release when the record shows a lien in the described process.
- Complete signatures exactly as instructed. The authorized person should use the required representative or heir capacity and obtain notarization where required.
- Submit the packet. Include the title, death evidence, authority documents, application, affidavits, identification and fees required by that state.
- Keep copies and wait for the new title. Retain the submitted forms, proof of delivery and any receipt until the title and registration record show the new owner.
California: REG 5 and other deceased-owner routes
California DMV provides a no-probate route using REG 5 for an heir who meets the form’s conditions. The current form requires a copy of the death certificate and states that at least 40 days must have elapsed since death. It also asks the signer to make assertions concerning whether probate was started, creditor claims, entitlement to the vehicle and the value of the estate.
REG 5 applies to California-titled vehicles or vessels. Its estate-value limits depend on the decedent’s date of death: the form lists $166,250 for deaths before April 1, 2022, and $184,500 for deaths on or after April 1, 2022. These are eligibility limits stated on the current form, not universal small-estate limits. Use the current California form because thresholds and procedures can change.
California also recognizes vehicle transfer-on-death beneficiaries. A TOD beneficiary follows the state’s TOD process rather than automatically using REG 5. California DMV’s deceased-person and title-transfer guidance should be read together with the current form so the applicant uses the route that matches the title record.
New York: different affidavits and an out-of-state warning
New York DMV describes an affidavit route for a surviving spouse or qualifying child or children under 21. It also describes a separate transfer form for certain vehicles worth $25,000 or less when there is no will, no estate, no surviving spouse and no surviving minor child. The $25,000 figure is a New York procedural threshold for the circumstances described there, not a general rule for other states.

When an executor or administrator has authority, New York’s instructions call for the relevant court documents. New York also distinguishes out-of-state titles: its in-state deceased-owner forms cannot transfer an out-of-state title that remains in the deceased owner’s name. An applicant with an out-of-state title should contact the issuing state or follow New York’s separate titling instructions before attempting a transfer.
Texas: probate letters, VTR-262 and title applications
TxDMV says an applicant handling a probated estate should provide original or certified letters testamentary or letters of administration. For a non-probated estate, it lists a completed and notarized VTR-262 Affidavit of Heirship for a Motor Vehicle. The FAQ also identifies the title, Form 130-U and other applicable documents as part of the packet.
Texas statute and the state title manual describe additional operation-of-law and heirship situations. The exact evidence can depend on whether the estate was probated, whether heirs agree, whether a lien appears and how ownership was recorded. Do not treat VTR-262 as a universal substitute for probate or as a form that another state will accept.

Florida Statutes §319.28 provides that an intestate heir may apply without a probate court order when the estate is not indebted and the surviving spouse and heirs have amicably agreed on division of the estate. This is a narrow statutory example. It does not mean every Florida deceased-owner transfer avoids probate, and it does not apply automatically when there is a will, debt, disagreement or another complication. Confirm the current Florida agency requirements for the specific estate.

Illinois and the District of Columbia
Illinois Secretary of State guidance makes the route depend in part on whether the title was issued to one owner or jointly. Supporting documentation changes with that ownership pattern, so applicants should use the Illinois checklist rather than a form from another state.
DC DMV describes a surviving joint-owner process and a non-joint route requiring documentation such as an assignment executed by the estate’s personal representative or executor. The DC examples reinforce that the person receiving the vehicle and the person authorized to sign may be different people.
What changes when a lien, missing title or out-of-state title is involved?
Active lien
A lienholder’s interest does not disappear because the owner died. The agency may require a lien release, payoff confirmation or lienholder authorization before issuing a title to the heir or buyer. Contact both the lienholder and the titling agency; do not rely on a private payoff receipt unless the agency accepts it.
Free tools Windows power users keep installed
One-click scans. No signup required.
Lost or unavailable title
Ask the issuing agency whether an estate representative may request a duplicate title and whether the duplicate request must be filed before the ownership transfer. A death certificate alone generally will not replace the title or prove authority to dispose of the vehicle.
Title issued by another state
Start with the state that issued the title. A local DMV may register the vehicle after transfer, but it may not be able to apply its own deceased-owner affidavit to an out-of-state title. New York expressly warns about this situation.
Common mistakes that cause rejection
- Using a form from the state where the vehicle is currently located instead of the title-issuing state.
- Assuming a spouse or child can sign without proving survivorship, beneficiary status or heirship.
- Submitting only a death certificate.
- Signing the deceased owner’s name or signing as though the deceased were still acting.
- Using an old California REG 5 and its former value limits.
- Ignoring a lien shown on the title record.
- Using a non-probate affidavit without checking waiting-period, creditor, estate-value or consent conditions.
- Submitting photocopies when the agency requires originals or certified copies.
- Failing to notarize an affidavit that the state requires to be notarized.
- Trying to transfer a vehicle while heirs disagree or a court case is unresolved.
When professional probate help is sensible
A local probate or estate attorney may be useful when heirs dispute ownership, a minor inherits, the will conflicts with the title, a trust is involved, creditors may have claims, the vehicle is financed, or the agency rejects the proposed authority documents. Not every transfer requires an attorney, but a disputed or high-value estate can cost more to correct after an unauthorized assignment than to review before filing.
