On March 11, 2025, President Donald Trump said he would label violence against Tesla dealerships as domestic terrorism. That was a political announcement, not a court ruling: federal law defines domestic terrorism through specific elements, and whether conduct meets them depends on evidence. Peaceful protest and protected speech are distinct from violence or other alleged crimes.
What Trump said about violence at Tesla locations
Trump made the remarks while appearing with Tesla CEO Elon Musk at the White House, amid protests over Musk’s role in the federal government and reports of graffiti and fires at Tesla-related locations. Trump said, “I’m going to stop them,” and warned, “You do it to Tesla, and you do it to any company, we’re going to catch you, and you’re going to go through hell.” TechCrunch reported the remarks on March 11, 2025.
Contemporary coverage used “Tesla Takeovers” for some protests, while the movement described itself as “#TeslaTakedown.” Those labels should not be treated as interchangeable descriptions of every protester or every incident.
What domestic terrorism means under federal law
Under 18 U.S.C. § 2331(5), domestic terrorism involves activities that:

- Appear intended to intimidate or coerce a civilian population, influence government policy by intimidation or coercion, or affect government conduct through mass destruction, assassination, or kidnapping; and
- Occur primarily within U.S. territorial jurisdiction.
The FBI’s description of the statute and its investigative standards makes clear that a public official’s use of the term does not itself establish that these elements are satisfied in a particular case. The conduct, evidence of intent, and applicable law matter.
Protest, vandalism, and arson are not the same thing
Peaceful protest and speech—including speech expressing an extremist ideology—are not unlawful merely because of their viewpoint. FBI testimony says an investigation cannot be opened solely on the basis of First Amendment-protected activity. It adds that investigations of individuals are opened on information concerning the occurrence or threat of violent criminal actions in furtherance of an ideology.

In 2022 joint testimony, FBI National Security Branch Executive Assistant Director Jill Sanborn and DOJ Assistant Attorney General Matthew Olsen said steps to counter domestic terrorism must focus on “acts or true threats of violence,” while safeguarding civil rights and liberties. Their January 11, 2022 testimony distinguishes protected activity from violent conduct; it does not make every act of vandalism terrorism. Whether a specific criminal act also meets the statutory definition turns on its danger, intent, and circumstances.
What officials and court records established in March 2025
Bondi’s public characterization
On March 18, Attorney General Pamela Bondi called the “swarm of violent attacks on Tesla property” “nothing short of domestic terrorism.” She said DOJ had charged several perpetrators “with that in mind,” and referred to cases involving five-year mandatory minimum sentences. Those were Bondi’s public characterization and description of charging decisions—not a blanket judicial finding about all incidents. DOJ’s March 18 announcement does not establish that every protest, vandalism report, or prosecution met the statutory definition.

The March 19 briefing and investigation
At a March 19 White House briefing, Press Secretary Karoline Leavitt said the attorney general was investigating the events as acts of domestic terrorism. An investigation is not a court determination that the legal elements have been proved. The briefing transcript records the administration’s position at that time.
The March 27 DOJ case announcement
On March 27, DOJ announced that Paul Hyon Kim had been charged by criminal complaint with one count of arson and one count of unlawful possession of an unregistered firearm, following an incident at a Tesla collision business. According to allegations in the complaint, Molotov cocktails and a .30-caliber AR-style firearm were used on March 18 to damage and destroy five Tesla vehicles, and “Resist” was spray-painted on the building. These are allegations, not findings of guilt. The release documents charges and a multi-agency investigation; it does not report a final terrorism conviction. Read DOJ’s March 27 release.

Why the terrorism question remained open in contemporaneous reporting
In an Associated Press report on March 19, FBI Las Vegas Special Agent in Charge Spencer Evans asked, “Was this terrorism? Was it something else?” He said the reported facts had “some of the hallmarks” investigators might consider. That language reflects an open question, not a final classification.
AP also reported that Indivisible said its publicly available protest guidance explicitly encouraged peaceful protest and condemned violence or vandalism. The existence of a protest movement does not, by itself, establish a connection between peaceful organizers and people accused of crimes; that requires evidence. AP’s March 19 report preserves both the investigative uncertainty and the distinction between protest guidance and alleged criminal conduct.
