Under current Florida law, it must leave the plate number and the registration decal or validation sticker in the upper-right corner visible. More serious penalties apply to deliberately obscuring the plate or using a device to hide or switch it—not simply to owning an ordinary frame.
When is a license plate frame legal in Florida?
Florida Statutes §§ 320.061(2) and 320.262(5) expressly make a frame or decorative border permissible under those sections if it does not obscure either the plate’s alphanumeric designation or number, or the registration decal or validation sticker in the upper-right corner. The test is how the frame sits on the actual plate, not what the frame is called.
Before driving, check the installed frame and plate together. Make sure the full number and upper-right sticker can be seen, and that the frame does not interfere with the plate’s legibility, visibility from an angle, detectability, or recording. A frame that leaves those required details unobstructed is different from a cover or mechanism designed to hide them.
What conduct can bring a penalty?
Knowingly interfering with the plate or sticker
Section 320.061(1) prohibits changing the original appearance of covered registration documents, plates, and stickers. It also prohibits attaching a substance, reflective matter, illuminated device, spray, coating, covering, or other material onto or around a plate when it interferes with the legibility, angular visibility, or detectability of the plate number or validation sticker, or with recording either one. A knowing violation is a second-degree misdemeanor. The frame exception does not excuse interference with the number or upper-right sticker.

Buying, possessing, making, or distributing an obscuring device
Section 320.262 defines a “license plate obscuring device” as a manual, electronic, or mechanical device designed or adapted for a vehicle to switch between plates; flip a plate so its number is hidden; obscure or interfere with the number’s or sticker’s legibility, angular visibility, or detectability; or interfere with recording the number or sticker.
The law separates penalties by conduct:

These are maximums under Florida’s general penalty statutes, not automatic sentences or predictions of what a particular case will bring. The applicable grade depends on the conduct charged and proven. The felony maximum is tied to the crime-related use described above; it is not the penalty for an ordinary decorative frame. See § 775.082 and § 775.083.

Can a frame cover the word “Florida”?
The statute’s express frame exception names the plate number and upper-right registration decal or validation sticker; it does not state the same visibility requirement for the state name. In a December 12, 2025 memo to law-enforcement agencies, Florida Department of Highway Safety and Motor Vehicles Executive Director Dave Kerner said that a frame impinging on information at the top is permissible if law enforcement can identify the state that issued the plate. The memo also says the number and upper-right decal must remain visible and that FLHSMV does not consider information at the bottom a primary feature.
That memo is administrative guidance, not statutory text, and does not promise that every frame or plate arrangement is lawful. The statute’s visibility protections still apply. Read the December 12, 2025 FLHSMV memo alongside the current statutes.

Are Florida drivers commonly getting stopped or jailed over frames?
The statutes establish prohibited conduct and possible maximum penalties; they do not show how often police stop, cite, arrest, or prosecute drivers. No reliable enforcement-rate figure is established by the cited official sources, so it would be misleading to claim that drivers are commonly jailed over ordinary frames.
