25-Year Import Rule: Everything You Need To Know

The 25-year rule can exempt an older foreign-market vehicle from U.S. safety standards, but it does not eliminate EPA, customs, tariff, or state registration requirements.

The U.S. 25-year import rule is often described as a shortcut for bringing an overseas-market car into the country. It is a shortcut—but only for one part of the process. Once a vehicle is at least 25 years old, NHTSA generally exempts it from compliance with applicable Federal Motor Vehicle Safety Standards (FMVSS). That does not automatically waive EPA emissions rules, customs entry, tariffs, shipping costs, or your state’s title and registration requirements.

The most important detail is the vehicle’s exact manufacture date. Model year alone is not enough. A car built on August 10, 2001, reaches the federal safety exemption on August 10, 2026, even if it is advertised as a 2001 model.

What the 25-year import rule actually exempts

NHTSA’s rule allows a vehicle that is at least 25 years old to be permanently imported without being brought into compliance with the applicable U.S. FMVSS requirements. This is the rule that makes many older Japanese, European, Australian, and other gray-market vehicles practical to import.

At entry, the importer claims the exemption on DOT Form HS-7, Box 1. The form’s declaration is effectively saying that the vehicle is 25 or more years old and therefore does not need to meet the safety standards that would normally apply to a non-U.S.-certified vehicle.

This does not mean the vehicle can cross the border with no paperwork. You still need a customs entry, ownership documents, the required EPA declaration, and payment of applicable duties and fees. The exemption also does not guarantee that your state will title or register the car.

How to calculate the 25 years

NHTSA bases the age calculation on the vehicle’s date of manufacture, not simply its model year. Manufacturers commonly build the next model year before the calendar year changes, which is why the two dates cannot be treated as interchangeable.

Vehicle information What it tells you What it does not prove
2001 model year The vehicle was marketed as a 2001 model That it was manufactured early enough to qualify on a particular date
August 10, 2001 manufacture date The vehicle reaches 25 years on August 10, 2026 That every similarly labeled 2001 vehicle qualifies at the same time
Factory identification plate showing month and year Useful evidence of when the vehicle was built That the vehicle is original or emissions-compliant for EPA purposes

For example, a 2001-model vehicle built on August 9, 2001, generally qualifies for the NHTSA exemption on August 9, 2026. One built on August 10, 2001, generally does not qualify until August 10, 2026.

What if the manufacture date is missing?

Do not guess based on a listing headline or registration year. Look for the manufacturer’s permanent label, usually located in a door jamb, engine compartment, or another factory-designated area. If that label does not provide a usable date, supporting evidence may include:

  • an original invoice showing the sale date;
  • a registration document proving the vehicle was registered at least 25 years earlier;
  • a letter from the manufacturer; or
  • a statement from a recognized vehicle historical society.

Resolve the date before buying or shipping the car. If the vehicle arrives before it qualifies, the 25-year exemption cannot simply be applied because it will become eligible a few weeks later.

The 21-year EPA rule is separate

The other number commonly associated with old-car imports is 21 years. That is primarily an EPA emissions exemption—not the NHTSA safety exemption.

EPA Form 3520-1 uses import code E for a vehicle that is at least 21 years old under EPA’s calendar-year calculation and remains in its original, unmodified configuration. In 2026, that calculation generally reaches vehicles manufactured in calendar year 2005 or earlier, provided the other EPA conditions are satisfied.

For a typical 25-year-old foreign-market car, the importer normally submits both:

  1. DOT Form HS-7: select Box 1 for the 25-year NHTSA safety exemption.
  2. EPA Form 3520-1: use code E only if the vehicle meets EPA’s age and original-configuration requirements.

These rules can produce an awkward result: a car may be old enough to avoid FMVSS compliance but still fail the EPA exemption because it has been modified. EPA’s original-configuration requirement matters especially when the car has a non-original engine, altered emissions equipment, or other changes that affect its certified configuration.

Do engine swaps and restorations matter?

For NHTSA’s 25-year safety exemption, the vehicle’s age is tied to the manufacture of the vehicle itself. An older engine or a collection of old parts does not make a newly built vehicle 25 years old. A recently assembled replica, new chassis, or replacement body cannot qualify merely because some components came from a vintage car.

Modifications do not necessarily destroy the NHTSA age exemption. They can, however, prevent the vehicle from qualifying for EPA code E. A newer replacement engine is a common problem. EPA generally expects the replacement engine and emissions-control system to be equivalent to, or newer than, the certified original equipment—not simply any engine that fits in the bay.

Ask for detailed photographs and records before purchasing a modified import. A car advertised as “25-year legal” may be referring only to DOT status while overlooking its EPA configuration.

Documents required at import

The exact process depends on the port, shipping method, vehicle type, and whether you use a customs broker. In general, prepare:

  • the original title or a certified title copy;
  • the bill of sale or purchase invoice;
  • the VIN and evidence of the manufacture date;
  • completed DOT Form HS-7;
  • completed EPA Form 3520-1;
  • the bill of lading and other shipping documents; and
  • any documents required by the vehicle’s country of export or the receiving port.

At entry, declare the vehicle to U.S. Customs and Border Protection (CBP), submit the required forms, and pay the applicable charges. After the formal entry is processed, CBP issues Form 7501, Entry Summary. Keep it permanently. Your state DMV may require it before issuing a title or registration.

Never sign HS-7 or EPA paperwork casually. The forms contain legal declarations, and a false claim can result in penalties, including fines or imprisonment. If the car is not yet eligible, the correct answer is to wait or use another lawful import pathway—not to use an earlier model-year date.

How much does it cost?

The 25-year rule eliminates the need for FMVSS conversion work and the registered-importer process normally associated with a newer nonconforming vehicle. It does not make the import duty-free.

CBP’s traditional base rates are often summarized as 2.5% for passenger cars, 25% for trucks, and 2.4% or free for motorcycles depending on classification. Those figures are not a guaranteed final rate. Country of origin, vehicle classification, trade measures, Section 232 duties, reciprocal tariffs, and other Chapter 99 provisions can change the amount. Check the current Harmonized Tariff Schedule and CBP instructions for the specific vehicle before shipping it.

Other costs may include:

  • Merchandise Processing Fee;
  • Harbor Maintenance Fee for qualifying ocean shipments;
  • customs-broker fees;
  • ocean or air freight;
  • terminal, storage, and inspection charges;
  • inland transport;
  • repairs needed after arrival; and
  • state title, registration, sales, use, and inspection taxes.

A cheap purchase price can become an expensive project if the car sits at a port while documents are corrected. Get a landed-cost estimate before committing to the purchase.

Federal entry does not equal state registration

Import approval and road registration are separate decisions. Your state may require a VIN inspection, odometer disclosure, safety inspection, emissions testing, insurance, translated documents, or a specific title brand for a gray-market, reconstructed, or salvage vehicle.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Before paying the seller, contact the DMV or equivalent agency in the state where you will register the car. Ask specifically whether it will accept:

  • the foreign title;
  • the VIN format and any required physical inspection;
  • CBP Form 7501 as proof of legal entry;
  • the vehicle’s emissions configuration; and
  • the proposed title brand.

Some states are more restrictive than others, and a federal exemption cannot force a state agency to issue a title. A car that clears customs can still be difficult or impossible to register for normal road use in a particular state.

A practical import sequence

  1. Verify the exact manufacture date. Obtain a clear photo of the factory plate or reliable documentary evidence.
  2. Check the vehicle’s identity. Confirm the VIN, title, ownership history, salvage status, and whether it is a true production vehicle rather than a replica or newly assembled car.
  3. Review modifications. Pay particular attention to engine swaps and emissions equipment if you expect to use EPA code E.
  4. Check your state first. Confirm title, inspection, and emissions requirements before arranging transport.
  5. Estimate the landed cost. Include duty, current tariffs, fees, shipping, storage, broker charges, taxes, and repairs.
  6. Prepare the entry documents. Complete HS-7 and EPA Form 3520-1 accurately, and provide the title, invoice, shipping documents, and age evidence.
  7. Complete formal CBP entry. Keep the stamped or electronically issued entry records, especially Form 7501.
  8. Apply for title and registration. Bring the CBP documents and all state-required paperwork to the DMV.

When the 25-year exemption does not apply

Vehicles that are not yet 25 years old may still have other import options, depending on their circumstances. These can include a vehicle built to U.S. standards, a Canadian-certified vehicle meeting the applicable requirements, importation through a registered importer, or a temporary import for a qualifying nonresident.

Special pathways may also exist for racing vehicles, research or testing, display and show purposes, and vehicles not primarily manufactured for on-road use. These alternatives have their own restrictions. For example, a nonresident’s temporary personal-use import can generally remain in the country for up to one year, cannot be sold in the United States, and must be exported when the permitted period ends.

Common mistakes to avoid

Claim What is wrong with it
“It is a 25-year-old model, so it qualifies.” NHTSA uses the manufacture date, not just the model year.
“The 21-year rule is the import rule.” Twenty-one years generally concerns EPA emissions; NHTSA’s safety exemption is 25 years.
“No forms are needed for an old car.” HS-7, EPA documentation, CBP entry, ownership records, and customs declarations still matter.
“Any engine swap is acceptable after 21 years.” EPA code E depends on original configuration and has specific replacement-engine limitations.
“CBP entry guarantees a title.” State DMVs apply their own title, inspection, emissions, and registration rules.
“The exemption makes the car inexpensive to import.” Duty, tariffs, shipping, storage, broker fees, repairs, and taxes remain.

FAQ

Can I import a car as soon as it reaches its 25th model year?

Not necessarily. NHTSA generally uses the vehicle’s actual manufacture date. Verify the day, month, and year rather than relying only on the model-year designation.

Do I need both DOT Form HS-7 and EPA Form 3520-1?

For a typical foreign-market vehicle, yes. HS-7 Box 1 addresses the NHTSA safety exemption. EPA Form 3520-1, usually with code E for an eligible original vehicle, addresses emissions requirements.

Does the 25-year rule eliminate import duty?

No. It removes the need for FMVSS compliance, but customs duty, current tariffs, processing fees, shipping, storage, broker charges, and state taxes may still apply.

Can my state refuse to register a car that CBP allowed into the country?

Yes. Federal import entry and state registration are separate. A DMV may require a VIN inspection, emissions or safety testing, proof of CBP entry, specific title documents, or may reject the vehicle under state law.

The Bottom Line

The 25-year rule is best understood as a NHTSA safety exemption, not a universal old-car pass. Confirm the manufacture date, file HS-7 Box 1 correctly, satisfy EPA requirements separately, complete a formal CBP entry, budget for current import costs, and obtain your state DMV’s approval before the car leaves the seller’s country.
