A solar lease can commit your land long before panels are built. Before signing, identify whether you are being offered an option, a development agreement, or an operating lease; match the contract maps to your fields; model every payment phase and contingency; protect farming, access, taxes and insurance; and make decommissioning financially enforceable. Have an attorney experienced in solar land leases review the actual documents, and confirm local consequences with your assessor, planning officials and farm-program advisers.
Start by identifying exactly what you are signing
Developers commonly approach landowners in stages. An early document may be an option to lease or a development agreement, followed by a long-term operating lease. Those documents do different things and should not be evaluated as if they were one harmless expression of interest.

Option or development agreement
An option can be legally binding even though construction is uncertain. Missouri Extension cautions that an option may restrict land use during the option period and give the developer time to conduct surveys, environmental studies, interconnection work and permitting. Read it as a real land commitment.

- Exclusivity: Determine whether you are barred from negotiating with another developer or using the land for a competing purpose.
- Site work: List every permitted visit, test, bore, tree removal, soil sample, access route and temporary staging activity.
- Notice and termination: Note how notice must be delivered, when you may terminate, and what happens if the developer misses a deadline.
- Payment: Confirm the amount and due date for the option, and whether payment continues during extensions.
- Assignment: See whether the developer can transfer the option without your consent.
Ask in writing whether you may continue cropping, grazing, maintaining drainage and using farm roads while the option is pending. Also specify what happens if the developer never builds: the expiration date, removal of temporary works, restoration and release of recorded notices or easements.

Operating lease
The operating lease controls possession, construction, electricity production and eventual exit. Do not assume that promises made in meetings or a term sheet will carry over. University of Wisconsin–Madison Extension’s practical warning is: “If it’s not in the contract, assume it won’t happen.”
Verify the map, acreage and every right attached to the project
Have your attorney and survey professional compare the legal description and exhibits with the fields you actually farm. A lease can affect more land than the fenced panel area.
Review the complete footprint
- Identify leased acres, fenced acres, panel rows, inverters, transformers, batteries, substations and construction laydown areas.
- Mark setbacks from property lines, homes, roads, streams, wetlands, drainage features and neighboring parcels.
- Locate permanent and temporary access roads, gates, turning areas, transmission lines and utility easements.
- Show areas excluded from the project but burdened by setbacks, glare restrictions, safety zones or construction traffic.
- Check whether roads, ditches, tile, waterways and field entrances remain usable by your equipment.
Missouri Extension notes that maps, legal descriptions and setbacks matter because exclusion areas can make otherwise unleased land difficult or impossible to use. Require a current survey or a map with measurable coordinates, not a conceptual drawing that can expand later.

Check existing claims on title
Wisconsin Extension recommends reviewing existing easements, mortgages and liens. A lender may need to consent before a lease or easement is recorded. Mineral reservations, conservation easements, access rights and boundary agreements can also limit what you can grant. Obtain a title commitment and ask who has priority if the developer’s lender forecloses.

Analyze payments as a schedule, not a headline rate
There is no reliable national “average” solar lease payment. The U.S. Department of Energy (DOE) says payments vary with project size, location and negotiated terms. A proposal may combine fixed rent, per-acre rent, construction payments and generation-based amounts, each with different triggers and risks.

Build a year-by-year spreadsheet for the option, construction and operating phases. Include extension scenarios, delayed construction, partial build-out and early termination. Compare the total expected payment with the acres unavailable for farming, lost crop revenue, extra travel around fences and any tax or compliance costs. A high annual figure may be less attractive if it applies only after several unpaid development years or to fewer acres than the map suggests.
Protect farming, tenants and field access
Determine exactly when the developer may enter, take possession and exclude you. Existing tenants, custom operators and grazing arrangements need written notice and workable routes.
Define permitted agricultural use
If the proposal says farming will continue or advertises agrivoltaics, name the activities and design obligations. DOE describes agrivoltaics as agriculture under or between panels, but higher panel height and wider spacing can increase installation cost or reduce electricity production. “Allow farming” is not a defined plan unless the contract states, for example, permitted crops, grazing species, machinery dimensions, panel clearance, row spacing, water access and maintenance responsibility.

- State whether spraying, fertilizer application, livestock movement, hunting and drainage maintenance are allowed.
- Require coordination with tenants and a contact who can authorize urgent access.
Put damage and interference procedures in writing
Construction can damage crops, tile, fences, lanes, soil structure and drainage even outside the final fence line. The lease should define notice, inspection, valuation and payment for crop loss and repair. Specify whether compensation uses actual documented loss, a county crop budget, an agreed schedule or another measurable method. Address dust, compaction, weeds, runoff, fire risk, erosion and restoration of temporary roads.
Read term, renewal, transfer and default provisions together
A lease that appears to run for one period may last much longer through extensions and renewals. Wisconsin Extension identifies duration and early termination as issues requiring investigation; Missouri Extension also flags renewals and related obligations.
- Term: Separate the option, construction, operating and post-term removal periods.
- Renewals: Identify who controls each renewal, the notice deadline and the rent adjustment.
- Early termination: Ask whether the developer can walk away after permitting, financing or interconnection failure, and what you receive if it does.
- Default: Check notice, cure periods, interest, self-help rights and your remedies for unpaid rent or property damage.
- Assignment and sale: Determine whether the developer may transfer the lease to an affiliate, investor or unknown buyer without your approval.
- Lender step-in: Understand any lender notice, cure or foreclosure rights that can delay your termination.
- Abandonment: Define when an idle or damaged project is considered abandoned and when removal duties begin.
Do not accept a renewal or assignment clause that changes your counterparty without preserving payment security, insurance, restoration obligations and a financially responsible guarantor.
Investigate taxes, farm programs and title before execution
Tax and program consequences are parcel- and jurisdiction-specific. Neither a developer’s estimate nor a general internet explanation can determine your result.

Property and income taxes
Ask your county assessor how panels, substations, roads and lease rights may affect real-property or personal-property valuation. If the land has a preferential agricultural assessment, ask whether development changes eligibility or triggers recapture. The contract should allocate added taxes, assessments, tax appeals and any recapture caused by the project, while stating who supplies records and pays by each due date.
Conservation and farm-program obligations
Contact the relevant USDA and state program offices before signing. Confirm whether construction, fencing, grading or a change in land use conflicts with conservation contracts, wetland restrictions, acreage reporting or other benefits. Require the party causing an ineligibility or repayment to reimburse the defined cost, subject to applicable law.
Insurance, indemnity and defense
Review construction and operating liability separately. Require appropriate commercial general liability, automobile, workers’ compensation and property coverage, with certificates and notice of cancellation. Clarify who defends claims and pays attorneys’ fees when an injury, fire, storm, chemical drift or equipment failure involves the project. Address actions by your employees, tenants, contractors and visitors; a broad indemnity can shift risks you did not expect.

DOE reports that a photovoltaic system’s typical performance period is 20 to 30 years. That technical life is not a promise that your lease ends then; the agreement may run longer through renewals. DOE’s Federal Energy Management Program states: “A decommissioning plan for the end of system life should be in place as a part of the land-use agreement and could be required to construct a new PV system.”

Specify triggers, scope and standards
Define decommissioning triggers such as lease expiration, prolonged nonoperation, abandonment, insolvency or failure to meet a production threshold. Set notice and completion deadlines. The scope should address panels, inverters, transformers, batteries, wiring, racks, foundations, roads, fencing, buildings, buried materials and contaminated soil, as applicable.
Use measurable restoration standards: removal depth for foundations, compaction limits, drainage performance, topsoil replacement, grading, erosion control, weed management and revegetation. Identify who may inspect, how disputes are resolved and what happens if weather prevents seasonal work.
Require credible financial security
Decommissioning costs should be budgeted, not left to a future promise. Negotiate a bond, letter of credit, escrow or other security that remains adequate as costs rise and survives assignment, lender foreclosure and developer failure. State when the security is posted, how it is recalculated, who controls it and how you may draw it after an uncured default. A restoration clause without a funded backstop can leave the landowner paying for removal.

Use a disciplined review process before signing
- Collect the full document set: Obtain the option, lease, easements, exhibits, site plan, insurance requirements, decommissioning plan, guaranties and any recorded notices.
- Map the project: Walk every field with the drawings, mark access and exclusion areas, and identify tenant and drainage conflicts.
- Build the payment model: Calculate each phase, escalation, acreage assumption, delay scenario, downsizing outcome and termination payment.
- Check outside obligations: Ask the assessor, planning office, lender, USDA or state program office and insurer for parcel-specific answers.
- Negotiate operational language: Add farm-use rules, damage schedules, access procedures, notice contacts, tax allocation and insurance evidence.
- Secure the exit: Finalize decommissioning triggers, standards, deadlines and financial assurance before execution.
- Obtain independent legal review: Use counsel who regularly handles solar land leases in your state, not only a general real-estate review.
- Keep a signed record: Store the final exhibits, surveys, amendments, payment notices and inspection reports; the version you sign controls.
