Beam Mobility’s “Phantom” E-Scooters: What Councils Said Happened

Auckland Council said Beam exceeded scooter caps and supplied data that made its dashboard appear compliant. Here’s what councils alleged, what Beam said, and what remains unresolved.

“Phantom e-scooters” was the label used in reporting about Beam Mobility vehicles allegedly missing from the fleet counts shown to councils. Auckland Council later said its investigation found Beam exceeded permitted fleet limits and that changes to data sent to its monitoring system made the fleet appear compliant. The council cancelled Beam’s licence and referred the matter to Police. Those are council findings and actions—not a court ruling or a criminal conviction.

What “phantom e-scooters” means in this case

“Phantom” was a reporting label, not an official class of scooter. The allegation was that additional Beam vehicles were operating while fleet data supplied to local authorities understated the number that should count against city limits.

The story has three distinct evidence layers: investigative reporting about leaked internal material; councils’ accounts of their own investigations and data analysis; and Beam’s later explanation of its review and remedial steps. They should not be treated as interchangeable. In particular, the leaked-document claims were reported by The Australian and summarized by TechCrunch, while the fleet findings below are attributed to the relevant councils.

How Auckland’s monitoring system worked, according to the council

Auckland Council said operators sent vehicle data to Ride Report, the council’s monitoring platform, about every five minutes. A vehicle marked “unknown” did not appear on the real-time map and was not counted toward the fleet caps. The council said changes Beam made to the data it provided caused the dashboard to show apparent compliance.

The council said a private individual supplied evidence of anomalies on 2 August 2024. It then reviewed the matter with Ride Report; the platform’s analysis was consistent with the allegations and the council’s own findings. Auckland said the analysis did not identify similar activity by other providers, a conclusion limited to that analysis and its scope.

What Auckland Council said its investigation found

Auckland’s permitted Beam fleet was 1,400 scooters: 450 in Tier 1, 450 in Tier 2 and 500 in Tier 3. The council said Ride Report analysis found Beam consistently exceeded its Tier 1 and Tier 2 allocations by almost 40% from 26 July 2023 through 15 August 2024.

Preliminary analysis suggested as many as 530 additional vehicles could have been in “unknown” status at a peak. Auckland said an exact total would require further investigation, so 530 is not a verified count of the excess fleet.

On 27 August 2024, Auckland Council cancelled Beam’s licence effective immediately and directed the company to deactivate and remove its vehicles. The council also referred the matter to Police. Its licensing manager, Mervyn Chetty, said: “Limits on e-scooter numbers are in place for the safety of other road and footpath users and to minimise nuisance in and around our city.”

Brisbane, reported 2 September 2024 ABC reported Brisbane City Council alleged $330,000 in unpaid fees, an average of 500 undeclared devices a day, and cap exceedances of nearly one-third in the 12 months to July. Council cancelled Beam’s contract. Beam disputed the claims and called the cancellation “highly premature,” as reported by ABC.
Canberra, 4 September 2024 The ACT permit allowed 950 scooters. The government said its investigation included correspondence, field audits and liaison with City Software Solutions, which operates Ride Report. The ACT government said it would not renew Beam’s permit. Deputy Director-General Ben McHugh said staff received information alleging Beam was manipulating data and acting outside permit conditions.

These actions were not identical: Auckland cancelled a licence and made a Police referral; Brisbane cancelled a contract amid disputed council claims; and the ACT declined to renew a permit after describing an investigation. The cited accounts do not establish whether the Police referral resulted in prosecution or whether a court later determined civil or criminal liability.

What the leaked-document reporting alleged

TechCrunch’s 26 August 2024 summary of The Australian’s two-part investigation said leaked Slack messages and documents described plans to add 1,000 scooters in selected “best areas,” with an expected additional $150,000 profit. The figures and strategy are allegations reported from leaked material, not findings independently confirmed by the council statements summarized here.

What Beam said after its independent analysis

In a statement published on 12 February 2025, Beam said it had retained Corrs Chambers Westgarth in August 2024 and that the firm engaged Pitcher Partners to conduct an independent analysis. Beam said the analysis was complete and that Corrs had written to partner councils offering settlement or adjustments to affected councils. The statement provides Beam’s summary; it does not reproduce the full underlying analysis.

Beam said it adopted or planned governance and monitoring changes, including:

  • Appointing an internal compliance officer and providing training for staff and directors.
  • Applying stricter approval controls to reporting methodology and product changes.
  • Commissioning an independent audit and enhancing its whistleblowing process.
  • Using Vianova data auditing, dashboard alerts and automated safeguards for deployments.

A Beam spokesperson acknowledged process failures, saying that rapid expansion meant its processes “did not evolve to the same level of sophistication,” resulting in mistakes, including operating-agreement violations in some ANZ markets. That is Beam’s own characterization of its conduct and remediation.

What remains unresolved

  • The cited accounts do not establish whether Auckland’s Police referral led to prosecution or a final legal determination.
  • Auckland described the 530-vehicle figure as a preliminary peak estimate and said an exact total required further investigation.
