Factory air permits do two different jobs under the Clean Air Act. A New Source Review (NSR) permit generally authorizes construction or a major modification before work begins, while a Title V operating permit gathers the air-pollution requirements that apply once a source operates. One factory can need both. To participate, find the public notice and complete permit record, follow that notice’s comment and hearing deadlines, submit specific evidence-based comments, and keep proof of filing.
This is a federal overview, not a permit analysis for a particular facility or legal advice. State, local, tribal, and federal authorities administer different portions of the programs, so the named authority and the actual notice control the deadline, filing method, and appeal route.

First identify which permit is being proposed
Do not assume that every factory has one standard “emissions permit.” The program depends on what the source is doing, how much it emits, which pollutants are involved, and whether the action is construction, modification, or ongoing operation.

EPA describes NSR as a preconstruction program for qualifying new or modified stationary sources. A source at or above the applicable emissions thresholds generally must obtain the required NSR authorization before construction begins. The permit can contain technology, emissions, monitoring, and operating requirements tailored to the project and the pollutants covered. The exact threshold and type of NSR review depend on the source facts and the applicable federal, state, local, or tribal rules. EPA’s public-participation explanation is at Participate in the Permitting Process — NSR.

Title V: an enforceable operating document
Title V is an operating-permit program for major sources and certain smaller sources that meet applicable emissions thresholds. EPA characterizes a Title V permit as a legally enforceable document that consolidates the air requirements applying to a facility and clarifies what the facility must do to comply. It does not automatically invent new pollution limits; the limits and duties come from the underlying federal and state requirements and from the permit’s own terms. Read EPA’s overview of the program in Basic Information about Operating Permits.
A facility may need both programs
A new production line may require NSR approval before construction and later be covered by a Title V operating permit. An existing plant may be renewing or revising Title V while a separate modification proceeds through NSR. When reading a notice, identify the permit number and program rather than relying on the facility’s general description.
| Question | NSR | Title V |
|---|---|---|
| Primary purpose | Preconstruction review for a qualifying new source or modification | Operating permit that consolidates applicable requirements |
| When it matters | Before construction or the covered change begins | During operation and at renewal or revision |
| Who may issue it | State, local, tribal, or EPA authority, depending on jurisdiction | Usually a state or local Part 70 authority; EPA issues a smaller number under Part 71 |
| Public record | Notice, application, draft permit, technical analyses, comments, and final decision | Application, draft permit, fact sheet or statement of basis, comments, response to comments, and final permit |
EPA’s Clean Air Act Permitting System and the permitting authority’s own website can help you determine which record you are looking at.
What the permit must tell the factory to do
Emission limits and control measures
The draft or final permit should identify each regulated emissions unit, the pollutant limits or applicable standards, and the control equipment or work practices required to meet them. A permit may address boilers, furnaces, coating lines, storage tanks, engines, or other units separately. Check whether limits are expressed as a mass rate, concentration, production-based rate, operating-hour limit, fuel or material restriction, or another enforceable format.
Monitoring, records, and reports
Look for the monitoring method tied to every important limit. The permit should state what the operator measures, how often, which instruments or tests are used, and what records must be retained. It should also specify deviation reports, certification dates, test schedules, and notifications to the permitting authority. A limit without a practical monitoring and reporting provision can be difficult to enforce, so those provisions deserve the same attention as the numerical limits.

Operating conditions and compliance duties
Title V terms can include startup, shutdown, malfunction, maintenance, fuel or raw-material restrictions, control-device operation, inspection, and recordkeeping requirements. The enforceable conditions are in the permit and incorporated requirements, not merely in a summary webpage. Compare the draft’s tables and appendices with the fact sheet or statement of basis to see how the authority explained each requirement.
Renewal cycle
EPA generally describes Title V permits as being renewed every five years, although the facility’s permit controls its actual expiration and renewal dates. Treat the five-year figure as a typical cycle, not a substitute for checking the permit file.

Find the notice and complete permit file
The public notice is the starting point because it names the issuing authority, permit action, comment period, hearing procedure, and submission address. Use this sequence:
- Identify the authority. Follow the state environmental agency, local air district, tribal authority, or EPA office named in the notice. Do not assume EPA is the direct issuer.
- Search the agency’s permit database. Search by facility name, street address, permit number, and county. For Title V, EPA’s Participate in the Permitting Process — Title V page lists electronic state permit sources where available.
- Check EPA’s systems. The Clean Air Act Permitting System may contain materials entered into EPA’s public-facing system, but the local file may be more complete.
- Download every component. Save the application, draft permit, fact sheet or statement of basis, emissions calculations, modeling or technical analyses, appendices, public notice, and any proposed permit revisions.
- Record version dates. A revised draft can replace an earlier document. Keep the file name, publication date, and download date with your notes.
If a document is missing, ask the permitting authority for the complete administrative record and the correct method for obtaining it. A missing attachment can change how a permit condition should be understood.
Read the public notice before counting days
EPA says an NSR comment period is usually 30 days, but that is a general description, not a universal deadline. The notice for your facility controls the opening date, closing time, time zone, submission channel, and hearing-request deadline. Title V notices can use different schedules or additional procedural steps.

When a notice is amended, use the latest notice and verify whether the amendment reopened or extended comments.
Do these 3 things before closing this tab:
1Scan for outdated or missing drivers - takes under a minute2Repair Windows errors before they cause bigger problems3Fix the driver behind crashes, sound loss and screen glitchesWrite comments that the authority can answer
Effective comments connect a precise permit provision to a factual concern and a requested action. General statements that a factory is “polluting” or that a project is “good” or “bad” are less useful than a documented question about a specific unit, limit, monitoring method, or missing analysis.
Use a repeatable comment format
- Identify the document and provision. State the facility, permit number, draft version, page, table, emissions unit, or condition number.
- State the concern. Explain what the draft says and why the record appears incomplete, inconsistent, or inadequate.
- Support it with the record. Cite the application, emissions calculation, technical analysis, operating data, or another document in the file. If you rely on local observations, give dates, times, weather conditions, and what was observed without claiming more than you know.
- Ask for a concrete response. Request a corrected limit, additional monitoring, a revised analysis, a clarification, or an explanation of the agency’s legal and technical basis.
- Separate issues. Number each comment so the final response can address them individually.
Questions worth checking
- Does every emissions unit listed in the application appear in the draft permit?
- Do proposed limits match the emissions calculations and applicable standards?
- Is monitoring frequent and reliable enough to demonstrate compliance?
- Are testing, record retention, reporting, and deviation-notification duties stated clearly?
- Does the draft explain startup, shutdown, malfunction, maintenance, and control-device bypass conditions?
- Are production, fuel, raw-material, or operating-hour assumptions enforceable?
- Does the fact sheet explain why the selected limits and monitoring methods satisfy the applicable rules?
- Did a revised draft change a condition without giving the public a meaningful opportunity to review it?
EPA’s Title V petition guidance later requires a clear issue, supporting citations, and identification of where the issue was raised during public comment. Writing comments in that disciplined format preserves a useful record. See Title V Petitions.
Request a public hearing when it will help
NSR notices include a deadline for requesting a hearing, and Title V procedures also allow comments and hearing requests. A hearing is most useful when residents need to explain technical or community concerns on the record, ask questions in a public forum, or show substantial interest in the proposed action. It is not a replacement for written comments: submit the specific issues in writing as well.
Follow the notice exactly for the request format, address, and deadline. Some authorities require a written explanation of why a hearing is warranted; others provide a form or online process. If a hearing is scheduled, review the agency’s rules for testimony time, registration, accessibility, and whether written exhibits may be submitted.

Submit and preserve proof
Before sending comments, compare your draft with the notice one more time. Include the facility name, permit number, and your contact information if the notice requires it. Submit through the specified channel and keep:
- the final text and all attachments;
- the submitted email, portal receipt, or certified-mail record;
- the date, time, and time zone of filing;
- the notice and draft version you addressed; and
- any later acknowledgment from the authority.
These records matter if you need to show that an issue was raised during the comment period. Do not wait for a later appeal or petition to make the first detailed presentation.
What happens after comments close
The permitting authority reviews timely comments and may revise the draft. If revisions are substantial or introduce new issues, another notice and comment opportunity may be required. The final permit should be read together with the response-to-comments document and supporting explanation.
For Title V, EPA’s summary of the petition rules says permitting authorities must respond in writing to significant comments when applicable, with the response-to-comments document supplied with the proposed permit for EPA review. Compare each numbered concern with the response and then check whether the final permit actually changed.
Title V petitions to EPA
Anyone may petition EPA to object to certain Part 70 permits. Ordinarily, the petition can raise only issues previously raised during public comment, subject to EPA’s exceptions when commenting was impracticable or the grounds arose later.

EPA describes a 45-day review period for a proposed Part 70 permit. If the Administrator does not object, a subsequent 60-day public petition period is available under the process described by EPA. The permit-specific notice and the live EPA instructions control the deadline.
EPA’s current instructions say petitions should be emailed to [email protected], with a hard-copy backup method, and that copies must also be provided to the permitting authority and permit applicant. Verify the current filing mechanics before sending anything. A petition should identify the exact permit term, explain why it violates an applicable requirement, cite the record, identify where the issue was raised in comments, and explain how the authority responded.
NSR appeals, enforcement, and noncompliance
Appeal procedures for NSR permits depend on the state or other issuing jurisdiction. EPA says people normally must comment on the draft permit to preserve issues for an appeal. For EPA-issued permits or permits issued on EPA’s behalf, EPA identifies possible appeals to the Environmental Appeals Board and federal courts; jurisdiction-specific rules determine the deadline and filing requirements.
A permit challenge is different from reporting an operating violation. If a facility appears not to be complying with an existing permit, EPA’s NSR participation information directs residents to notify the permitting authority or EPA. Use the current enforcement and compliance route for that concern. An enforcement report or potential citizen suit does not substitute for a timely comment on a draft permit.
2026 policy developments to keep separate from the basic process
In a May 11, 2026 announcement, EPA described guidance allowing state, local, and tribal authorities to conduct public comment while EPA reviews a proposed Title V permit. EPA said concurrent review can preserve public participation while permitting review proceeds, and the announcement emphasized that the guidance does not change or replace binding legal requirements. Read the announcement at EPA issues guidance streamlining Clean Air Act Title V operating permit process.
Separately, EPA’s January 5, 2026 summary of final revisions to Title V petition provisions explains when significant comments must receive written responses and how those responses accompany proposed permits for EPA review. The summary is available at Final Revisions to the Petition Provisions of the Title V Permitting Program. These updates do not eliminate the need to read the facility’s notice, permit, and governing jurisdictional rules.
Practical timeline and decision checklist
| Stage | Figure or action | What controls |
|---|---|---|
| NSR public comment | Usually 30 days | The facility’s notice, including its stated close date and filing method |
| Title V EPA review | 45 days described by EPA | The proposed Part 70 permit and current EPA procedures |
| Title V petition period | 60 days after the described review if EPA does not object | The current EPA instructions and permit-specific date |
| Title V renewal | Typically every five years | The permit’s own expiration and renewal schedule |
- Before commenting: confirm the program, authority, permit number, latest draft, and exact deadlines.
- While commenting: cite page and condition numbers, explain the factual problem, and request a specific response or change.
- After filing: preserve receipts, watch for amended notices, and obtain the response-to-comments document and final permit.
- If considering a petition or appeal: verify current jurisdiction-specific instructions and show where each issue was raised on time.
The most reliable way to evaluate a factory permit is to work from the actual public notice and complete administrative record. Program labels, typical timelines, and agency summaries provide orientation; the enforceable requirements and your participation rights come from the permit documents and the rules identified in that notice.
