Sometimes—but Chinese ownership alone does not make a car illegal. A particular vehicle’s status depends on separate federal tests: whether the Commerce Department’s Connected Vehicles Rule restricts its manufacturer, technology, or sale; whether it meets U.S. safety certification and import requirements; and whether it can be titled and registered under the applicable state’s rules. The most important federal change for new vehicles begins with model year 2027, but it is not a blanket ban on every car associated with a Chinese-owned automaker.
What determines whether a specific car is legal?
“Chinese-owned car” is not, by itself, a complete legal category. For a real purchase or import, assess the vehicle and transaction through three distinct questions:
As an Amazon Associate I earn from qualifying purchases.
- Connected-vehicle restrictions: Does the U.S. Commerce Department’s Bureau of Industry and Security (BIS) rule cover the vehicle, its manufacturer, or relevant software or hardware because of a specified connection to China or Russia?
- Federal safety and import requirements: Was the vehicle manufactured and certified to meet applicable U.S. Federal Motor Vehicle Safety Standards (FMVSS), or does it qualify for an import route such as an NHTSA eligibility determination and Registered Importer process?
- State road-use requirements: Can the specific vehicle be titled, registered, and operated under the rules of the state where it will be kept?
Passing one test does not settle the others. A vehicle that can be imported under federal safety rules is not automatically clear under the Connected Vehicles Rule, and federal compliance does not guarantee a state will title or register it. Conversely, a brand’s ownership or nationality alone does not answer whether an individual vehicle meets each requirement.

BIS’s Connected Vehicles Rule is a targeted restriction on certain connected-vehicle technology and transactions, not a simple rule that every Chinese-branded or Chinese-owned vehicle is prohibited. BIS’s overview says the rule took effect on March 17, 2025. Its coverage turns on specified vehicle technology and a required China or Russia nexus, including ownership, control, or jurisdiction or direction tests described by BIS.

The rule applies to passenger vehicles weighing under 10,001 pounds. BIS describes covered Vehicle Connectivity System (VCS) hardware and software, as well as Automated Driving System (ADS) software. VCS refers to systems that allow external communications; examples include telematics control units and Bluetooth, cellular, satellite, and Wi-Fi modules. The ADS provisions concern software integrated into systems that allow highly autonomous vehicle operation. These descriptions do not mean every Bluetooth radio, modem, or driver-assistance feature is automatically prohibited: the relevant rule definitions, technology, parties, and nexus must be assessed for the particular vehicle and transaction.
Why model year 2027 matters
BIS identifies two restrictions that begin with model year 2027: prohibitions related to covered software and a restriction on sales of connected vehicles by covered manufacturers. The manufacturer sales restriction may apply even if the vehicle is assembled in the United States. That means assembly location alone does not resolve whether a covered manufacturer may sell a vehicle in the U.S.
Model year is not interchangeable with the calendar year in which someone buys a car. A vehicle sold in one calendar year may have a different model year, and the rule’s key dates are stated by model year. Before relying on a dealer listing, confirm the vehicle’s model year and configuration and ask how the seller has assessed the applicable BIS requirements. The available federal guidance summarized here does not establish a one-step consumer lookup that determines legality for every trim, software package, supplier, or transaction.

Hardware has a later phase-in
The VCS hardware prohibition has a separate, later phase-in: BIS identifies model year 2030, or January 1, 2029 for units without a model year. Do not collapse that schedule into the model year 2027 software and manufacturer-sales restrictions. A vehicle could raise a software or sales issue before the hardware phase-in date; the later hardware date is not a blanket permission for all earlier transactions.
Authorizations do not automatically clear a vehicle
BIS lists general authorizations, specific authorizations, and advisory opinions as routes relevant to compliance. It also lists active general authorizations, including amended authorizations dated June 18, 2026. Their existence does not prove that a particular manufacturer, vehicle, software package, or sale qualifies. BIS says a party owned by, controlled by, or subject to the jurisdiction or direction of China or Russia is excluded from relying on the general authorizations described in its guidance. For a concrete transaction, the applicable live BIS guidance and any required authorization need to be checked rather than inferred from the fact that an authorization program exists.
Federal safety certification and importing are a separate test
Under 49 U.S.C. § 30112, federal law generally bars manufacturing a vehicle for sale, selling or offering it for sale, or importing it unless it complies with applicable FMVSS and has the required certification, subject to statutory exceptions. This safety-and-certification baseline is independent of the BIS connected-vehicle restrictions.

NHTSA’s Importation and Certification FAQs explain that a vehicle not originally manufactured to comply with all applicable FMVSS and certified by its manufacturer generally must first be determined eligible for importation. For that nonconforming-vehicle route, NHTSA describes import by a Registered Importer, or by a person contracted with one to bring the vehicle into conformity. NHTSA makes eligibility decisions by make, model, and model year. An eligibility listing for one vehicle configuration or year should not be treated as approval for every car that looks similar or carries the same badge.
Do these 3 things before closing this tab:
1Fix the driver behind crashes, sound loss and screen glitches2Repair Windows errors before they cause bigger problems3Scan for outdated or missing drivers - takes under a minuteFor vehicles at least 25 years old, NHTSA says the vehicle may be lawfully imported without regard to whether it complies with all applicable FMVSS; the 25-year period runs from the date of manufacture. This is an import-law exception described by NHTSA, not a blanket exemption from every other applicable rule. It does not, by itself, settle BIS restrictions or state title, registration, and road-use requirements.
How to check a car before buying or importing it
Use the sequence below for the exact car, not just the automaker or brand. A seller’s assurance that a vehicle is “U.S.-spec,” a foreign-market car’s physical similarity to a U.S. model, or U.S. assembly alone is not a substitute for checking the relevant requirements.

- Identify the exact vehicle. Record the make, model, model year, vehicle identification number (VIN), configuration, and—if importing—date of manufacture and country of origin. Ask whether the vehicle has the manufacturer’s U.S. certification label. Do not assume the nameplate alone identifies its software, connectivity equipment, or certification status.
- Pin down the transaction. Determine whether you are buying a vehicle already offered for U.S. sale, purchasing one from a private party, or importing it yourself. Note when the sale or import would occur. A model-year-based rule and the particular transaction date answer different questions.
- Assess the BIS nexus and covered technology. For a connected vehicle under 10,001 pounds, establish whether the rule’s VCS or ADS provisions are implicated, who manufactures or controls the relevant operation, and whether the required China or Russia ownership, control, jurisdiction, or direction nexus applies. Ask for a compliance basis tied to the actual model year and configuration, not just a general statement about the brand.
- Check the applicable BIS date and authorization. Separate model year 2027 software and covered-manufacturer sales restrictions from the later VCS hardware phase-in. If a party relies on an authorization, confirm that it covers the specific party, technology, vehicle, and transaction and that the party is eligible to rely on it. Do not infer an exemption from a general authorization’s existence.
- Verify federal safety and import status. For a U.S.-market vehicle, inspect the manufacturer certification label and confirm the vehicle’s certification applies to the car being sold. For a nonconforming import, check NHTSA’s eligibility determination for the exact make, model, and year, then establish the required Registered Importer or contracted process. If relying on the 25-year exception, calculate from the manufacture date and still check other rules.
- Ask the state motor vehicle agency about title and registration. Give the agency the VIN and documentation for the exact car, and ask what it requires for title, registration, inspection, and road use. The federal rules discussed here do not establish a state-by-state answer.
- Get material claims in writing before paying. Keep the VIN-specific certification, import, and compliance records and written answers about the vehicle’s model year and configuration. If a seller cannot explain the legal basis for a U.S. sale or the import path, do not treat that uncertainty as proof of eligibility.
What Polestar’s disclosure does—and does not—show
Polestar’s SEC-filed interim report for the first half of 2026 provides a company-specific example. Polestar reported that it was informed on June 25, 2026 that BIS would not grant authorization under the current Connected Vehicles Rule for its U.S. sales from model year 2027 onward. The company said it expected to continue selling previous model years from inventory and then cease new-vehicle sales, while continuing U.S. customer support.
That disclosure describes Polestar’s stated circumstances and plan; it does not establish the outcome for every automaker with Chinese ownership. Nor should its inventory statement be taken as proof that every vehicle from an earlier model year is automatically lawful to sell, import, register, or drive. Each vehicle remains subject to its applicable federal certification and import rules, any relevant BIS restrictions, and state requirements.

An Associated Press report dated September 30, 2026 said legislation intended to impose a broader permanent ban had stalled in the Senate and was expected to wait until after the November elections. That report described a proposal, not enacted law. It is separate from the BIS rule already in effect. Because legislative status can change, check the current status of any bill before treating a reported proposal as law.

Common mistakes to avoid
- “Chinese-owned means illegal.” The rule described by BIS is not a simple ownership-only ban; its requirements involve covered technology, specified nexus tests, transaction restrictions, and phase-in dates.
- “It was built in America, so the rule cannot apply.” BIS says the covered-manufacturer sales restriction can apply even when a vehicle is made in the United States.
- “The hardware date is 2030, so nothing changes before then.” Software-related restrictions and covered-manufacturer sales restrictions begin with model year 2027; the hardware phase-in is distinct.
- “NHTSA eligibility means it is approved for everything.” Import eligibility addresses a specific safety/import route. It does not decide BIS compliance or guarantee a state will title and register the vehicle.
- “A similar model year is close enough.” NHTSA decisions are make-, model-, and model-year-specific, while BIS analysis can depend on the actual technology, parties, and transaction.
- “A proposed ban is already law.” The AP report described legislation that had stalled; a proposal is not the same as an enacted statute or an effective regulation.
What can be concluded for a particular car?
Without the exact vehicle, model year, configuration, manufacturer and technology relationships, sale or import route, and state, no reliable yes-or-no legal conclusion is possible. For a new connected vehicle at or after the model year 2027 phase-in, the BIS questions may be especially important. For an individually imported car, federal safety certification and the correct eligibility path are also central. For either kind of vehicle, state title and registration requirements remain a separate final check.
The safest practical approach is to verify the specific VIN and model year against the relevant BIS requirements, federal certification or import route, and the motor vehicle agency in the state where the car will be registered. Do not rely on nationality, assembly location, a broad brand statement, or federal import eligibility alone.
