Elon Musk’s January 2025 comments were a significant change in what Tesla said some Hardware 3 cars would need for future unsupervised driving software: an upgrade. But they were not a blanket admission that Tesla’s current Full Self-Driving feature had failed, and the legal record cited here does not show a general ruling that Musk or Tesla “must face justice.” Tesla currently calls the feature Full Self-Driving (Supervised); the driver must remain responsible for supervision.
What did Elon Musk say about Hardware 3?
On January 30, 2025, TechCrunch reported that Musk had said on a Tesla conference call the previous evening that some vehicles with Hardware 3 would need a computer upgrade before they could support the unsupervised driving software Tesla was developing. TechCrunch described Hardware 3 cars as vehicles sold between 2019 and 2023 and the software then running on them as Full Self-Driving (Supervised).
TechCrunch attributed this statement to Musk: “I think the honest answer is that we’re going to have to upgrade people’s Hardware 3 computer for those that have bought Full Self-Driving,” he said. “That’s going to be painful and difficult, but we’ll get it done.” The report does not establish the technical details, timing, or cost of a retrofit for every affected vehicle.
The news mattered because TechCrunch contrasted the statement with Tesla’s 2016 claim that every car it was building had the hardware needed to one day fully drive itself. The gap was nearly nine years, according to TechCrunch. That contrast raises a legitimate question about the scope of Tesla’s earlier promise; it is not, by itself, an independent technical audit or proof that all FSD functionality failed.

Does this mean Tesla Full Self-Driving is actually self-driving?
No. Tesla’s current product page calls the feature “Full Self-Driving (Supervised).” Keep the word “Supervised” in mind: the name does not mean the car is autonomous, nor does it permit a driver to stop monitoring the vehicle. Tesla’s product page describes its product, not an independent safety evaluation.
The Hardware 3 comment concerned whether certain cars could support future unsupervised software without an upgrade. That is distinct from the capabilities and operating limits of the supervised feature those cars had. The reported need for a future hardware upgrade should not be recast as proof that every present-day use of FSD has failed—or as evidence that unsupervised autonomy is already available.

What do the legal cases establish?
The cases cited in coverage involve different facts and legal outcomes. A family’s allegations, a settlement, a small-claims decision, and a proposed class action are not interchangeable. None of the examples below establishes a broad court finding that Tesla’s flagship technology failed or that Musk must face justice.
Walter Huang wrongful-death lawsuit
The Associated Press reported that Tesla settled a wrongful-death lawsuit brought by Walter Huang’s family in April 2024, one day before trial was scheduled to begin. The settlement amount was not disclosed. The family alleged that Tesla and Musk repeatedly exaggerated the technology’s capabilities and promoted Autopilot in ways that could lead drivers to believe they did not need to remain vigilant. Because the case settled before trial, those allegations were not proven by a trial verdict.

The crash involved a Model X with Autopilot active that struck a highway barrier in Mountain View on March 23, 2018; Huang died. AP reported that evidence indicated Huang was playing a video game on his iPhone. That detail is relevant context, but it does not alone establish a single cause of the crash.
Washington small-claims ruling
Electrek reported that Tesla owner Ian Jordan complained after Tesla sought payment for a hardware upgrade required to access an FSD subscription. Tesla did not appear, and the judge ruled for Jordan. Electrek quotes the judge as concluding that the advertised hardware capability and later upgrade cost amounted to false advertising. The report also describes a separate award involving a different vehicle’s media computer and a warranty dispute.

This was a small-claims case, not a nationwide ruling on Tesla’s FSD program. Its outcome should be described in that limited context rather than treated as a general judgment about all Tesla vehicles, customers, or software.
Proposed 2017 class action
A Washington Post report on a proposed class action described plaintiffs’ allegations about delayed Autopilot 2 features and software quality. The report presents those points as claims by the plaintiffs, not as findings established by a court. It offers historical context for disputes over promises and delivery, not proof of a final legal determination.

How should the “failed and must face justice” headline be read?
It combines a real, consequential reported statement with conclusions that go beyond the evidence described here. Musk’s reported remark was about upgrading some Hardware 3 cars for future unsupervised software. It does not establish that Tesla’s supervised feature as a whole failed. And the legal examples differ in status: one settled before trial, one was a limited small-claims ruling, and one concerned allegations in a proposed class action.
The headline article published by Indian Defence Review on December 20, 2025 also made claims about investigations in multiple countries, MIT research, and customer backlash. Those claims are not independently established by the sources cited here, so they should not be treated as verified facts on that basis.
