Consider getting individualized legal advice if someone is seriously or persistently injured, fault or insurance coverage is disputed, an insurer wants a recorded statement or settlement before the injuries are clear, or important evidence may disappear. A consultation can help you understand the issues; it does not commit you to hiring anyone or guarantee a particular result.
When is it sensible to speak with a lawyer?
Start with the circumstances that make a claim harder to assess or protect. A lawyer may be able to explain which insurance policies could apply, identify evidence that needs preserving, review insurer communications or proposed settlement papers, and assess whether a claim against another party may be available. Those are possible functions, not promises about what a lawyer can recover.
- Injuries are substantial, worsening, possibly permanent, or not yet clearly diagnosed. The medical picture can affect what a claim involves, so be cautious about settling before you understand your condition.
- Fault is disputed or the insurance picture is complicated. Multiple drivers, a commercial vehicle, a rideshare, or a government entity can raise questions about responsibility and coverage.
- An insurer requests a recorded statement, broad medical authorization, release, or quick settlement. Consider getting advice before signing or agreeing, especially if you do not understand the document or the extent of your injuries.
- Evidence could be lost. Witnesses may become hard to reach and recordings or other evidence may not remain available. The Florida Bar says some wrecks may require prompt legal help to preserve evidence and obtain witness statements.
- The crash caused a death or serious disability, or you are unsure which policy to claim under. Advice may help you understand the process and possible coverage, including PIP, uninsured/underinsured motorist (UM), or medical payments (Med Pay) coverage.
These are practical reasons to ask for case-specific advice, not a legal checklist that determines whether you qualify to bring a claim.
What Florida’s PIP rules mean after a crash
Florida’s no-fault system affects how some initial medical expenses and lost wages are handled. Personal injury protection (PIP) is first-party coverage, meaning you seek benefits through the applicable policy rather than treating it as a complete answer to every injury claim. Policy terms, eligibility, and the facts of the claim matter. The Florida Department of Financial Services explains PIP, UM, and Med Pay in its Personal Automobile Insurance Overview.

A key timing rule is separate from any lawsuit deadline: The Florida Bar’s automobile insurance pamphlet, updated May 2025, and the Florida Department of Financial Services say initial services and care must be received within 14 days of the crash to qualify for PIP benefits. Do not delay emergency care or appropriate medical advice while considering legal questions.
The Florida Bar’s May 2025 pamphlet describes required PIP coverage as a $10,000 amount, with coverage described as 80 percent of reasonable accident-related medical expenses and 60 percent of lost wages, subject to applicable law and policy terms. These are descriptions of coverage, not a promise that a particular claim will pay those amounts. Check your policy and the facts of your claim.
How injury claims and deadlines differ from PIP
PIP benefits and a claim against another party are different questions. Florida law sets an injury threshold for specified non-economic damages in motor-vehicle tort actions. The conditions in the statutory text include significant and permanent loss of an important bodily function, or a permanent injury within a reasonable degree of medical probability, other than scarring or disfigurement. Whether a person meets the threshold depends on the injuries and evidence. The cited Florida Senate page is for the 2020 statutes, so consult a lawyer or verify the current text rather than relying on that older page for a present-day legal determination: Florida Statutes § 627.737 (2020).

There is also a filing deadline to consider. The Florida Senate’s 2024 Florida Statutes, including 2025C, lists two years for an action founded on negligence under § 95.11(5)(a). That general period is not an individual deadline calculation: when the clock starts, who is involved, exceptions, and the type of claim can matter. Get case-specific advice promptly instead of calculating your deadline from a general article. See Florida Statutes § 95.11.
Can you handle a Florida wreck claim yourself?
Some people may be able to manage a straightforward claim, but whether that makes sense depends on the injuries, disputed facts, insurance, and paperwork involved. A lawyer is not automatically necessary, and hiring one does not guarantee a larger recovery. The official consumer sources cited here do not provide a reliable comparison of outcomes for represented and unrepresented claimants, so no specific increase in settlement value or success rate can be promised.
If you are weighing a consultation, focus on whether you can confidently identify the applicable coverage, understand what an insurer is asking you to sign or say, preserve relevant evidence, and evaluate the consequences of a settlement. If any of those are unclear—or the stakes are high—individualized advice may be useful before you make a decision.

How to find counsel and what to ask
The Florida Bar’s automobile insurance pamphlet points consumers to its Lawyer Referral Service or a local lawyer referral service. Use a referral as a way to find someone to speak with, not as an endorsement of a particular lawyer. Ask about the lawyer’s experience and qualifications, who will handle your case, and what the engagement would cover. Before signing, get the fee arrangement and possible case expenses in writing; the sources cited here do not establish a standard fee percentage or hiring cost.
