But the National Highway Traffic Safety Administration (NHTSA) has escalated its investigation into an estimated 3.2 million Tesla vehicles to an Engineering Analysis—a more advanced stage that can precede enforcement or a recall.
The investigation centers on whether FSD can recognize when its cameras are impaired by fog, glare, dust, dirt, or other visibility problems, then warn the driver early enough to take control safely.

What NHTSA is investigating
NHTSA began a preliminary evaluation of Tesla FSD in October 2024. In March 2026, the agency upgraded the matter to an Engineering Analysis, according to Reuters.

NHTSA’s information request asks about visibility alerts, the timing of those warnings, the FSD software installed during relevant crashes, and the interval between the last warning and a collision. The agency’s original investigative document is available in its official filing.

The central safety question is not simply whether poor visibility can affect a camera. Any camera-based system has physical limits. The question is whether FSD:
- detects the impairment quickly and reliably;
- recognizes hazards despite the reduced visibility;
- gives the driver a clear, timely warning; and
- allows a safe transition from automated assistance back to human control.
Why an Engineering Analysis matters
An Engineering Analysis is more serious than a preliminary evaluation, but it is not a recall order and does not establish that Tesla has committed a legal violation.
- Preliminary Evaluation: NHTSA reviews complaints, crash reports, manufacturer information, and other evidence.
- Engineering Analysis: The agency conducts a deeper assessment of the alleged defect, affected vehicles, safety consequences, and possible remedies.
- Outcome: NHTSA may close the investigation, seek a voluntary recall, order a recall, or take another action.
That progression explains why “on the cusp of a recall” is a reasonable description of the regulatory risk, but not a confirmed event. The investigation could result in a recall; it could also be narrowed or closed without one.
How many vehicles and crashes are involved?
The upgraded review covers approximately 3.2 million vehicles, but that number represents the estimated investigation population—not 3.2 million vehicles that NHTSA has declared defective or that Tesla will necessarily recall.

Reuters reported that NHTSA was examining nine incidents associated with the visibility concern, including one fatal crash. The available evidence does not justify saying that FSD caused all nine incidents. The agency is examining whether the alleged defect contributed to them and whether the system’s warnings and handoff behavior were adequate.
The final scope could be smaller or different depending on vehicle hardware, camera systems, software versions, model years, and the markets included in any eventual action. Potentially relevant Tesla models may include the Model S, Model X, Model 3, and Model Y, but NHTSA has not provided a definitive model-year list in the material reviewed.
What “camera degradation” means in practice
Tesla’s FSD depends heavily on cameras to understand lanes, vehicles, pedestrians, traffic signals, and other road features. Fog, direct glare, dust, airborne material, a dirty lens, or an obstruction can reduce the quality of that visual information.
A warning that arrives only after the system’s ability to interpret the road has already been substantially degraded may leave the driver too little time to respond. That timing issue is especially important because FSD is a supervised driver-assistance system, not a driverless technology.

Tesla describes the current offering as FSD (Supervised). The driver remains responsible for monitoring the roadway and must be ready to take over immediately. “Full Self-Driving” should not be read as Level 4 or Level 5 autonomy, in which a vehicle could operate without a human driver under defined or all conditions.
Could a recall be fixed with an over-the-air update?
Possibly, but the remedy is not yet known. Potential solutions could include:
- improved camera-degradation detection;
- earlier or more prominent driver warnings;
- automatic limitation or suspension of FSD in poor visibility;
- changes to the handoff process; or
- hardware changes if software cannot adequately address the risk.
Tesla has previously completed software-related recalls through over-the-air updates. A February 2023 recall involving FSD Beta addressed certain traffic-law-related maneuvers and was documented by NHTSA’s recall acknowledgment and recall report.

Do not confuse this with Tesla’s other investigations
Alleged traffic violations
NHTSA is separately examining reports that FSD may have committed traffic-safety violations, such as running red lights or entering opposing lanes, and whether drivers received adequate alerts. That matter is described in a separate NHTSA information request. It is not the same investigation as the low-visibility degradation case.
The fatal Texas house crash
NHTSA also opened a special investigation after a Tesla using an automated driving feature struck a Texas home, killing a 76-year-old woman. Separately, the National Transportation Safety Board reported that the driver manually overrode the system by fully depressing the accelerator, according to Reuters’ report.
That accelerator-override finding does not make the crash irrelevant, but it means the incident should not be presented as proof of the specific poor-visibility defect under review. Crash reports can also contain duplicates or errors in the classification of Level 2 driver assistance. NHTSA explains those limitations in its Standing General Order crash-reporting materials.

What Tesla owners should do now
- Keep the vehicle software current. Updates may contain safety improvements, even though no particular update should be assumed to resolve this investigation.
- Remain fully attentive. FSD requires continuous supervision and immediate readiness to take control.
- Use extra caution in poor visibility. Do not rely on FSD when fog, glare, dust, dirt, weather, or another obstruction makes the cameras or roadway difficult to see.
- Keep camera areas clean. Follow Tesla’s guidance for cleaning the cameras and windshield areas.
- Report recurring problems. Owners can contact Tesla and submit a safety complaint through NHTSA’s official complaint portal.
- Check by VIN if a recall is announced. Use the official NHTSA recall lookup, rather than assuming that every FSD-equipped vehicle is included.
What happens next?
Several outcomes remain possible. Tesla could voluntarily recall affected vehicles, provide additional data to NHTSA, deploy a software change, or dispute the agency’s conclusions. NHTSA could order a recall, narrow the affected population, continue investigating, or close the matter without a recall.
The most important facts to watch are the specific vehicle and software configurations NHTSA identifies, whether the agency finds a safety defect, and whether any proposed remedy demonstrably improves warning and handoff timing.
