Why did Tesla sue the California DMV?
The dispute is about what Tesla’s driver-assistance branding communicated to buyers. In a December 16, 2025 administrative decision, the DMV adopted an administrative law judge’s proposed finding that Tesla’s use of “Autopilot” and “Full Self-Driving Capability” violated state law because the vehicles could not operate as autonomous vehicles. The agency concluded the marketing could suggest a level of autonomy the features did not provide. California DMV’s account of its decision and the decision.
Tesla’s February 13, 2026 petition disputes that conclusion. It argues the DMV disregarded repeated statements that Tesla vehicles were not autonomous and calls the order wrongful. What did the DMV order, and what changed?
The DMV modified the proposed penalty in its December 2025 decision. It permanently stayed suspension of Tesla’s manufacturer’s license and gave the company 60 days to address its use of “Autopilot.” If Tesla failed to take the required action, its dealer license would face a 30-day suspension. Tesla stopped using “Autopilot” in California marketing and had already changed “Full Self-Driving Capability” to “Full Self-Driving (Supervised).” On February 17, 2026, the DMV said Tesla’s corrective action meant the threatened license suspensions were avoided. What is the status of Tesla’s lawsuit?
Tesla filed a petition for administrative mandamus, injunctive relief and declaratory relief in Los Angeles County Superior Court on February 13, 2026. The case is listed as 26STCP00629. The court calendar lists a hearing on the petition for writ of mandate on December 18, 2026, and the checked calendar entry shows no disposition. What the dispute does—and does not—establish
The DMV’s administrative decision found a violation based on how Tesla marketed the features. Tesla’s court petition contests the agency’s finding and says the company repeatedly disclosed that its vehicles were not autonomous. The two positions are not equivalent procedural outcomes: one is an agency decision, while the other is a challenge awaiting court consideration.
The DMV framed its action as a safety matter. Director Steve Gordon said, “The DMV is committed to safety throughout all of California’s roadways and communities.” DMV statement.
