In October, the buyer raised a separate operational concern: it said Fisker might not be able to move vehicle information to a new server, which American Lease said it needed to operate the cars after Fisker’s dissolution. Its objection did not itself undo the approved sale, and the available reports do not establish whether the data-transfer issue was ultimately resolved.
Why was the Fisker fleet sale in question?
The disagreement was about whether the vehicles could remain operable after Fisker ceased operating—not whether the court had approved the bulk purchase. American Lease told the bankruptcy court that information associated with the purchased Ocean SUVs needed to be transferred to a server outside Fisker so the buyer could operate the fleet after Fisker’s dissolution.
In its October 8, 2024 report, TechCrunch said American Lease reported that Fisker first raised a possible transfer problem on October 4 at 8 p.m. ET, and later said porting the information would not be possible. Those details came from American Lease’s filing; they are not a court finding that the transfer was technically impossible or that Fisker knew of the issue earlier.
American Lease’s lawyers described the late notice as significant, saying: “ [American Lease] cannot overstate the significance of this unwelcome news, conveyed to it only after it has paid [Fisker] tens of millions of dollars under the Purchase Agreement.” That is the buyer’s characterization, quoted by TechCrunch, rather than a judicial conclusion. The filing also said it was unclear what Fisker representatives had known, and when, about the alleged impossibility or impracticability of porting the information.

What had the bankruptcy court already approved?
The court approved the fleet sale in July 2024. TechCrunch reported that the agreement covered more than 3,000 Fisker Ocean SUVs, with a maximum reported value of $46.25 million. That figure was the maximum sale value, not confirmation of the amount actually received. The October report relayed American Lease’s description that it had paid Fisker “tens of millions of dollars,” an approximate characterization rather than a precise payment total.

What did American Lease ask the court to do?
American Lease asked to postpone the upcoming confirmation hearing and sought expedited, targeted discovery into when Fisker learned of the reported porting problem. TechCrunch published its account on October 8, before the expected hearing, so that report does not show whether the court granted either request.

Did the later bankruptcy schedule resolve the data issue?
No conclusion about the transfer follows from the later calendar entries alone. The bankruptcy case administrator’s case page listed an October 11, 2024 confirmation/joint hearing and an October 17 plan effective date. Those dates establish procedural milestones, not whether American Lease’s vehicle information was transferred or the specific dispute was resolved.
Public docket search results show the Fisker case continued in later claims administration, including filings into September 2026. Ongoing estate administration is distinct from the 2024 question about operating the Ocean fleet after Fisker’s dissolution; it does not establish the outcome of that technical issue.
