A roof is not a passenger seat and provides no proper seat belt or dependable protection from a fall, sudden braking, a collision, or overhead hazards. For a parked car, the sources here do not establish one rule that applies everywhere; the roof may still be unsafe or damaged by someone sitting on it. Use a designated seat inside the vehicle and wear the seat belt.
Why a car roof is not a passenger seat
Passengers should travel in a seat designed and secured for that purpose. The Hong Kong Transport Department’s Code of Practice on the Loading of Vehicles says passengers must sit in a properly constructed seat secured to the vehicle bodywork. A car roof has no designated passenger seating position or passenger seat belt.
Nor does a roof’s structural strength make it a place to sit. The U.S. federal roof-crush standard tests roof performance under specified conditions; it is not an approval for carrying a seated person. The cited standard describes a test in which force is applied to the roof and limits are set for movement and loading against a head form. Its test procedure also removes roof racks and other non-structural components. A structural test result cannot be treated as a safe seating capacity.
Is it illegal to ride on a car roof?
Laws differ by location, so these official examples should not be read as a universal legal rule. They do, however, show why riding outside a moving vehicle is prohibited or expressly warned against in several jurisdictions.

- South Australia: The Government of South Australia’s My Licence Driver’s Handbook says, “You must not allow any person to ride on the roof or bonnet of your vehicle, or any other external part of the vehicle.”
- Hong Kong: The Transport Department’s code says a driver must not permit a passenger to travel unless they sit in a properly constructed seat secured to the vehicle bodywork. It also warns against riding on top of a vehicle cab, citing lack of support and overhead-structure hazards.
- New Zealand: Waka Kotahi NZ Transport Agency’s Road User Q&As state that riding in or on a vehicle in a manner or position that may cause injury is prohibited.
For a definitive answer where you live, check the current official road rules for your jurisdiction. A rule in one place does not establish the law elsewhere.
What if the car is parked?
The cited guidance addresses passenger safety, travel, and loading; it does not establish a general legal rule for briefly sitting on every parked car. That uncertainty is not proof that it is permitted or safe. A roof can be damaged, and a person can slip or fall. The sources do not establish a safe person-weight limit for any particular vehicle, so check that vehicle’s owner manual or ask its manufacturer rather than assuming its roof can support you.

Do roof racks make it safe?
No. A roof rack is for suitable, secured cargo within the vehicle manufacturer’s stated limit, not passengers. UK Driver and Vehicle Standards Agency and Department for Transport guidance on securing loads says, “You must never load items directly onto the roof of a car,” explaining that the roof is not designed for this, friction can be low, and suitable attachment points are lacking. The guidance says to keep rack cargo within the manufacturer’s maximum roof-rack weight and secure it with suitable clamps or cargo straps. None of that turns a rack into a passenger seat.

Travel inside the vehicle in a designated seat, with the seat belt fastened. Do not ride on the roof of a moving car, and do not treat a parked car’s roof or a roof rack as seating.
