The driver, Craig Doty II, said the event happened on May 8 while Full Self-Driving was engaged. The footage and his account do not establish why the car behaved as it did or independently prove that the system failed to detect the train.
What the Tesla train video appears to show
Futurism described four videos of a Tesla traveling through a foggy rural area. In the forward-facing footage, a moving train appears ahead, with a lowered crossing gate and warning lights. The car does not visibly stop, and the driver appears to take control and turn away at the last moment. The report said Doty survived and included a photograph showing the car with its right passenger wheel displaced.
Those visible details do not establish the car’s speed, whether it struck anything, whether anyone was injured, what repairs were needed, or the vehicle’s exact configuration. Nor can the footage alone show what the car’s software detected or why the vehicle moved as it did.
What the driver said happened
In the account quoted by Futurism, Doty said the latest event occurred May 8, 2024, and that he had owned the Tesla for less than a year. He also claimed that in the preceding six months it had twice attempted to drive toward a passing train while FSD was engaged. That history is his account, not an adjudicated finding or a regulator-confirmed record.

Futurism reported the incident from Doty’s post and footage; the specific event was not the subject of an independent technical investigation or a published regulator finding in the sources available here. It is therefore more accurate to say the footage appears to show the approach and that Doty said FSD was engaged than to state as established fact that FSD failed to detect the train or caused a crash. What Tesla says drivers must do
Tesla’s current Model 3 owner manual calls the feature Full Self-Driving (Supervised) and says: “You must remain attentive and be ready to take over at all times while Full Self-Driving (Supervised) is engaged.” The manual warns: “Failure to follow these instructions could cause damage, serious injury or death.” Tesla describes the feature as using camera inputs to guide the car, while making clear that the driver remains responsible and must be ready to intervene. The current supervised-feature name should not be read as the wording used by the driver in 2024. The report referred to the feature as FSD, or “full self-driving,” reflecting the terminology in Doty’s quoted account. Tesla’s Autopilot and Full Self-Driving support page provides the company’s current feature information.

These are counts within an investigation set, not a fleet crash rate, not a count of train-crossing incidents and not findings about Doty’s event. NHTSA discussed limits in the reporting data, including gaps in Tesla telematics, and said it did not rely on a simple crash-rate comparison with other Level 2 systems. The same update says Tesla filed Recall 23V838 on December 12, 2023, after the investigation and discussions with NHTSA; that recall applied to Tesla models equipped with any version of Autopilot and addressed concerns about controls intended to support constant human supervision. It is separate from the May 2024 train video. NHTSA’s EA22002 update.
