What the U.S. Connected-Vehicle Rule Actually Bans—and What It Doesn’t

The U.S. has not banned every Chinese or Russian vehicle. Its connected-vehicle rule targets defined VCS hardware, covered software, and certain manufacturers, with major exemptions and phased deadlines.

The United States has not banned all Chinese- or Russian-made cars, electric vehicles, or connected technology. Instead, the Commerce Department’s Bureau of Industry and Security (BIS) has restricted specific transactions involving China- or Russia-linked vehicle connectivity system (VCS) hardware, covered software, and certain completed connected vehicles.

The rule, published as a final regulation on January 16, 2025, took effect on March 17, 2025. Its requirements then phase in through software, model-year, and hardware transition dates.

The bottom line

The rule is a targeted national-security and supply-chain regulation, not a blanket import ban on “Chinese cars” or “Russian cars.” It applies to defined technologies and corporate relationships, including situations where a vehicle is assembled outside China or Russia but uses covered hardware or software linked to one of those jurisdictions.

BIS says modern vehicles can collect sensitive information, communicate externally, and create pathways for remote access, manipulation, espionage, or disruption. Those are government risk determinations; they do not mean every covered vehicle or component has been proven unsafe or used for spying.

The rule appears in 15 C.F.R. Part 791, Subpart D, under authorities including Executive Order 13873 and related IEEPA provisions.

What transactions are prohibited?

Unless covered by a general authorization or approved through a specific authorization, the rule prohibits or restricts:

  • U.S. imports of specified VCS hardware linked to China—including Hong Kong and Macau—or Russia.
  • Imports of completed connected vehicles that contain covered software.
  • Sales in the United States of completed connected vehicles containing covered software.
  • Sales by a connected-vehicle manufacturer owned by, controlled by, or subject to the jurisdiction or direction of China or Russia when the vehicle contains VCS hardware or covered software.

The last category is especially significant: for a China- or Russia-controlled manufacturer, the restriction can apply even when the individual hardware or software component does not itself have a Chinese or Russian origin connection.

That is why “made in China” is an incomplete test. BIS looks at the technology, supplier, design, development, manufacture, ownership, control, jurisdiction, direction, and transaction involved.

What counts as a connected vehicle?

A connected vehicle is not simply an electric vehicle or an autonomous vehicle. The relevant question is whether it has systems that communicate outside the vehicle or support covered automated-driving functions.

Connectivity can include:

  • Cellular communications and telematics
  • Wi-Fi and Bluetooth
  • Satellite communications
  • Wireless communication modules and external antennas
  • Other systems that transmit vehicle or operating data externally

Many modern gasoline, hybrid, electric, passenger, and light-duty vehicles may contain some of these functions. However, having connectivity alone does not automatically make a vehicle prohibited. The particular technology and its foreign nexus must fit the rule’s definitions.

What is VCS hardware?

VCS hardware generally means software-enabled or programmable components that directly enable vehicle connectivity. Examples include:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • Microcontrollers, microcomputers, and systems-on-chip
  • Telematics or networking control units
  • Cellular modems and modules
  • Wi-Fi and Bluetooth modules
  • Satellite-communications systems
  • Other wireless-communications modules
  • External antennas
  • Digital signal processors
  • Field-programmable gate arrays

The rule can therefore reach a relevant subcomponent integrated into a larger connectivity system. It is not limited to a complete telematics control unit.

  • Compatibility with Third-party Software: The vLinker FS USB is compatible with a variety of third-party apps and software, allowing you to view and analyze the data in a way that suits your needs.

Passive items such as brackets, fasteners, plastics, and certain passive electronic components are excluded. Automotive radar and LiDAR were also excluded from the VCS hardware definition, although other automated-driving systems can still fall within the rule.

What software is covered?

Covered software is software with a foreign interest that is executed by the primary processing unit of an item directly enabling vehicle connectivity or covered automated-driving functionality at the vehicle level.

The category expressly includes:

  • Application software
  • Middleware
  • System software
  • Operating-system-level software

Firmware is generally excluded as the rule defines it. The distinction matters because automotive software stacks do not always divide cleanly into firmware, middleware, and operating-system layers. BIS acknowledged that companies may need to use their system architecture and established industry methodologies to make good-faith determinations.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Open-source software

Genuinely open-source software can qualify for an exclusion when the complete source code is available for use, study, modification, and redistribution. That is not a blanket exemption for any product containing publicly available code. The exclusion may not apply when code is modified for proprietary purposes and the modified version is not redistributed or shared.

Legacy software

Certain legacy software components designed, developed, manufactured, or supplied before March 17, 2026, remain excluded if they were not later maintained, augmented, or altered by a China- or Russia-linked entity. The cutoff does not mean that every software component created before that date is automatically exempt; the later maintenance and alteration conditions also matter.

Software is not treated as China- or Russia-linked solely because an individual employee or contractor is a citizen of one of those countries. The relevant foreign-interest analysis is broader and more specific than an employee-nationality test.

Does the rule cover autonomous driving and driver assistance?

Yes, but only where the technology fits the rule’s automated-driving-system (ADS) definitions. The regulation focuses on VCS and ADS-related information and communications technology, not every electronic component in a vehicle.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

That creates an important distinction:

  • VCS covers systems that enable external communications and connectivity.
  • ADS covers systems capable of performing the automated-driving functions specified by the rule.
  • ADAS is a broader industry term. A driver-assistance feature is not automatically covered merely because it is marketed as ADAS.

Radar and LiDAR are not VCS hardware under the final rule, but software or other systems associated with automated driving may still be within scope if they meet the applicable definitions.

  • 18V ECU PROGRAMMING SUPPORT - Delivers up to ~18V output for ECU programming and flashing on select older US-market vehicles. (Always consult service documentation or qualified technician before use)

Who is most affected?

  • Vehicle manufacturers and original-equipment manufacturers
  • U.S. importers of completed connected vehicles
  • Suppliers of telematics, cellular, Wi-Fi, Bluetooth, satellite, and networking equipment
  • Tier-one and tier-two automotive suppliers
  • Companies integrating foreign-developed connectivity or ADS software
  • Manufacturers owned or controlled by Chinese or Russian entities
  • Companies using subsidiaries, joint ventures, contract manufacturers, or opaque third-country supply chains

A vehicle assembled in the United States, Mexico, Europe, or Southeast Asia is not automatically outside the rule. If its relevant modem, telematics unit, operating-system layer, middleware, or application software was designed, developed, manufactured, or supplied by a covered person, the vehicle may require a detailed compliance review.

Important exclusions and limits

Situation What the final rule does
All Chinese or Russian vehicles Not automatically banned.
All Chinese or Russian components Not automatically banned; the component and technology must meet the rule’s definitions and nexus tests.
Commercial vehicles Excluded from this final rule, including covered buses and heavier commercial vehicles.
Recreational vehicles over 10,000 pounds Generally outside this rule.
Automotive radar and LiDAR Excluded from the VCS hardware definition.
Passive parts Items such as brackets, fasteners, plastics, and certain passive electronics are excluded.
Existing consumer vehicles The rule does not automatically require owners to remove or disable installed technology.
Older-vehicle repairs and warranty work Specified treatment exists for hardware imported to repair or support warranty work on vehicles with model years before 2030.

The commercial-vehicle exclusion is particularly important for truck, bus, and logistics operators. BIS said it intended to consider a separate commercial-vehicle regulation because that sector raises serious but distinct issues. A future proposal or rule should not be confused with a restriction already enacted under this final rule.

Key dates

Date Significance
February 29, 2024 Commerce began the regulatory process with an advance notice focused initially on connected-vehicle technology from the People’s Republic of China.
September 26, 2024 Commerce issued its proposed rule.
January 16, 2025 The final rule was scheduled for Federal Register publication.
March 17, 2025 The final rule took effect after its stated 60-day period.
March 17, 2026 Cutoff used for specified legacy-software treatment.
Model year 2027 Relevant to specified completed-vehicle exemptions and transition provisions.
January 1, 2029 Major VCS hardware transition date for hardware not associated with an earlier model year.
Model year 2030 Important boundary for specified VCS hardware, repair, warranty, and older-vehicle provisions.

It is misleading to say that “the ban starts in 2027.” Different restrictions use different dates, and the rule includes legacy, model-year, repair, warranty, and authorization provisions.

How compliance works

The rule creates an affirmative compliance regime rather than relying only on customs screening at the border.

Declarations of Conformity

Covered connected-vehicle manufacturers and VCS hardware importers may need to file a Declaration of Conformity with BIS. In general, the declaration must be submitted:

  • Before the first import of relevant VCS hardware
  • Before the first import or U.S. sale of each relevant model year of a completed connected vehicle
  • Annually through confirmation or recertification
  • Within 60 days after discovering a material change affecting the declaration

Filing is electronic and follows BIS instructions. Companies should map the entire relevant software and hardware chain rather than relying only on the vehicle brand or final assembly location.

General and specific authorizations

A general authorization permits specified categories of transactions that would otherwise be prohibited. A transaction that does not qualify may be eligible for a specific authorization if the applicant can demonstrate that it does not pose an undue or unacceptable national-security risk.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

A specific authorization is not an automatic waiver or routine certification. It depends on BIS review. Companies facing uncertainty can also use the rule’s advisory-opinion mechanisms for fact-specific questions.

Practical examples

A U.S.-assembled vehicle uses a China-linked cellular modem

U.S. assembly does not resolve the issue. The importer and manufacturer would need to determine whether the modem is VCS hardware, how it is linked to the relevant jurisdiction, whether a transition provision applies, and whether the transaction is prohibited or authorized.

A European brand uses software maintained by a China-controlled subsidiary

The brand’s headquarters and vehicle assembly location are not the only facts that matter. If the subsidiary maintained, augmented, or altered covered software after the relevant cutoff, the software may not qualify for legacy treatment.

A Chinese-owned automaker builds vehicles in the United States

U.S. manufacturing does not necessarily avoid the rule. Ownership and control are independent parts of the analysis, and restrictions can apply to sales by a China- or Russia-controlled connected-vehicle manufacturer.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

A dealer imports a replacement telematics unit for an older vehicle

The rule contains specified repair and warranty treatment for hardware used with vehicles having model years before 2030. The dealer still needs to confirm that the particular transaction meets the applicable conditions.

A bus fleet uses covered connectivity technology

Commercial vehicles, including covered buses and heavier vehicles, are excluded from this final rule. That does not establish that commercial fleets face no future regulation; BIS has indicated that a separate commercial-vehicle action was contemplated.

What this means for consumers

For consumers, the rule is mainly prospective and transaction-focused. It does not automatically make an already-owned vehicle illegal, require its owner to remove a modem, or prohibit ordinary repairs where an applicable exception exists.

Consumers should also avoid two opposite assumptions: a Chinese or Russian brand is not automatically prohibited, and a non-Chinese or non-Russian brand is not automatically clear. The compliance question may concern an unseen supplier, connectivity module, software layer, or corporate relationship.

What manufacturers and suppliers should verify

  1. Identify every VCS and ADS-related hardware and software component in each affected vehicle and model year.
  2. Classify software carefully as application software, middleware, system software, operating-system software, firmware, or another category under the rule.
  3. Trace design, development, manufacture, supply, maintenance, ownership, control, jurisdiction, and direction—not only final assembly.
  4. Document subsidiaries, joint ventures, contract manufacturers, cloud or software-maintenance relationships, and third-country suppliers.
  5. Check legacy, model-year, repair, warranty, and other transition provisions.
  6. Determine whether a general authorization applies before treating a transaction as permitted.
  7. Seek a specific authorization or advisory opinion when the facts do not fit a clear authorization or exclusion.
  8. Prepare and update Declarations of Conformity, including the 60-day material-change requirement.

For official filing and authorization information, BIS directs companies to its Office of Information and Communications Technology and Services.

What happens next?

The immediate compliance landscape is defined by the passenger- and light-duty-vehicle rule now in force. BIS has separately indicated that it contemplated a tailored commercial-vehicle regulation. Until such an action is enacted, operators should not describe commercial vehicles as covered by this final rule—but they also should not treat the current exclusion as a permanent guarantee.

The practical effect is a continuing shift toward detailed automotive technology and ownership due diligence. Vehicle companies will need to know not just where a vehicle is assembled, but who designed, supplied, maintained, controlled, and ultimately operates the connectivity and automated-driving layers inside it.
