What the judge’s ruling does
U.S. District Judge Kathleen Cardone granted the preliminary injunction after finding that the plaintiffs were likely to succeed on at least one claim and likely to suffer irreparable harm if construction continued, according to Inside Climate News. The injunction halts construction while the court considers the case; it does not resolve the lawsuit’s ultimate merits.

The news report says the order stays the effect of federal waivers that had allowed construction to proceed without complying with the National Environmental Policy Act, the Archaeological and Historic Preservation Act and other laws. The report describes the injunction’s reach as covering the national park, the state park and the remainder of the Big Bend sector along the Rio Grande. The exact text of the brief written order was not available in the report, so its precise terms should not be inferred beyond that account.

Inside Climate News described the Big Bend sector as spanning more than 500 miles across West Texas. Before the injunction, federal plans reported by the outlet called for different infrastructure in different places:

Those were plans as reported before the injunction, not a final design. The report says plans had changed several times since February. It also describes land-clearing activity in Big Bend National Park in mid-August, followed by a Customs and Border Protection pause in park construction on August 17. That pause was lifted during the week before the report was published.
Why the plaintiffs challenged the waivers
The plaintiffs are the Center for Biological Diversity, Friends of the Ruidosa Church and river guide Danny Miller Jr. They sued the U.S. Department of Homeland Security and Secretary Markwayne Mullin. The Texas Civil Rights Project and Center for Biological Diversity represent them.

At the hearing, plaintiffs’ attorneys argued that the Big Bend sector did not fit the waivers’ characterization of an area with “high illegal entry.” Inside Climate News reported that analyst Adam Isaacson of the Washington Office on Latin America presented data describing Big Bend as a “distant last place” in unauthorized crossings compared with the other nine U.S.-Mexico border sectors. The article supplies no underlying crossing figures, and says park-level detention data requested by the plaintiffs was not provided. The comparison therefore should not be mistaken for a specific count or a complete dataset.

Miller described border-wall construction as a “visible scar that will never go away,” according to the report. A CBP spokesperson, whom the article did not name, said the agency stood by its assessment and remained confident in its legal authorities, adding that it was working with the Department of Justice on next steps.
