Federal Trade Commission (FTC) staff guidance recognizes a narrow exception for charges a federal, state, or local government requires you to pay directly. A dealer-required fee cannot normally be hidden until the sales contract, regardless of whether it is called a documentation fee, processing fee, market adjustment, certification fee, or something else.
The exact answer still depends on your state and transaction. States can cap document fees, require specific disclosures, or set rules for taxes, title, registration, and other government charges. The safest way to shop is to obtain a written out-the-door price, identify every dealer-required charge, and separate mandatory amounts from optional products and conditional discounts.

The rule in plain English
When a dealer advertises a vehicle, the prominent price should be the price a consumer generally can pay for the vehicle, including mandatory dealer charges. The FTC focuses on what a charge does, not the label printed on the worksheet. Calling a mandatory charge a processing fee, reconditioning fee, administrative fee, electronic filing fee, or protection package does not make it optional.

Government charges are treated differently when the government requires you to pay the amount directly. That exception is not a blanket exemption for any amount a dealer describes as a government fee. If the dealer is legally responsible for paying a charge and then passes it to customers, the charge may still be a dealer-required amount for advertising purposes under FTC staff guidance.
Which charges belong in the advertised price?

Document fees: the most common surprise
A documentation fee covers paperwork or electronic processing in the dealer’s description. States take different approaches: some rely on general consumer-protection rules, some require separate disclosure, and some cap the amount or prescribe wording. There is no single nationwide dollar limit that applies to every buyer.
FTC staff guidance addresses a different issue from a state cap. Even if state law permits a particular document fee, the dealer should include the full mandatory amount in the advertised price. A dealer should not base the advertised price on a reduced document fee that only certain customers receive while requiring other customers to pay more.

How to test a document-fee quote
- Ask for the advertised vehicle price and the exact document fee that applies to your transaction.
- Ask whether the fee is mandatory for every buyer or waived only under specific circumstances.
- Check your state motor-vehicle agency or attorney general for a cap, required wording, or disclosure rule.
- Compare the written quote with the final buyer’s order. If the amount changes, ask for the legal and contractual reason before signing.
Government taxes, title and registration charges
Taxes, title charges, registration fees, inspection charges, and similar amounts may be imposed by a state, county, city, or other public agency. The FTC exception concerns charges the government requires the consumer to pay directly. Because collection practices differ, do not assume that every line labeled tax, title, registration, or government fee can be omitted from an advertised price.
Ask the dealer to identify the agency imposing each amount and whether you, rather than the dealer, are legally required to pay it. Also ask whether the dealer is collecting the money for submission to the agency. Your state’s motor-vehicle agency or attorney general can explain the local rule and the exact charges for your address; a general federal answer cannot determine those figures.
Optional add-ons and dealer-installed products
Add-ons are products or services sold in addition to the vehicle itself. Common examples include gap policies, window etching, extended warranties, service contracts, paint or fabric treatments, theft-recovery devices, and other protection packages. A dealer may offer them, but an optional product must not be presented as a condition of buying the car if it is genuinely optional.

Your protections when an add-on is offered
- The dealer must not imply that an optional product is required by law, a lender, or the manufacturer when it is not.
- The dealer must not misstate the product’s price, coverage, cancellation terms, or effect on your financing.
- The dealer must not charge for an option you did not agree to purchase.
- If the dealer says an installed option cannot be removed, that statement must not be misleading. Ask why removal is impossible and what the legal or contractual basis is.
Request a separate price for every add-on. Mark unwanted products as declined on the buyer’s order and verify that the total financing amount does not include them. A lower monthly payment can conceal an add-on because the cost is spread over a longer loan; compare the total amount financed and total of payments instead.
Discounts tied to financing, rebates or eligibility
Some advertisements show a price that depends on financing through the dealer, a manufacturer rebate, a trade-in qualification, military or student status, membership, or another condition. FTC staff guidance says the price generally available to any consumer should remain the prominent advertised price. A dealer may also show a financing discount, but it must identify the condition and show the generally available price prominently.
Ask for two written figures: the price available without a special qualification and the lower price with the qualification. Then ask what happens if the lender does not approve the advertised rate, if you use outside financing, or if you do not qualify for the rebate. The discount should not disappear after you have relied on the headline price without a clear explanation.

Lease advertisements and upfront processing fees
Lease advertisements often emphasize a monthly payment and an amount due at signing. If the ad states a total amount due upfront, FTC staff guidance says processing fees due upfront must be included in that total. Review the lease disclosure for acquisition or processing charges, the first payment, security deposit if any, taxes, registration, and other amounts due at signing.
Do not compare a lease solely by monthly payment. Compare the total due at signing, the number and amount of scheduled payments, mileage allowance, excess-mileage rate, disposition fee, wear standards, and early-termination terms. Federal lease-disclosure requirements still apply in addition to the advertising rule.

Get the out-the-door price before you visit
FTC consumer guidance recommends contacting the dealer before visiting to confirm that the vehicle is available and to request the out-the-door price in writing. In that guidance, the out-the-door price is the total price before financing, including taxes and fees. A written quote lets you identify a new charge before you are in a showroom or committed to a trade-in.

Use this request
Ask the dealer to email or text:
- The vehicle identification number, stock number, mileage, and confirmation that the vehicle is currently available.
- The advertised vehicle price and every dealer-required charge.
- Estimated taxes, title, registration, and other government amounts, identified by agency and payment responsibility.
- Each optional add-on and its individual price, with unwanted products excluded.
- Any rebate, financing, trade-in, residency, membership, or other eligibility condition attached to a displayed price.
- The complete out-the-door total before financing, plus the cash price and financing terms if you request them.
Tell the dealer that you are comparing total prices, not monthly payments. Ask whether the quote expires, whether it assumes a trade-in, and whether any amount changes after a credit approval or vehicle inspection.
What to do when a new fee appears
- Pause the signing process. Do not sign a buyer’s order or retail installment contract while an unexplained charge remains.
- Classify the charge. Ask whether it is a government-required amount payable directly by you, a dealer-required fee, or an optional product you agreed to buy.
- Compare documents. Put the advertisement, written quote, buyer’s order, and finance contract side by side. Look for changed fees, duplicated products, or a conditional discount that disappeared.
- Request removal or correction. If the charge is mandatory but was omitted from the advertised price, ask the dealer to correct the price or explain the basis for the omission in writing.
- Check state rules. For a document-fee cap, disclosure requirement, or exact tax and registration amount, contact your state motor-vehicle agency or attorney general.
- Keep records. Save screenshots, emails, text messages, worksheets, and signed documents. They establish what price was advertised and what you were told.
How to compare two dealer quotes
Put both offers into the same format. A quote with a lower vehicle price can cost more after mandatory fees, add-ons, or a financing condition. Compare these items:

Why this issue is receiving federal attention
In March 2026, the FTC said it sent warning letters to 97 dealership groups about advertised prices that include mandatory fees. That figure is the number of warning-letter recipients, not a national estimate of how often dealers violate the law.

In April 2026, the FTC and the Maryland Attorney General announced allegations involving Lindsay Automotive Group and a proposed resolution. The announcement described more than $75 million charged between April 1, 2020, and December 31, 2025. That amount is specific to the allegations in that case and should not be treated as a nationwide estimate.
Christopher Mufarrige, director of the FTC’s Bureau of Consumer Protection, said the agency is committed to preventing dealers from advertising low prices and then adding mandatory fees at the end of the purchasing process. The enforcement activity reinforces the practical rule for shoppers: obtain the complete price before you travel, negotiate, or sign.
Bottom line for shoppers
A dealer can add an amount to the advertised vehicle price only when the charge fits a legitimate category, such as a government-required amount you must pay directly or an optional product you knowingly choose. A mandatory dealer fee should be in the advertised price, and a conditional discount should not replace the generally available price. Because state rules differ, use a written out-the-door quote, demand itemization, and verify local document-fee and government-charge rules before signing.
