Tesla’s California DMV Dispute Isn’t Over: What Happened and What Comes Next

Tesla avoided California DMV suspensions after changing its marketing, but filed a court petition challenging the underlying decision. The available records do not establish a later ruling.

Tesla avoided the California Department of Motor Vehicles’ threatened license suspensions by changing its California marketing, but the dispute did not end there. In February 2026, Tesla petitioned Los Angeles County Superior Court to set aside the DMV’s decision. The petition presents Tesla’s arguments—not a court ruling—and the available records do not establish a later decision in that case.

What the California DMV case was about

The case concerned how Tesla described driver-assistance features, especially the terms “Autopilot” and “Full Self-Driving Capability.” The DMV said those names and related claims could mislead consumers into believing the vehicles could drive autonomously. It pointed to marketing language describing trips “with no action required by the person in the driver’s seat,” while stating that the vehicles could not operate as autonomous vehicles. This was an advertising and licensing dispute, not a finding that Tesla’s vehicles had become autonomous. The agency’s finding concerned the marketing of driver-assistance systems and the impression their names and claims conveyed.

How the case moved from a proposed penalty to compliance

Why Tesla is still fighting the DMV

Compliance addressed the threatened suspensions; it did not mean Tesla accepted the DMV’s findings. In its court petition, Tesla asks for a writ of administrative mandamus and declaratory and injunctive relief to set aside the order. It argues, among other things, that the DMV’s conclusions about consumer understanding and the governing legal standard were flawed, and that the proceedings violated due process. Tesla’s petition calls the order “factually wrong, legally flawed, unconstitutional, and should be set aside.” That is Tesla’s characterization in a legal pleading, not a judge’s finding. The records available here establish that Tesla filed the challenge, but do not establish a later ruling or the current docket status of this Los Angeles County case. It would be inaccurate to say that a court overturned the DMV order—or to claim the case remains active—without a current court docket or order.

Did Tesla’s license get suspended?

No. The administrative law judge initially recommended 30-day suspensions, but that was a proposed decision, not the DMV’s final penalty. The DMV changed the terms of the penalty in December 2025 and gave Tesla an opportunity to correct its marketing. What changed in Tesla’s California marketing

According to the DMV’s February 17, 2026 announcement, Tesla stopped using “Autopilot” in its California marketing and had already changed “Full Self-Driving” to “Full Self-Driving (Supervised).” The regulator described the added word as clarifying that the driver must supervise the system. This was the compliance step the DMV said allowed Tesla to avoid the threatened suspensions; it did not resolve Tesla’s separate court challenge to the agency’s findings. (California DMV)

Does “Full Self-Driving (Supervised)” mean the car drives itself?

Not on the basis of this case. The DMV said the systems at issue could not operate as autonomous vehicles, and its February 2026 announcement described the revised name as clarifying driver supervision. The dispute addressed marketing descriptions, not a change in the vehicles’ legal or technical status as autonomous vehicles. (California DMV, December 16, 2025; California DMV, February 17, 2026)

Separate Tesla litigation and permit records

Other developments involving Tesla and driver assistance should not be confused with this DMV case. Tesla’s June 2026 quarterly filing discussed a separate consumer class-action matter, including a Ninth Circuit appeal over class certification with oral argument set for August 31, 2026. That appeal is not the Los Angeles County challenge to the DMV order, and the filing does not report a disposition of the writ petition. (Tesla, Inc., Form 10-Q for the quarter ended June 30, 2026)

Likewise, the DMV’s permit list is a separate matter from the marketing decision. As of September 17, 2026, the page listed Tesla Robotaxi LLC as holding an autonomous-vehicle testing permit with a safety driver. The page’s driverless-testing list, updated April 3, 2026, did not list Tesla. Those permit entries describe testing authorization, not the outcome of the advertising case or Tesla’s court petition.
