Tesla later replaced the truck after his case was escalated, but the replacement also reportedly stopped responding and would not charge. By Fortune’s July 2024 follow-up, Lamar said that problem had been fixed. The story is not a legal finding that the first truck was a “lemon,” or that North Carolina law required Tesla to replace it.
Why Lamar MK demanded a replacement
In May 2024, The Daily Dot reported Lamar MK’s account of recurring problems with his new Cybertruck. He described error codes and voltage issues, a steering malfunction, a breakdown within about two weeks, and additional service stays. By the time he sought a replacement, he said the truck had broken down four times. These were the owner’s claims as reported at the time, not independent technical findings.
Lamar said Tesla offered to buy the truck back, while ordering another would mean joining a waitlist. At that point, Tesla had not granted his replacement demand. The headline’s use of “lemon” reflected the dispute, not a legal determination. The Daily Dot’s May 2024 account described the demand and the problems Lamar reported.
What happened after Tesla escalated the case
Fortune’s July 28, 2024 follow-up said the original truck had spent more time in the shop than on the road. After a prolonged back-and-forth and public escalation, a Tesla manager called Lamar; he received a replacement within a week.

The replacement developed a problem of its own after Lamar had it wrapped: it became unresponsive and would not charge. Fortune reported that Lamar said Elon Musk contacted him and wrote on X on July 1, 2024, “We’ll get it fixed pronto.” A few weeks later, Lamar told Fortune the issue had been fixed and that he had experienced no further problems at that time. In the interview, he said, “Every time we drive we wonder if it is going to break again.” This is the outcome he reported in 2024, not confirmation of the vehicle’s condition today. Does North Carolina lemon law require Tesla to replace a Cybertruck?
North Carolina’s New Motor Vehicles Warranties Act provides a qualifying consumer the option of a comparable new vehicle or a refund if the manufacturer cannot bring a new motor vehicle into conformity with an express warranty after a reasonable number of attempts. The defect or condition must arise within 24 months or 24,000 miles after original delivery. Those requirements do not establish that Lamar qualified; the published accounts do not include the complete service records, notices, or a legal ruling on his claim. North Carolina General Statutes § 20-351.5 sets out the remedies.

How the statute treats repair attempts and days out of service
The law presumes a reasonable number of repair attempts in either of two circumstances: the same nonconformity has been presented for repair at least four times and still exists, or the vehicle has been out of service for 20 or more cumulative business days during a 12-month warranty period. For that statutory presumption, the consumer generally must give the manufacturer direct written notice and an opportunity of up to 15 calendar days to correct the problem, subject to the statute’s notice-disclosure exception. A consumer may also prove substantial impairment by other means. The statute’s presumption and notice provisions explain these rules.
- Four breakdowns do not automatically mean four repair presentations for the same continuing defect.
- Total time in the shop does not, by itself, establish every element of a claim.
- The nature of the defect, its effect on use, value, or safety, when it occurred, repair history, mileage, and written notices can all matter.
So a public account of repeated failures can explain why an owner sought relief, but it is not enough on its own to decide whether the statutory test is met or whether Tesla could be compelled to provide a remedy.

What Tesla’s Cybertruck warranty says
Tesla’s current vehicle-warranty support page lists separate limits for the Cybertruck’s basic vehicle warranty and battery and drive-unit warranty:

These are the limits listed on Tesla’s support page, not a substitute for the terms delivered with a particular vehicle. Tesla says owners should consult that vehicle-specific warranty for authoritative terms. Its support page also asks owners to give written notice of defects and allow Tesla an opportunity to repair before pursuing remedies under applicable law. Warranty coverage alone does not establish that a vehicle meets the statutory replacement or refund test. Tesla’s Cybertruck warranty information has the current published limits and guidance.

The 2024 accelerator-pedal recall was a separate issue
In April 2024, Tesla recalled 3,878 model-year 2024 Cybertrucks because an accelerator pedal pad could dislodge and become trapped by interior trim, potentially causing unintended acceleration. Tesla said it would repair or replace the pedal assembly at no cost. The Associated Press reported the recall based on Tesla’s filing. The available reports do not connect that pedal issue to the electrical and steering problems Lamar described; the recall count is not an estimate of how common those other problems were. What a Cybertruck owner with recurring failures can document
For someone evaluating a similar problem, the useful comparison is not simply how many times a vehicle stopped working. Keep records that can distinguish recurring defects from separate incidents and show the timeline:

- Dates, mileage, and a clear description of each symptom.
- Repair orders and service records showing what was diagnosed, repaired, or left unresolved.
- The number of times the same condition was presented for repair, separately from unrelated issues.
- Business days the vehicle was unavailable during the applicable warranty period.
- Written notices to the manufacturer and any response or repair opportunity provided.
Those records help assess the warranty and statutory questions; they do not predetermine the outcome. The available reporting about Lamar does not establish whether he satisfied North Carolina’s legal requirements.
