Western Australia announced a broader car-licensing overhaul on 26 April 2026, but the announcement did not set a start date for the new rules. It is separate from Tom’s Law, the existing restriction that limits red P-platers to one passenger during their first six months on provisional plates, subject to exemptions.
What is the WA P-plate overhaul?
It is a proposed strengthening of Western Australia’s car Graduated Licensing System (GLS), announced by the WA Government on 26 April 2026. The package would extend the time and supervised practice required before and during provisional licensing, introduce an online theory and hazard-perception test option, and add phone and supervisor alcohol rules. The announcement does not establish that these changes are already in force or give a commencement date. The government said timing would be determined after consultation on proposed motorcycle-system changes and alignment of legislative changes for cars and motorcycles. The passenger rule often associated with the overhaul is different: Tom’s Law has applied since 1 December 2024. It was introduced after Tom Saffioti, aged 15, died in a 2021 crash involving a red P-plater and an overloaded car. The later GLS review was backed by the “Tom’s Story” campaign. More than 7,700 Western Australians took part in the consultation preceding the 2026 announcement, according to the government.
What changes did the government announce for car drivers?
The announced car package would change several stages of licensing. These are announced measures, not a confirmed commencement schedule.

The table reflects the 26 April 2026 WA announcement; it does not establish whether a later law or commencement notice has changed the status of any item.
What does Tom’s Law require now?
Transport WA says the passenger restriction applies during the first six months of a provisional licence, while a driver is on red P plates. During that period, a red P-plater is limited to one passenger unless an exemption applies. It is not a restriction on every provisional driver for the full P-plate period. Who is exempt?
- An additional passenger who has held an ordinary or full C-class licence for at least four years.
- Passengers who are immediate family members.
- Extra passengers required for the driver’s employment. For this exemption, the driver must carry an employer letter and produce it if requested.
Transport WA says no application is required for these exemptions, although police may request proof. The stated penalty for breaching the restriction is a $200 fine and two demerit points.
Why were the rules proposed?
The government’s stated aim is safer roads, particularly for young and novice drivers. The 2026 announcement followed a review of the car GLS, which Transport WA described as considering how driving ability is assessed, what hours learners log before testing, and how learners are prepared for solo driving.

WA’s 2024 announcement reported a killed-or-seriously-injured rate of 107 per 100,000 population for Western Australian drivers aged 17–19, citing the Western Australian Road Fatalities and Serious Injuries 2023 report. That is a rate for a specified age group and population denominator, not a count of deaths or a rate for all young drivers. The WA announcement gives the figure and its context.
A separate Victorian Government response, published in 2021 and recounting a 2017 review, said fatal and serious injury crash involvement among Victorian drivers aged 18–20 fell 20%, while involvement among P-platers in their first year of solo driving fell 19%. It also cited research indicating that learners with about 120 practice hours had about 35% lower risk than learners with about 40 hours. These are historical Victorian findings, not evaluations of the WA package. The Victorian Government response describes those findings.

Neither those historical figures nor the WA announcement demonstrates that the 2026 package has reduced crashes. The new measures should be understood as proposed safety requirements, not proven outcomes.

Transport WA’s Tom’s Law guidance highlights practical risks that apply beyond passenger limits: seatbelt use, distraction from passengers or phones, speed, fatigue, and unfamiliar regional roads. It states that two seconds of distraction at 60 km/h means travelling 33 metres without looking at the road, and that every 5 km/h above the limit in a 60 km/h zone doubles the risk of injury in a crash. For the new car GLS requirements, check a current WA Government implementation notice or the applicable law before relying on an effective date: the 26 April announcement itself does not give one. For the passenger restriction, use Transport WA’s current red-plate guidance to confirm the rule and exemption details that apply to a particular journey.
