That evaluation, a separate recall notice for braking software, and a later investigation into unintended automatic emergency braking are three distinct official records—not one finding that every Ocean has faulty brakes.
What prompted the braking-loss investigation?
NHTSA’s Office of Defects Investigation opened preliminary evaluation PE24001 after reviewing owner complaints about alleged partial loss of braking performance in 2023 Ocean vehicles. The opening record estimated a population of 4,000 vehicles and listed nine complaints, one crash, and one injury incident. Those are counts recorded when the evaluation opened, not a measured rate of failure across the Ocean fleet.
Complainants described braking performance declining on low-traction surfaces, sometimes without a driver warning and with increased stopping distance. Some reports described intermittent loss of blended braking—the interaction of conventional service brakes and regenerative braking—on low-traction or bumpy surfaces. NHTSA said it opened the evaluation to assess the scope, severity, and safety implications of the allegations; the complaints were not an agency determination that every vehicle had experienced the condition. NHTSA’s PE24001 opening resume describes the alleged condition as “partial loss of braking over low traction surfaces, without alerting the driver.”
What did the braking recall notice say?
Fisker’s NHTSA-hosted recall notice, 24V623, described a brake-module software issue associated with drag torque control. According to the notice, the issue could alter braking feel, cause inconsistent braking performance, and delay expected deceleration in some conditions in 2023 and 2024 Ocean vehicles.

Fisker identified an over-the-air software update to OS 2.2, at no cost, as the planned remedy. Its notice anticipated availability by the end of August 2024. That was a forecast stated in the notice, not confirmation that a particular vehicle received the update or that its current repair status is known. The 24V623 recall notice is the source for the described condition and planned remedy.
How is the AEB investigation different?
NHTSA’s separate preliminary evaluation PE24013 examined complaints about automatic emergency braking (AEB) activating without an apparent obstacle and causing sudden deceleration. It did not investigate the same alleged low-traction braking-loss condition covered by PE24001 and recall notice 24V623.

The PE24013 closing record, dated January 16, 2025, says NHTSA was aware of over 20 reports; its summary table lists 21 ODI incidents and two injury incidents. Those figures belong to the AEB inquiry and should not be combined with the nine complaints in PE24001.
NHTSA said the information Fisker provided was insufficient for a full evaluation and noted that employees with whom the agency had been corresponding were dismissed as of December 27, 2024. The agency found no clear trend in event recurrence, preceding or final speed, road conditions, or warnings. It closed the investigation because the information then available did not warrant further action, while reserving the right to act later. NHTSA stated: “The closing of this investigation does not constitute a finding by NHTSA that a safety-related defect does not exist.” Read the PE24013 closing resume for the agency’s scope and conclusion.

What about the recall for unintended vehicle movement?
Recall 24V-865 is a separate matter. It concerns reports involving difficulty shifting into Park or the intended gear and possible vehicle movement at zero speed while in Drive or Reverse. Its report describes Automatic Vehicle Hold (AVH) in OS 2.0 as the remedy. The report lists 7,745 potentially involved model-year 2023–2024 vehicles and a 100% estimated percentage with the defect; those figures apply to 24V-865, not to the braking-performance issue in 24V623. - Go to NHTSA’s Recalls & Investigations search page and look up the vehicle using its VIN. Use vehicle-specific results rather than assuming a general notice establishes that an individual car is affected or repaired.
- Ask Fisker’s available service channel or the party responsible for the vehicle’s service records to confirm whether recall 24V623 applies and whether the OS 2.2 remedy was installed. The notice’s anticipated rollout date does not establish installation on any particular Ocean.
- Keep the VIN-specific recall result and software or repair history with the vehicle’s records. If the vehicle shows a braking warning or braking behavior that concerns you, avoid relying on a general investigation summary as a diagnosis; seek qualified vehicle-specific assistance.
NHTSA notes that its search page distinguishes recall publication dates from the dates safety issues were reported, and its investigation filters use opening or closing dates. The official records cited here do not establish the present repair status of any specific VIN or current service availability.
