Elon Musk Didn’t Say “I Lied”—But Tesla’s HW3 Admission Revives the FSD Promise Dispute

Musk did not literally admit to lying, but Tesla’s acknowledgment that Hardware 3 cannot achieve unsupervised FSD revives serious questions about years of FSD promises and what owners may be owed.

Elon Musk did not literally say, “I lied to Tesla customers.” During Tesla’s April 22, 2026 earnings call, he said the company’s Hardware 3 computer “simply does not have the capability to achieve unsupervised FSD.” That statement conflicts with years of Tesla messaging about future self-driving capability, but it is not, by itself, a legal admission of fraud or intentional deception.

The practical issue is serious for Tesla owners who paid for Full Self-Driving: Tesla has acknowledged a hardware limitation, discussed possible HW3-to-HW4 conversions, and has not established universal retrofit terms, pricing, timing, or compensation.

What Musk actually said about Tesla Hardware 3

At Tesla’s Q1 2026 financial-results discussion on April 22, Musk said:

“Unfortunately, Hardware 3 — I wish it were otherwise — but Hardware 3 simply does not have the capability to achieve unsupervised FSD.”

Tesla’s archived earnings-call webcast is the primary source for the statement. Musk reportedly attributed the problem to Hardware 3’s memory-bandwidth limitations.

That is an admission about the capability of a computer platform—not an admission that Musk knowingly lied. Whether earlier Tesla statements were predictions, misleading marketing claims, contractual promises, or intentional misrepresentations would require examining the exact wording, dates, sales documents, and evidence of intent.

Why the statement matters to FSD buyers

Hardware 3 began appearing in many Tesla vehicles around 2019. Tesla marketed vehicles with the relevant equipment as having the hardware needed for future Full Self-Driving capability. Buyers could therefore reasonably understand that later software updates—not a replacement computer—would deliver the promised functionality.

Musk reportedly acknowledged in January 2025 that Hardware 3 would not be sufficient for fully autonomous driving. The April 2026 comments appear to reaffirm and expand that position rather than reveal the limitation for the first time.

The dispute is not simply whether Tesla’s current software makes mistakes. It is whether the computer installed in particular vehicles can ever support the unsupervised operation customers were led to expect.

FSD (Supervised) is not autonomous driving

Tesla’s current customer-facing product is labeled FSD (Supervised). Tesla’s Q1 2026 investor update says active driver supervision is required and that the system does not make the vehicle autonomous.

In practical terms:

  • The driver remains legally and operationally responsible.
  • The driver must continuously monitor the road and be ready to intervene.
  • A car completing a route without an immediate intervention is not necessarily driving autonomously.
  • Supervised driver assistance can continue improving even if Hardware 3 cannot meet Tesla’s unsupervised target.

Tesla also reported unsupervised Robotaxi operations in selected U.S. locations. That is a separate deployment and does not prove that ordinary customer-owned Hardware 3 vehicles—or even all Hardware 4 vehicles—can perform the same task.

What Hardware 4 could change

According to reporting on the earnings-call discussion, Musk said Tesla was considering converting or retrofitting Hardware 3 vehicles to Hardware 4. He suggested that Hardware 4 would allow vehicles to enter the Robotaxi fleet and use unsupervised FSD. He also mentioned possible “microfactories” and a discounted trade-in program.

Those comments are not the same as a formal, available retrofit program. The available material does not establish:

  • Whether every Hardware 3 vehicle will be eligible;
  • Whether the upgrade would be free, discounted, or paid;
  • Whether cameras as well as the computer would need replacement;
  • When installations would begin;
  • Whether owners must request the work;
  • Whether a trade-in would replace the retrofit option; or
  • Whether an upgraded customer vehicle would have the same capabilities as Tesla’s Robotaxi fleet.

A physical hardware replacement is also different from an ordinary over-the-air software update. Owners should wait for written Tesla eligibility and pricing terms before treating a retrofit as a guaranteed remedy.

Which Tesla owners may be affected?

Not every Tesla with Hardware 3 represents the same financial or legal situation. Relevant details include:

  1. Installed hardware: Model year alone does not reliably establish the computer configuration. Owners should check the vehicle’s software or service information and ask Tesla for confirmation.
  2. FSD purchase history: A vehicle equipped with FSD-capable hardware is not necessarily one whose owner paid for FSD. One-time purchasers, subscribers, and owners who never activated the feature may have different claims.
  3. Vehicle configuration: Model, production date, cameras, software version, and regional specification may affect eligibility.
  4. Location: Regulatory approval and feature availability differ by country and state. Tesla’s U.S. Robotaxi disclosures should not be generalized to every market.

Reports describe millions of Hardware 3-equipped vehicles, but that is not the same as millions of confirmed FSD purchasers. Tesla has not supplied a definitive number of customers financially affected by the limitation.

What Tesla has—and has not—promised

Tesla has publicly described FSD (Supervised) as requiring driver attention. Musk has discussed possible HW3-to-HW4 conversions, but the reviewed Tesla materials do not establish a universal retrofit commitment or remedy package.

There is no verified basis here to say that every owner will receive a free upgrade, a refund, a discounted trade-in, or compensation. Likewise, the statement does not establish that Tesla has conceded legal wrongdoing.

What owners should do now

  • Confirm the vehicle’s installed computer and camera configuration through Tesla’s software, service information, or support channels.
  • Save the purchase agreement, FSD invoice or subscription history, delivery documents, and relevant Tesla advertising.
  • Ask Tesla for written answers about retrofit eligibility, cost, timing, FSD entitlement, and any trade-in or refund terms.
  • Do not assume a media report, verbal statement, or future-looking comment is a binding offer.
  • Review any proposed settlement, trade-in, waiver, or arbitration decision with a qualified attorney before accepting it.

Tesla’s official support portal is the appropriate starting point for vehicle-specific information. Its trade-in portal may show a vehicle valuation, but owners should obtain written confirmation of how any FSD purchase or subscription would be treated.

Is this an admission that Musk lied?

Technically: Musk said Hardware 3 cannot achieve unsupervised FSD.

Commercially: That creates a substantial promise-versus-delivery issue for customers who paid for future self-driving capability based on the installed hardware.

Legally: It is not enough, standing alone, to prove intentional deception or fraud. A failed prediction, an overly broad marketing claim, negligence, and a knowingly false statement are different legal questions. Lawsuits or customer allegations would not establish liability unless a court or settlement did so.

Tesla’s own current terminology makes the most important distinction clear: FSD (Supervised) is not autonomous operation. The unresolved question is what Tesla will do for owners who paid for a future capability that the company now says Hardware 3 cannot support.
