A Maharashtra consumer commission has directed United India Insurance Company to pay BMW owner Ravikant S Patil the car’s reported insured declared value of ₹70 lakh after the vehicle was left parked overnight following a puncture and was found completely burnt the next day. NDTV’s report says the award also includes ₹50,000 for mental agony and harassment and ₹25,000 in litigation costs, bringing the reported total to ₹70.75 lakh, excluding interest.
What happened to the BMW
According to NDTV’s report published October 13, 2026, the incident began on March 8, 2012, on a state highway near Dhulkhed in Maharashtra. Patil’s BMW suffered a puncture. He reportedly moved the car safely off the road near a roadside dhaba, locked it, secured its windows and returned home in another vehicle, intending to collect it the following day.

When Patil returned, the BMW had been completely gutted by fire. The ensuing insurance dispute lasted 14 years before the consumer commission’s reported decision.

Why the insurer rejected the claim
United India Insurance Company reportedly denied the claim by relying on the policyholder’s duty to take reasonable precautions to prevent further loss. Its position, as described by NDTV, was that leaving the punctured vehicle unattended overnight breached that obligation.

The dispute therefore turned on more than the fact that the car was unattended. It concerned whether Patil had acted reasonably after the breakdown and whether leaving the vehicle where he did could be connected to the fire.
Why the commission reportedly rejected that argument
NDTV says the commission found no absolute policy prohibition against leaving a broken-down vehicle unattended. Its reported assessment focused on the precautions Patil had taken:

What this decision does—and does not—establish
It is a case-specific finding
The reported outcome concerns Patil’s evidence, the precautions he allegedly took and the absence of conclusive proof connecting the overnight parking to the fire. It does not establish that every motor-insurance claim will succeed whenever a burnt or damaged vehicle was left unattended after a breakdown.
“Unattended” is not automatically the same as “negligent”
The insurer’s argument treated the overnight absence as a breach of the duty to take reasonable precautions. The commission reportedly examined the surrounding circumstances instead of treating the word “unattended” as decisive by itself. Causation remained important
Even if a policy requires reasonable precautions, the report says the commission noted no conclusive evidence that leaving the BMW overnight caused the fire. That distinction matters: a policy-condition allegation and proof that the alleged lapse caused or worsened the loss are separate issues.
