If police took your car after an arrest, contact the arresting agency promptly, find out which agency or storage lot has custody, and get the case number, property receipt, and every written notice. Then establish whether the car is being held as evidence, is in an ordinary impound, or is subject to forfeiture: each process has different release steps and deadlines, and the rules depend on where the seizure happened.
What to do first
- Locate the car and identify who controls it. Call the arresting agency and ask for the tow or impound facility, incident or case number, property receipt, and contact information for the unit or prosecutor handling the vehicle. Keep a log of calls, names, dates, and instructions.
- Collect and calendar every notice. Read the notice for the response deadline, required form, and filing destination. Keep the envelope and proof of service; deadlines may run from the date a notice was served or the date printed on it. Follow the current instructions for the relevant court, agency, or hearing office.
- Ask what kind of hold applies. Ask whether the car is needed as evidence, was towed under ordinary impound rules, or is involved in a forfeiture proceeding. Request the legal basis and release instructions in writing when practical.
- Confirm who is entitled to claim it. Ask what proof is required from the registered owner, co-owner, lienholder, or other person legally entitled to possession. A person who did not drive the car may have an innocent-owner claim under some state laws, but must assert it under local rules.
- Get the costs and release requirements. Request an itemized, current quote for towing, storage, and impound fees. Ask whether a hearing can be requested before payment, how to retrieve personal belongings, and whether the lot requires an appointment, registration, or proof of insurance.
- Get local legal advice promptly if forfeiture is involved. A forfeiture case may be separate from the criminal case, with its own filing requirements. Do not assume a lawyer appointed for the criminal case will handle the forfeiture matter.
Identify why police still have the car
The same event can involve more than one process. Ask the agency which one applies and what event will end the hold.

Evidence hold
Police may retain a vehicle because it is relevant to an investigation or prosecution. The car may not be released until it is no longer needed as evidence. Hennepin County court guidance says evidence may need to remain held until the case is finished. Utah Courts describes a general 75-day return rule for seized property, but lists exceptions, including when a criminal case involving the property is filed.

A tow or administrative impound usually places the vehicle in a storage lot, where charges may accrue. A local hearing may let an owner challenge the basis for the impound; it does not decide whether the person arrested committed a crime. Release may also depend on the applicable local requirements and payment of charges.

Forfeiture
In a forfeiture process, the government seeks ownership of property it alleges is connected to unlawful conduct. A notice may require a claim or court filing by a stated deadline. A criminal case ending does not necessarily end forfeiture: the Minnesota Judicial Branch warns that dismissal or the absence of criminal charges does not automatically return property.

These official examples illustrate why a deadline from one city or state should not be applied elsewhere. Check the current notice and local instructions for your vehicle.

Who can seek the car or challenge the seizure?
The driver is not necessarily the only person with a legal interest. Depending on the process and local law, a registered owner, co-owner, lienholder, or another person entitled to possession may be able to seek release or contest the seizure. Gather documents showing the relevant interest, such as registration or ownership records, and ask the agency or court which proof it requires. If you were not driving, ask promptly whether local law provides an innocent-owner process and how to assert it.

For an ordinary impound, towing, storage, and related charges may accumulate. Get an itemized amount rather than relying on an estimate, and ask the responsible agency whether a hearing is available before payment. If the vehicle is held as evidence or for forfeiture, payment alone may not secure release. Ask separately how to retrieve personal belongings and whether the lot requires an appointment or particular documents; requirements differ by agency and facility.

When to contact a lawyer
Seek advice from a lawyer familiar with local forfeiture or impound proceedings as soon as a forfeiture notice, court deadline, or contested hold appears. The response may be a civil filing distinct from the criminal defense. The Minnesota Judicial Branch specifically notes that public defenders appointed in a criminal case are not able to help with forfeiture cases; representation arrangements elsewhere depend on local rules and the case.
