Short answer: an automaker or importer leaving the market does not automatically cancel an EV warranty, transfer it to the dealer, or guarantee that repairs will be paid. The outcome depends on the warranty document, the seller’s statutory duties, any local importer obligations, and the company’s insolvency or successor arrangements. Start by identifying the legal entity that made each promise, then pursue the seller and the applicable consumer-law route in the country where the vehicle was sold.
First, identify which promise you are trying to enforce
An EV may be covered by several separate obligations. Treating them as one “warranty” can send a claim to the wrong company or cause you to miss a statutory deadline.

Keep these routes separate in your letters and records. A traction-battery defect, a failed onboard charger, a missed statutory quality standard and physical damage caused by a defective component can involve different parties, proof and deadlines.
What a commercial EV warranty actually promises
A commercial warranty is a contract. Its issuer, duration, covered parts, exclusions, notice procedure and remedy are defined in the written terms. The named warrantor might be the vehicle manufacturer, a regional importer, a dealer group, a warranty administrator or an insurer rather than the badge on the vehicle.

Does the warranty vanish when the company closes?
Not automatically. The reviewed United States and European materials do not establish a universal rule that a commercial warranty is void the moment its issuer stops trading. In practice, however, a warranty can become hard to use if there is no operating claims department, authorised repair network or money to pay suppliers. Whether another company must perform depends on an express assignment, a parent-company undertaking, insurance backing, an administrator’s arrangement or a successor’s assumption of the contract.
Read the documents for a backup obligor
Look for wording such as “warrantor,” “administrator,” “guarantor,” “service provider,” “importer of record,” and an address for formal notices. Check whether the terms allow assignment after a sale of the business, name a local entity, or require claims to be filed in a particular country. The invoice and purchase contract can identify a seller that is legally distinct from the brand owner.
Why the selling dealer may still owe you a remedy
A dealer’s obligations can arise from consumer law even when the dealer never issued the manufacturer’s commercial warranty. The European Commission’s Your Europe guidance distinguishes the commercial warranty from the legal guarantee. It says: “This warranty does not replace the legal guarantee, which is always a minimum of 2 years.” The same guidance tells sellers: “If the product you sold turns out to be faulty — or doesn’t look or work as advertised — within the timeframe of the legal guarantee, you are responsible for this.”

That EU guidance describes a minimum two-year legal guarantee for consumer goods, with national laws sometimes providing longer protection or extending responsibility to a manufacturer or importer. It is not a worldwide rule, and it does not mean every defect qualifies. The vehicle must fail the relevant conformity, quality or performance standard, and local rules determine notice, evidence and remedy.
Use the seller route first in the EU
Write to the business named on your sales contract, not only to a discontinued brand email address. Describe the defect, when you found it, the mileage, the remedy requested and the legal-guarantee basis. Ask the seller to arrange diagnosis or explain, in writing, why it says another entity is responsible. Contact your national consumer authority or an approved dispute-resolution body if the seller refuses to engage.
Importer responsibility is not automatically a warranty takeover
EU Regulation (EU) No 167/2013 assigns importer and distributor duties within its vehicle type-approval scope. Article 15 treats an importer or distributor as a manufacturer for that regulation’s purposes in specified circumstances, such as marketing, registering or being responsible for entry into service under its own name or trademark, or making a relevant modification. That regulatory treatment should not be generalized into a rule that every importer must honor every commercial warranty issued by an overseas manufacturer. Check the vehicle category, the importer’s role and the actual contract.

United States: federal warranty protections without an automatic dealer transfer
In the United States, the Magnuson-Moss Warranty Act governs qualifying written and implied warranties, but the cited provisions do not say that a dealer becomes the manufacturer’s warrantor when the manufacturer exits the market.

Under 15 U.S.C. § 2304(a)(1), a warrantor must, as a minimum, “remedy such consumer product within a reasonable time and without charge” when a covered defect, malfunction or failure to conform occurs. The exact remedy and procedure still depend on the written warranty and the facts.
Limits on disclaiming implied warranties
Section 2308(a) states: “No supplier may disclaim or modify (except as provided in subsection (b)) any implied warranty to a consumer with respect to such consumer product” in the circumstances covered by the statute. This does not decide who has assets, who acquired the warranty book or whether a particular dealer is a supplier or warrantor. State warranty, contract and consumer-protection law can add claims or remedies.

Send a dated written notice to the dealer and every legal entity named in the warranty. Keep proof of delivery, the repair order and the manufacturer’s closure notice. A state attorney general, consumer-protection office or qualified lawyer can help determine whether the dealer, distributor, parent or bankruptcy estate is the proper defendant.
Australia: statutory consumer guarantees and manufacturer damages claims
Australia’s Competition and Consumer Act 2010 contains statutory consumer guarantees. The Federal Register of Legislation page identifies a consolidated version dated 28 March 2026; check for amendments before relying on a section. The Act also provides a route for an affected person to bring a damages action against a manufacturer for specified failures to comply with guarantees.
That statutory route is subject to the Act’s conditions. It does not guarantee recovery if the manufacturer is insolvent, has no assets or cannot be located. The selling dealer may still have obligations as the supplier, so preserve the contract, tax invoice, service history and all communications before deciding whether to pursue the manufacturer, dealer or both.

Product liability is different from warranty repair
Directive (EU) 2024/2853 concerns compensation for damage caused by defective products. It states that it applies to products placed on the market or put into service after 8 December 2026. At the time of the cited guidance, that date was still in the future. The directive should not be described as an extension of an EV’s battery or vehicle warranty, or as a way to obtain ordinary maintenance or a software repair simply because a warrantor has left.
If a defect causes bodily injury or damage to other property, preserve the failed part, photographs, diagnostic reports, medical records and repair invoices. Product-liability rules have their own definitions, causation tests, limitation periods and potentially different defendants.
A practical recovery plan for an owner
- Secure the evidence. Save the signed purchase agreement, invoice, warranty booklet, battery-warranty terms, service records, recall notices, diagnostic scans and messages. Photograph warning lights, odometer readings and visible damage. Keep the legal company names, not just trading names.
- Map every obligation. Create a short list showing who sold the vehicle, who issued the vehicle and battery warranties, who imported it, and whether an administrator, insurer or successor is named.
- Notify the seller in writing. State the defect, discovery date, mileage, requested remedy and whether you rely on the commercial warranty, statutory guarantee or both. Ask for a written response and the identity of any entity the seller says is responsible.
- Check local law and deadlines. In the EU, begin with the seller and national consumer authority. In the United States, review the warranty, Magnuson-Moss provisions and state law. In Australia, examine the statutory consumer-guarantee route and the manufacturer-damages provisions. A cross-border purchase may require advice on governing law and jurisdiction.
- Search for an insolvency process. Identify the court, administrator, liquidator or claims portal handling the warrantor. File a proof of claim if required and ask whether warranty obligations were sold or assumed. The official materials reviewed do not establish a universal warranty fund or automatic payment of unsecured claims.
- Separate safety and damage claims. Check recall notices with the relevant vehicle-safety authority. Run a product-liability claim separately if the defect caused injury or property damage. Do not assume that a recall, statutory guarantee and commercial warranty have the same deadline or defendant.
- Control paid repairs. Before authorising a major repair, ask in writing whether it affects any warranty or statutory claim. Obtain a diagnosis and estimate, retain invoices and replaced parts where possible, and record why urgent safety work was necessary. There is no universal right to reimbursement for a self-funded repair.
How to compare the routes before escalating
Put each possible claim in a matrix rather than sending the same demand to everyone.

This comparison prevents a common mistake: proving that a defect exists while pursuing an entity that never promised the remedy or no longer has a viable claims process.
UK grant wording is not a general EV-warranty rule
UK Department for Transport guidance cited for this subject describes a warranty criterion for certain grant-eligible plug-in wheelchair-accessible vehicles, including traction-battery coverage requirements. It is scheme-specific. It does not establish what happens to every UK EV warranty when a manufacturer or importer closes, and it should not be used as a substitute for the vehicle’s contract or ordinary consumer law.
What owners should realistically expect
The strongest first move is usually a documented claim against the selling business under the law of the sale, alongside notice to the named commercial warrantor and any administrator. A dealer is not automatically the manufacturer’s replacement, an importer’s regulatory duties are not automatically a promise to perform every warranty repair, and a product-liability directive is not routine warranty service. If the responsible company is insolvent, the legal right to claim and the practical ability to collect may diverge; local insolvency and consumer-law advice may be necessary.
