Outbyte Driver Updater FREEFix the driver behind crashes, sound loss and screen glitchesFind Drivers →Outbyte PC Repair FREERepair Windows errors before they cause bigger problemsFix Now →Before signing an EV battery lease or subscription, check six things in the actual agreement: who owns the battery, the full fee schedule, what battery coverage promises, what happens when you sell or transfer the car, how cancellation and return work, and what the contract says about default, data and disputes. Terms vary by provider and jurisdiction; examples from Australia, Malaysia and automaker service plans illustrate questions to ask, not rules that apply to every contract.
1. Who owns the battery—and what happens when the car changes hands?
Vehicle ownership and battery ownership may be separate. Read the definitions of “battery,” “vehicle,” “owner,” “lessor” and “subscriber,” and identify whether the battery is included in the vehicle sale or leased from a separate company. Check whether the contract is tied to the vehicle identification number (VIN), and whether the provider, vehicle seller or another finance company holds title or a security interest.
Then look for the consequences of selling, exporting, modifying or writing off the vehicle. Does the next owner have to assume the battery agreement? Is provider consent or credit approval required? Does the transfer trigger a fee, payoff, continued payments or refund? What happens if the vehicle is stolen, declared a total loss or repossessed?
Perodua’s Malaysian QV-E disclosure sheet specifically identifies battery sale or ownership transfer and outstanding lease payments as matters under its Battery Leasing Plan: Perodua QV-E disclosure sheet. AGL’s Australian sample subscription terms refer to possible security interests over the car and registration on Australia’s Personal Property Securities Register (PPSR): AGL sample terms. These are examples of issues to inspect, not terms or legal requirements that apply everywhere.

- WORKS WITH EVERY NON-TESLA EV: Standard J1772 connector plugs straight into Ford, Chevrolet, Hyundai, Kia, Nissan, BMW, Volkswagen, Audi, Rivian, Lucid and every other EV or plug-in hybrid sold with a J1772 port - no adapter needed. Tesla drivers can charge too, using the J1772 adapter that comes with the car.
- PLUG IN, NO HARDWIRING: Level 2 charger delivers up to 40A to fully charge most EVs overnight. Plugs into a 240V, 4-prong NEMA 14-50 outlet (the RV/range type - NOT a dryer outlet) on a dedicated 50A circuit. The extra-long 25 ft cable easily reaches across a garage or driveway. Before ordering, check your car's port type and that you have the right outlet.
- CONTROL & SAVE FROM YOUR PHONE: A stronger built-in antenna keeps the charger online even in a garage or basement. Use the free app to start/stop charging, set speed (6-40A), get reminders, and track energy use and cost. Schedule off-peak overnight charging to cut your electric bill. Requires 2.4 GHz WiFi.
- SAFETY-CERTIFIED & WEATHERPROOF: Independently tested and certified (UL, ETL, FCC, Energy Star). A fully sealed IP66 / NEMA 4 housing stands up to rain, snow, heat and dust indoors or out, and internal steel shielding protects the electronics for years of reliable use.
- GLOW-IN-THE-DARK HOLSTER: The included high-visibility holster glows in the dark so you can find and dock the plug easily at night. Holds the connector securely when not in use.
2. What is the total cost, and can it change?
Do not judge the offer by its headline monthly payment. Add up every required payment over the time you realistically expect to keep the car, using the fee schedule, order form or subscription details that the main agreement incorporates. Check for:
- Deposit, activation or setup charges and when billing begins.
- Recurring payments, payment frequency, taxes and administrative fees.
- Late-payment or failed-payment charges.
- Automatic renewal, price changes and the notice the provider must give before a change.
- Early-termination, return, removal or other end-of-contract charges.
- Whether any deposit or prepaid amount is refundable, and how refunds are calculated.
AGL’s Australian sample places some charges in the customer’s specific subscription details and lists an administration fee. It also provides for a contract-specific early termination fee. Those are examples from that agreement, not typical market rates: AGL EV Subscription Terms and AGL fee details. Confirm the version and figures in the documents presented to you.

3. What battery condition, repair and replacement coverage is actually included?
A battery lease payment, the manufacturer’s battery warranty and an extended service plan are not interchangeable. Find the document that governs each one, then check what condition or failure qualifies for repair or replacement. In particular, look for:
- Any battery-health or capacity threshold that triggers coverage, who measures it and which test method applies.
- Whether normal degradation is excluded, and what happens if capacity falls below the stated threshold.
- Whether coverage includes diagnosis, labor, shipping, battery removal and installation, or only the replacement part.
- Claim deadlines, authorized-repairer requirements, exclusions and the coverage end date.
Tesla says its standard Extended Service Agreement does not cover the battery and drive unit, which have separate limited-warranty coverage. It describes a separate Battery ESA with its own eligibility and terms: Tesla Extended Service Agreement and Tesla Battery ESA. This illustrates why the plan’s name is not enough; confirm the terms for the specific model, vehicle and agreement you are considering.

4. What does the contract require if you sell or transfer the car?
Read the transfer clause before assuming a buyer can simply take over the payments or that the agreement ends when the vehicle is sold. Identify the required steps, any provider approval or buyer eligibility test, and the financial result: assumption of the contract, payoff, continuing liability, transfer fee or refund.
Automaker service terms show why it matters to distinguish one kind of contract from another. Tesla says unused Battery ESA coverage transfers after ownership processing; Rivian’s vehicle-connectivity subscription terms instead end services on transfer and provide a prorated refund: Tesla Battery ESA and Rivian connectivity subscription terms. These are examples of different services, not evidence of a standard battery-lease transfer rule.

5. How do cancellation, early exit and vehicle return work?
Write down the minimum term, the notice method and deadline, when cancellation takes effect, and how any early-exit charge or refund is calculated. Check whether cancellation requires a particular form or written notice, and whether the battery agreement can end separately from the vehicle arrangement.
If the car or battery must be returned, check where and how to arrange the return, who pays transport or battery removal, and what condition standard applies. Look for a fair-wear definition, damage charges, a condition report, and any battery-specific handover requirement such as a minimum charge level.

AGL’s Australian sample says customers must give at least 30 days’ written notice and may owe an early termination fee if they end the subscription within its minimum term. Its sample return terms include a condition report and a charge-level condition for battery-electric vehicles. These are provisions of that sample agreement, not general consumer rights: AGL EV Subscription Terms and AGL fee details.
6. What can happen after default, and how are data and disputes handled?
Find the events that count as default, the notice and cure period, and what the provider may do if a payment is missed. Check collection costs, repossession or security-interest clauses, and whether the provider can restrict services or access vehicle data. Read the privacy terms as well as the payment contract; they may be in separate documents.
Finally, locate the complaint process, governing law and any court or arbitration clause. Check for language preserving mandatory consumer rights. The examples here come from Australia, Malaysia and US automaker support materials; they do not establish which law applies to your agreement or whether a particular clause is enforceable. For a disputed or high-value term, consult a local consumer adviser or lawyer.
