The U.S. 25-year import rule is a National Highway Traffic Safety Administration (NHTSA) exemption from federal vehicle safety standards: a vehicle at least 25 years old may be imported without meeting the applicable Federal Motor Vehicle Safety Standards (FMVSS). The age is measured from the vehicle’s manufacture date, not simply its model year. This exemption does not automatically satisfy separate EPA emissions, customs-entry, or state registration requirements.
What the 25-year rule covers
NHTSA states that a motor vehicle at least 25 years old can be imported without regard to whether it complies with applicable FMVSS. The rule addresses federal safety-standard compliance; it is not a general waiver of every requirement for bringing a car into the United States.

For the NHTSA declaration, the agency directs importers of qualifying vehicles to select Box 1 on the current version of Form HS-7. Check the form and its instructions in effect when the vehicle enters the country. See NHTSA’s Importation and Certification FAQs.

The relevant age runs from the date of manufacture. A model-year designation or seller’s statement alone may not establish that date. If the permanent label affixed by the original manufacturer does not show the manufacture date, NHTSA identifies these records as possible evidence:

Confirm that the documents relate to the specific vehicle being imported and keep them available for the import process.
Does the rule exempt a car from EPA emissions requirements?
No. NHTSA’s 25-year exemption concerns FMVSS, while the Environmental Protection Agency (EPA) administers separate emissions requirements under the Clean Air Act. EPA describes a separate provision for vehicles at least 21 years old that are in their original, unmodified configuration and meet an engine-equivalence condition. The vehicle’s engine and modification history therefore matter; the NHTSA age exemption does not itself establish that the vehicle qualifies under EPA rules.

EPA says a nonconforming vehicle generally needs appropriate independent-commercial-importer arrangements or an applicable EPA exemption before shipment and entry. Review EPA’s importing vehicles and engines guidance and confirm how the provision applies to the particular vehicle and engine.
What else is required to bring the vehicle into the country?
Federal safety and emissions declarations are only part of the process. U.S. Customs and Border Protection (CBP) says importers file Form HS-7 for the DOT/NHTSA declaration and EPA Form 3520-1 at entry. For a vehicle qualifying under EPA’s over-21-year provision, CBP directs importers to use code E and provide supporting documentation such as the title.

CBP also advises keeping proof of ownership and the customs entry record, CBP Form 7501, which may be useful when seeking registration later. Its classic and antique vehicle guidance explains the entry paperwork. Check the DMV or equivalent agency in the state where you intend to title the car: the federal exemption does not standardize state title, inspection, or registration requirements.

A nonconforming vehicle under 25 years old generally needs a NHTSA import-eligibility determination. NHTSA makes eligibility decisions by make, model, and model year. When a vehicle is determined eligible, the import route can involve a registered importer or a person contracting with one to modify the vehicle for conformity. This is not a blanket route for every newer nonconforming car; the vehicle must meet the applicable eligibility requirements.

Checks to make before buying or shipping
- Verify the manufacture date. Check the original manufacturer’s permanent label and gather acceptable age evidence if the date is not shown.
- Confirm the NHTSA basis. Determine whether the vehicle is at least 25 years old, already conforms to FMVSS, or requires an under-25-year import-eligibility route.
- Check EPA eligibility separately. Establish the engine’s identity, age, and modification history, and confirm which emissions provision or importer arrangement applies.
- Prepare entry and ownership records. Confirm the required HS-7 and EPA Form 3520-1 declarations and retain ownership documents and the customs entry record.
- Check destination-state rules. Ask the state agency responsible for titles and registration what evidence, inspections, or other steps it requires.
