The exact duty depends on the state: Texas law treats an engaged automated driving system as the operator for traffic-law compliance and requires a qualifying vehicle to yield, move right, clear the intersection and stop. California has adopted additional responder-communication and emergency-zone measures, with some provisions phased in. There is no single nationwide statute in the sources reviewed that sets one identical pull-over rule for every state.
What must a driverless car do when an emergency vehicle approaches?
It depends on the jurisdiction and on which emergency vehicle and signals trigger that jurisdiction’s law. In Texas, an automated vehicle must be capable of complying with applicable traffic laws, and an engaged automated driving system is treated as the vehicle’s operator when deciding whether traffic and motor-vehicle laws were followed. The statute therefore assigns the traffic duty to the operating system rather than making the absence of a human driver an exemption. Texas Transportation Code, §§545.454–545.455.

Texas: yield, move right, clear the intersection and stop
Under Texas Transportation Code §545.156, an operator must yield to an approaching emergency vehicle displaying the specified visual signals and using the required audible signal, as well as certain listed police or official vehicles using a lawful signal. The operator must immediately move parallel to and as close as possible to the right-hand edge or curb, clear of an intersection, and stop until the emergency vehicle passes. A police officer may direct otherwise. The signal and vehicle conditions matter: the rule should not be reduced to “any flashing light always means pull over.” Texas Transportation Code, §545.156.

The sources available here do not establish a 50-state comparison, so drivers and fleet operators should check the law where the vehicle is operating.

What must a driverless-car fleet prepare for emergency responders?
Traffic duties and fleet-planning duties are separate. Texas requires a commercial driverless-vehicle operator to submit an emergency-services interaction plan to the Department of Public Safety. The plan must cover how responders can reach a fleet support specialist while the vehicle is operating, safely remove and tow the vehicle, recognize whether the automated driving system is engaged, and understand additional hazards or public-safety risks. Texas Transportation Code, §545.454.
California: communication, training and emergency zones
California’s DMV announced adopted autonomous-vehicle regulations on April 28, 2026, adding first-responder interaction plans, training and emergency-geofencing procedures. The DMV’s summary describes two-way communication with a 30-second response time and says manufacturers must direct their fleets to leave an identified area within two minutes after receiving an official emergency-zone directive. Because the DMV says effective dates are phased, whether a particular provision is enforceable depends on its operative date. Is there a federal pull-over rule for driverless cars?
The federal source cited here is NHTSA’s 2016 Federal Automated Vehicles Policy. It identifies yielding to emergency vehicles and following first responders who are controlling traffic as behavioral competencies for automated vehicles to consider. It is policy guidance, not a nationwide traffic statute that replaces state law. NHTSA, Federal Automated Vehicles Policy.
What should police and firefighters know when a driverless car is stopped?
The practical challenge is not just getting a vehicle to stop; responders may also need to keep it stationary, determine whether automated driving is active, and identify the vehicle or its owner when nobody is seated behind the wheel. A 2025 DOJ COPS Office account of research by the International Association of Chiefs of Police and Virginia Tech Transportation Institute highlights those issues. The white paper drew on a survey of 378 law-enforcement and first-responder agency members, along with focus groups and interviews. DOJ COPS Office: How To Stop a Self-Driving Car.

What the rules do—and do not—establish
- A human driver is not necessarily required for traffic rules to apply. Texas expressly assigns the operator role to an engaged automated driving system for compliance purposes.
- Emergency-vehicle duties depend on local law and triggering conditions. Texas sets out signal and vehicle conditions, the required maneuver, and an officer-direction exception; do not assume other states use the same text.
- Fleet readiness is an additional obligation. Responder contact channels, removal and towing procedures, and system-identification information concern the operator’s preparedness, distinct from the vehicle’s immediate duty to yield.
- Federal policy and responder guidance are not state traffic statutes. They can inform design and response practices without establishing one nationwide legal rule.
