There is no automatic, universal outcome. If a planned car is canceled or never built, your money is returned only if the reservation, order, or sale agreement promises a refund or applicable law provides another remedy. The result turns on the document you accepted, who received the payment, whether you had merely reserved a place or had placed a vehicle order, and the law where the transaction occurred. Some manufacturer programs allow cancellation with a full refund; others make the fee non-refundable after an order is placed.
Why the word “deposit” is not enough
Manufacturers and dealers use deposit, reservation fee, order deposit, and preorder payment for arrangements with very different legal effects. A payment may be a refundable reservation, a credit toward a future purchase, a deposit under a binding sales contract, or a fee that the written terms say is forfeited at a particular stage. The label on your bank statement does not decide which one it is.

Start with the documents, not the marketing description. Collect the confirmation email, receipt, reservation-page terms, later order form, purchase agreement, and any messages changing the vehicle or delivery plan. The version of the terms you accepted when you paid can matter even if the website now displays different wording.

Also identify the payee. Money sent to a manufacturer, franchised dealer, broker, or payment processor may be governed by different contracts and refund procedures. A dealer may hold a deposit under a state or provincial motor-vehicle rule, while a manufacturer’s online reservation may be governed by its own program agreement.

The transaction stage usually controls the answer
Reservation before a vehicle order
A reservation normally records your interest and may place you in a queue. It may be described as a deposit toward a future purchase while expressly stating that it is not a vehicle sale contract. Such terms can preserve the manufacturer’s ability to change pricing, configuration, production timing, or availability. A reservation may also disclaim a guaranteed production slot or delivery date.
At this stage, the agreement may give you a simple cancellation right. Rivian’s United States Preorder / Reservation Agreement, displayed as updated January 17, 2025, states: “You may cancel your Reservation and receive a full refund of your Reservation Fee at any time by contacting Rivian Support.” The same agreement says Rivian may cancel and refund as well. That is a promise in that program’s contract, not a rule that applies to every automaker.
After you place a selected-vehicle order
Some programs change the refund rule once you move from a general reservation to a selected vehicle order. VinFast’s United States VinFirst Reservation Agreement says: “You may cancel your Reservation and request a full refund of your Reservation Fee at any time prior to placing your Selected Vehicle order.” It then says, “Production of your Selected Vehicle will commence following the placement of your order, at which time your Reservation Fee will become non-refundable.” If your vehicle was never produced after that step, you would need to examine the remaining cancellation, delay, breach, and governing-law provisions rather than assume the earlier reservation right still applies.

Signed purchase or sales agreement
A signed purchase contract can contain its own deposit, cancellation, allocation, financing, delivery, and default clauses. It may specify whether the dealer can retain a stated amount, whether the customer can cancel after a material delay, and how a refund is paid. A reservation agreement that says it is not a sale contract does not answer what a later sales agreement says.
What official programs show
These examples illustrate why the exact agreement and stage matter. They are not universal consumer-law rules and should not be applied to a different country, seller, model, or contract.

When comparing an agreement, check six separate questions: Is this a reservation or a binding order? Who may cancel? Is a refund promised, restricted, or excluded? When must the money be sent and by what method? Are deductions or conditions allowed? Which law and dispute forum govern?

How to read your agreement for a canceled model
Find the operative document
Save a PDF or complete screenshot of the terms in force on the payment date. Include the confirmation number, timestamp, amount, vehicle or trim selected, and the identity of the payee. If you accepted updated terms later, preserve both versions and note which action triggered the change.

Read headings and definitions containing “cancel,” “refund,” “non-refundable,” “order,” “production,” “delivery,” “delay,” “allocation,” “default,” “force majeure,” “governing law,” and “dispute.” Determine whether the agreement treats a canceled production program as a seller cancellation, a customer cancellation, a failure to deliver, or an event outside either party’s control.
Separate a production promise from a delivery estimate
A reservation may say the manufacturer has not begun development or manufacturing and that no firm production slot or delivery date is guaranteed. A projected date therefore may not be a contractual deadline. Conversely, a later purchase agreement may contain a specific delivery commitment or a right to cancel after a defined delay. Use the clause that applies to the stage you reached.

What to do when the manufacturer or dealer cancels
- Build the file. Gather the reservation confirmation, receipt, card or bank record, accepted terms, order documents, purchase contract, delivery communications, and any cancellation notice. Keep the original emails and export attachments rather than relying on a live webpage.
- Identify the recipient and payment type. Confirm whether the money went to the automaker, dealer, broker, or processor and whether it was charged to a credit card, debit card, bank transfer, or other method. The recipient should be the first written contact unless the contract names a different refund administrator.
- Map the transaction stage. Write down whether you only reserved a model, selected a vehicle, placed an order, received a vehicle allocation or VIN, or signed a purchase contract. Note the date of each event. Refund language often changes at exactly these milestones.
- Send a dated written request. State your name, confirmation or order number, payment amount and date, vehicle, and the fact that the program or production has been canceled. Ask for cancellation and repayment, quote the applicable refund clause if it is clear, and request the expected refund date and payment method. Send it through the contract’s stated channel and keep proof of delivery.
- Check the amount and deadline. Compare the promised amount with the original charge. A program may refund only a reservation fee before order, or both a reservation fee and vehicle deposit after order. Volkswagen’s cited ID.4 terms, for example, specify payment within 10 business days after the applicable cancellation and refund event.
- Escalate with a complete record. If the seller does not respond, send a short follow-up attaching the first request and the contract page. Avoid telephone-only discussions; if you speak by phone, record the representative’s name, date, and exact commitment in a confirmation email.
- Use formal consumer channels when appropriate. In the United States, the Federal Trade Commission’s vehicle-buying guidance advises consumers to ensure that the agreed deal and terms are in the contract and points consumers toward the FTC and their state attorney general for suspected dishonest dealer conduct. A state motor-vehicle regulator or consumer-protection office may have additional complaint or escrow procedures.
- Ask your payment provider about a dispute. A card issuer or bank can explain its dispute process, evidence requirements, and deadlines. Eligibility depends on the payment method, the contract, the date, and the facts; a charge dispute is not an automatic determination that the seller breached the agreement.
- Get local legal advice for high-value or complex cases. Consult a consumer-law professional in your jurisdiction if the seller denies a clear refund, the amount is substantial, a dealer has closed, bankruptcy or insolvency is involved, or the contract contains arbitration or unusual governing-law provisions.
How online-order rules fit—and where they may not
The FTC page “What to do if your online order never arrives” explains a federal merchandise rule for covered online sellers. When the seller cannot ship on time, the seller generally must notify the consumer and provide a chance to cancel for a full refund. That framework may be relevant to some online transactions, but it does not automatically decide every vehicle reservation, custom order, preorder, or signed car-sale agreement. Whether it applies depends on the transaction and the terms, so do not treat the general guidance as a guaranteed refund for every canceled model.
Common complications
The manufacturer cancels, but the dealer still holds the money
Ask the dealer which contract authorized the charge and whether it has already transmitted the funds. A manufacturer announcement does not by itself identify who owes the repayment. Request a written accounting and direct the request to every party named in the paperwork, without making inconsistent statements about whether you are canceling or accepting a substitute vehicle.
The seller offers a different model or a transfer
A replacement vehicle, credit, or transfer to another model is not the same as a cash refund unless you agree to it. Compare the proposed price, incentives, delivery conditions, and whether accepting the substitute waives claims under the original reservation. If you want your money back, say so explicitly and do not allow a transfer to be treated as acceptance by silence.

The seller says the payment was “non-refundable”
Locate the clause and its trigger. “Non-refundable” may apply only after a selected vehicle order, allocation, customization, or signed purchase contract. It may also be limited by a separate cancellation or seller-default provision. Ask the seller to identify the exact paragraph and event that allegedly made the fee non-refundable.
The company is insolvent
Refund rights and the practical ability to collect are different questions. A claim against an insolvent manufacturer or dealer may be subject to a formal claims process and priority rules that vary by jurisdiction. The documents here do not establish which creditors receive payment first. Preserve proof of the debt and obtain jurisdiction-specific insolvency advice promptly.
The reservation was made in another country
Do not import a United States refund promise into a European or other regional agreement, or vice versa. The contracting entity, currency, consumer statutes, governing law, and dispute forum may all differ. Use the regional terms attached to your confirmation and seek advice where you live or where the contract assigns disputes.

- Is the payment refundable at any time, only before order, or only if the seller cancels?
- Exactly what event converts the fee to non-refundable?
- Is the payment credited to the purchase price, and can the price change?
- Does the agreement guarantee a production slot, delivery date, configuration, or price?
- Who holds the funds and who processes a refund?
- How many business days are allowed for repayment, and to which original payment method?
- Does cancellation end a place in line, incentives, or other rights?
- Which law, court, arbitration process, or regulator applies?
The practical bottom line for your case
A car that never reaches production does not automatically make every deposit refundable or automatically forfeited. Your strongest evidence is the agreement that governed the payment, the documented stage of the transaction, and the identity of the party that received the money. Some programs, such as the cited Rivian reservation terms, promise a full refund at any time; others, such as the cited VinFast United States terms, draw a sharp line before and after a selected vehicle order. Follow the written cancellation process, demand a dated response, and escalate through consumer authorities, payment-provider procedures, or local counsel when the contract or seller does not resolve the issue.
