Not automatically. The European Union’s measure applies to covered new battery-electric passenger vehicles that are originating in China and imported into the EU. It is a countervailing duty (often called a tariff in everyday discussion), and it is based on customs origin and the import transaction—not simply on the nationality of the brand.
A Chinese-brand EV assembled in Europe may therefore fall outside this particular measure, but European assembly alone does not prove EU origin. Customs must examine the vehicle’s production operations, classification, exporter, supply chain and import route under the applicable non-preferential origin rules.

The short answer: brand is not the deciding test
A vehicle does not become subject to the EU countervailing measure merely because its badge belongs to a Chinese company. Conversely, a car does not automatically avoid the measure merely because some assembly occurred in Europe.
The legal questions are:
- Is the vehicle within the measure’s product scope?
- What country is its customs origin?
- Was it imported into the EU from China?
- Which producer exported it, and what documentation accompanied the declaration?
- Does a current undertaking or other legal decision alter the treatment for that exact model and exporter?
The European Commission’s customs guidance explains that a good’s country of origin determines the application of commercial-policy measures, including anti-dumping and countervailing duties. The person lodging the customs declaration is responsible for declaring origin correctly.

For an unspecified car, no reliable yes-or-no answer can be given from the brand name or the phrase “made in Europe.” You need the vehicle’s manufacturing facts and customs paperwork.
What the EU measure covers
The European Commission’s Access2Markets summary, published 12 December 2024, describes the measure as applying to imports of new battery-electric vehicles primarily designed to carry up to nine people, including the driver. The scope includes specified vehicle classifications and exclusions and also covers vehicles fitted with an internal-combustion engine used as a range extender.
That means the first screening step is technical and customs-based, not marketing-based. A model advertised as an electric SUV, crossover or sedan is not enough information. The exact vehicle type, whether it is new, its seating capacity, its propulsion system and its CN/TARIC classification must be checked.

The measure became applicable on 30 October 2024. This article addresses the countervailing measure on China-origin covered vehicles; other customs charges, taxes or national registration costs are separate questions.
Three conditions must line up
- Covered product: the vehicle must meet the measure’s definition and classification requirements.
- China origin: customs rules must assign the vehicle non-preferential origin to China.
- Import into the EU: the covered China-origin vehicle must enter the EU as an import transaction.
If any one of those conditions is not met, this specific measure does not apply on the facts described by the Commission. That does not guarantee that no other border requirement or charge exists.
Why “assembled in Europe” does not settle origin
EU non-preferential origin rules use the concept of the last substantial transformation when production involves more than one country. The relevant operation must be substantial enough to confer origin under the applicable product rule. Minimal processing, or processing arranged mainly to avoid a commercial-policy measure, does not automatically create a new origin.

The final fitting of parts in an EU plant can be important evidence, but the words “final assembly” cover many different processes. A plant that performs extensive manufacturing and integration may be treated differently from a site that carries out limited operations on largely completed vehicles. The answer depends on the legally applicable rule and the documented facts.

The Commission’s customs page notes that legally binding list rules apply to goods covered by Annex 22-01. Goods outside that annex may require a case-specific analysis. A seller’s “European-built” description is therefore not a substitute for an origin determination.
Import route matters as much as the factory
Consider two cars carrying the same Chinese-owned brand badge:
- One is built in China and imported into the EU. It may satisfy the import condition, subject to product scope and origin.
- The other is manufactured in an EU plant and delivered to an EU customer from that operation. The China-origin import condition described for the measure is not met merely because the parent company is Chinese.
There can also be more complicated routes. A vehicle may be shipped from China to an EU distribution hub, moved through another country, or transferred between related companies before sale. The shipping path or seller’s registered office does not by itself establish origin. Customs looks at the goods, the production history and the import declaration.
For an importer, ask where the vehicle first entered the EU customs territory, who acted as exporter, what origin was declared and which documents support that declaration. If a car is already in free circulation in the EU, obtain the import record rather than assuming that the retail country was the country of manufacture.

The Commission’s published 2024 summary lists different rates for covered exporters. These are countervailing rates, not one universal charge for every Chinese-brand vehicle.

These figures do not tell you the rate for an unnamed vehicle by themselves. The exporting producer must be identified, and the vehicle must fall within the measure.
Why the commercial invoice matters
The Commission’s summary says an individual rate requires a valid commercial invoice containing the prescribed dated declaration. If that invoice declaration is missing or invalid, the highest “all other companies” rate can apply instead of the exporter’s lower published rate.
Before agreeing a purchase or shipment, obtain the exact invoice wording required for the transaction and confirm that the exporter, producer and vehicle identification match. A generic invoice, a quotation or a dealer’s statement that the car is “from Europe” is not the same as the prescribed customs declaration.
The documented undertaking exception
On 10 February 2026, the Commission accepted a price undertaking for Volkswagen (Anhui)’s China-exported CUPRA Tavascan. Under that undertaking, the named model can be exempt from the countervailing duties when it is sold at or above the applicable minimum import price and all other conditions are met.
The Commission defines an undertaking as a voluntary commitment by an exporter to sell a product subject to countervailing measures to the Union above a minimum import price in return for exemption from the duties otherwise due.
What the Tavascan example does—and does not—mean
- It applies to the specifically covered exporter and model, not to every Volkswagen vehicle.
- It concerns China-exported vehicles; it is not a blanket exemption for Chinese-brand cars assembled in Europe.
- The minimum import price and volume limits are conditions of the arrangement.
- If the terms are breached, the Commission can withdraw the undertaking and retroactively reinstate duties.
Undertakings can change the outcome for a particular shipment, so check the current Commission decision and the transaction documents on the date of import. Do not rely on a dealer’s claim that a brand “has an exemption” without confirming the exact model, exporter and conditions.

A practical check for buyers and importers
Use this sequence before signing an order, pricing an import or declaring a vehicle:

Record model, variant, model year, new or used status, seating capacity, propulsion system and vehicle identification number where available.
- Confirm product scope. Check whether it is a new battery-electric passenger vehicle within the Commission’s description, including the treatment of range-extender versions and the relevant CN/TARIC classification.
- Map the production chain. Ask where the body, battery system, drivetrain and final manufacturing operations were completed. Request a written production statement rather than relying on advertising language.
- Determine declared origin. Obtain the origin declaration or binding customs advice supporting the country assigned under EU non-preferential origin rules. If several countries are involved, ask which operation is treated as the last substantial transformation.
- Trace the import route. Establish whether the vehicle entered the EU from China, where the customs declaration was lodged and who was the exporter of record.
- Identify the applicable rate. Match the exporting producer to the Commission’s rate categories and check whether the required dated invoice declaration is present.
- Check for an undertaking. Search the current Commission measure for an accepted undertaking covering that exact exporter and model. Verify minimum-price, volume and reporting conditions.
- Check the law on the import date. Confirm whether a regulation, review, amendment or withdrawal has changed treatment since the vehicle was ordered.
- Keep an evidence file. Retain invoices, origin statements, production records, classification advice, transport documents and correspondence. The declarant must be able to support the declaration if customs asks questions.
For a high-value shipment or a fleet purchase, a qualified EU customs adviser or vehicle-import broker can review the origin, classification and paperwork before entry. That professional review is especially valuable where European assembly is limited or the supply chain involves multiple countries.

This comparison is more useful than comparing badges or parent-company nationality. Two vehicles sold under one brand can have different customs treatment if their production and import facts differ.
Current status and why the answer can change
The Commission’s case history for battery-electric vehicles from China lists the measures as in force, with an expiry date of 31 October 2029. It also records a partial interim review initiated in December 2025. A review can alter rates, scope or conditions, so the legal position on the day of import matters more than a quotation prepared months earlier.
The 2029 date is not a guarantee that the measure will remain unchanged until then. Nor does a pending review automatically cancel the current measure. Check the latest Commission case record, implementing regulations and any undertaking notice before customs clearance.

Mistake: treating any European work as enough
Correction: identify the exact operations performed in Europe and test them against the applicable substantial-transformation rule and any minimal-processing limitation.
Mistake: using the wrong exporter rate
Correction: match the legal exporting producer to the Commission category and verify the prescribed invoice declaration. Without valid documentation, the highest “all other companies” rate may apply.
Mistake: assuming a price undertaking is brand-wide
Correction: check the named exporter, model, minimum import price, volume limits and compliance conditions. The CUPRA Tavascan undertaking is a specific example, not a general exemption.

Correction: recheck the measure at shipment and customs-entry dates, especially while the partial interim review is pending.
What cannot be decided from the title alone
Without a model, factory, production process, exporter, classification and import route, nobody can calculate the applicable treatment for a particular “Chinese EV made in Europe.” The honest conclusion may be that more evidence is required.
Ask the seller or importer for a written answer to four questions: What is the declared country of origin? Which operations support that origin? Who is the exporting producer? Which Commission rate or undertaking is being claimed, and where is the required documentation?
If those answers are unavailable, treat the tariff exposure as unresolved when budgeting the vehicle. A customs professional can then assess the declaration before the car enters the EU.
