Whether you can cancel, recover your deposit or claim other costs depends on the contract and the law where you bought the car; there is no single delay period that gives every buyer the same rights.
Keep the order, receipts and every message together. Do not accept a substitute vehicle, stop finance payments or announce cancellation until you know what your contract and local consumer rules allow.

1. Confirm exactly what was promised
Find the signed order form and every document it incorporates, including standard terms, finance paperwork and any written specification. A salesperson’s estimate, text message or advertisement may not have the same status as the contractual terms, so compare all of them rather than relying on memory.

- Is there a fixed handover date, a date range or wording such as “estimated” or “subject to availability”?
- Does the contract allow the dealer or manufacturer an extension for production, shipping or other events?
- Does it state what happens if the date passes: cancellation, a refund, compensation or renegotiation?
- Is there a date after which you no longer want to proceed?
Consumer Affairs Victoria advises buyers to specify a delivery date. If a dealer cannot specify one, its guidance says the contract should include a date after which the buyer does not wish to continue. Its consumer guidance, last updated 13 October 2023, describes the agreement for sale as a legally binding document in the Victorian context.

Check deposit and cancellation terms
Look for separate wording about the deposit, reservation fee, cancellation, administration charges and the buyer’s right to withdraw. Obtain or locate a receipt showing the amount, date and purpose of the payment. NSW guidance recommends written terms explaining, for example, whether a deposit is refundable if the buyer changes their mind. “Deposit” does not automatically mean either refundable or forfeited; the written terms and applicable law matter.
Record the ordered specification
Save the exact model, grade, engine or motor, transmission, paint, upholstery, options, accessories, build year and any “included” equipment. Also note the agreed price, registration assumptions, trade-in value and finance conditions. This list lets you identify a material change if the dealer offers a different car.
2. Request a written status update
Call the selling dealer if you need an immediate answer, but follow up by email so there is a dated record. The Motor Ombudsman recommends discussing the delay and any assistance with the business. Ask for facts about the particular vehicle, not a generic statement about supply problems.

- What caused the delay: production, shipping, allocation, registration or another issue?
- Has the exact vehicle been built? If so, what is its current location and status?
- Has the ordered specification changed or been discontinued?
- What is the latest realistic handover date, and what event must occur before that date?
- Will the price, finance approval, trade-in valuation, warranty start date or registration details change?
- What temporary assistance, if any, is the dealer offering while you wait?
Ask the dealer to identify whether the date is firm or estimated. Keep the reply with your order and payment records. If the answer is only verbal, send a short email summarising what you understood and invite correction.

“My order dated [date] specifies [vehicle and key options] with delivery stated as [wording/date]. Please confirm the reason for the delay, the current status of this exact vehicle, whether the specification or price has changed, and the latest realistic handover date. Please also explain the contract process if that date cannot be met.”
Keep the bracketed variables inside your own records or message; replace them with the details on your order before sending.

3. Decide whether the delay is a contractual breach
The legal answer depends on your location and the wording you accepted. Australian and UK consumer guidance use different frameworks, and neither establishes one universal cancellation deadline for every delayed vehicle order. Read the contract first and obtain local advice before treating the delay as grounds to cancel.
Australia: state and territory rules differ
Queensland guidance recommends a specific delivery date and gives this example for a contract: “(Insert car details including colour and build date) is to be delivered by (insert date) otherwise the contract will be cancelled and deposit refunded.” That is official drafting guidance, not an automatic term inserted into every existing contract.
NSW guidance says some contracts permit an extension and that cancellation generally depends on a breach of the contract terms. It directs consumers with unresolved concerns about unfair contract terms toward NSW Fair Trading. A buyer in another Australian state should use that state’s regulator rather than assume NSW or Queensland wording applies.

United Kingdom: check the agreed delivery obligation
UK government guidance on cancelling goods or services, published 2 March 2016, explains rules for cancellation charges and loss in its jurisdiction. It states that a business may generally retain only an amount sufficient to cover actual direct loss caused by cancellation, must take reasonable steps to reduce that loss, and any charge must be fair. Those rules do not answer every vehicle-order dispute, particularly where the contract has its own delivery and cancellation provisions. Citizens Advice and Consumerline are listed routes for consumer advice.

The material above does not establish rights in the United States, Canada, New Zealand or other countries. If you bought the car outside Australia or the UK, identify the governing law in the order and contact the relevant consumer regulator or a qualified adviser in that jurisdiction.
4. Can you cancel and get the deposit back?
Possibly, but neither cancellation nor a refund is automatic. Start with three questions: did the contract make the date binding, did the dealer use an allowed extension, and has the dealer failed to supply the ordered car or specification?
When the dealer cannot supply the ordered vehicle
Production may stop, a model or option may be withdrawn, or the vehicle offered may not match the order. The Motor Ombudsman says a refund will often be due when a business cannot supply the car or chosen specification, while noting that further remedies depend on the circumstances. Obtain the dealer’s proposal in writing before agreeing to a replacement or revised order.
When you simply no longer want to wait
If the contract treats the date as an estimate or permits an extension, changing your mind may be treated differently from cancelling after a contractual breach. NSW guidance specifically recommends written deposit terms for this situation. Ask the dealer to identify the clause it relies on and how any retained amount was calculated.

Do not confuse a refund with a chargeback
A card dispute or finance complaint is not a substitute for establishing your contractual position. Starting a payment reversal while the dealer is still performing can complicate the dispute. Preserve evidence and seek advice from the card provider or regulator only after explaining the underlying delivery problem accurately.
5. Evaluate a substitute car or specification change
A dealer may offer a different colour, option pack, model year or vehicle already in stock. Compare it line by line with your signed order before saying yes.

The Motor Ombudsman says the seller should inform the buyer when a specification changes and that the buyer may decide whether to keep the changed vehicle or seek a refund or another remedy. Get every material change in a revised order or signed addendum. Do not rely on a promise that “the paperwork will be fixed later.”

If the delay leaves you without a car, compare the cost and duration of a rental, public transport, rides or borrowing another vehicle. A short-term rental may be a practical bridge, but the guidance reviewed does not establish that the dealer must reimburse it. Check the contract and local law before incurring a large expense, and keep invoices if you decide the cost is unavoidable.
Ask the dealer whether it will provide a loan car, transport allowance or other assistance, and record whether the offer is complimentary, refundable or conditional. Treat that arrangement separately from your decision about cancellation.

7. Escalate in a controlled sequence
Give the dealer a clear deadline to respond
After your written request, state the date by which you need a response and the information required. A reasonable deadline should account for the dealer’s ability to obtain a manufacturer update; it is not, by itself, a legal cancellation notice.
Use the appropriate dispute route
- Australia: use the consumer agency for the state or territory where the transaction occurred. NSW consumers can approach NSW Fair Trading about unresolved concerns involving unfair contract terms.
- United Kingdom: seek consumer advice through Citizens Advice or Consumerline, as directed by UK government guidance, and use any approved dispute-resolution scheme named in the dealer’s terms.
- Other jurisdictions: contact the local consumer regulator, ombudsman or legal adviser identified by the governing law in your contract.
Prepare a compact evidence file
- Signed order and incorporated terms.
- Deposit receipt, finance documents and payment confirmations.
- Vehicle specification and any advertised promise that was incorporated into the deal.
- Chronology of promised dates, calls, emails and dealer responses.
- Photos or screenshots showing changed specifications or revised prices.
- Invoices for transport or other costs, with an explanation of why they were incurred.
Send copies rather than originals. Remove unrelated personal information and keep the original files with their dates intact.
8. Common mistakes that weaken a buyer’s position
- Relying on a generic online deadline: a rule from another country or state may not apply to your contract.
- Assuming every deposit is refundable: the receipt and written terms may distinguish buyer-initiated cancellation from dealer non-performance.
- Accepting a verbal substitute: a different build year, option list or warranty can materially change the deal.
- Stopping finance payments without advice: this may create a separate arrears problem while the delivery dispute remains unresolved.
- Waiting without documenting: every revised promise should be dated and saved.
- Claiming speculative losses: ask what the contract and local law actually permit before demanding rental or convenience costs.
9. A practical decision path
- Order still matches and a credible date is supplied: decide whether the revised wait is acceptable; record the date and any assistance in writing.
- Order matches but no credible date is supplied: ask the dealer to identify the contractual extension and obtain local advice on whether the failure is a breach.
- Specification is unavailable: compare a replacement against the table above and choose only after the price, timing and rights are documented.
- Dealer refuses to explain or honor the terms: assemble your evidence file and escalate to the regulator, ombudsman or adviser for your jurisdiction.
- Financial exposure is significant: obtain qualified legal or consumer advice before sending a cancellation notice or accepting a refund settlement.
10. What to put in a future car order
For a future purchase, ask the dealer to write down the vehicle details, a firm delivery date or a clearly defined latest date, the extension mechanism, deposit treatment and the consequences of a missed date. Consumer Affairs Victoria recommends obtaining a receipt for the deposit. Queensland’s example clause demonstrates how a delivery deadline and deposit outcome can be stated together, but it should be adapted to the applicable law and reviewed before signing.
Read every incorporated term before paying. If a salesperson promises a feature, discount, trade-in value or delivery condition, have it added to the contract or an attached schedule rather than leaving it in an informal conversation.
