There is no single universal legal test for every product described as “Made in Europe.” For general EU non-preferential customs origin, goods made in one country take that country as their origin; when production spans countries, the general rule looks to the last substantial, economically justified processing or working. That customs test has a specific legal purpose and does not automatically decide every consumer-facing “Made in” claim.
First ask what kind of origin is being claimed
“Origin” can mean different things depending on the context: customs origin used for a tariff or trade measure, a country-of-origin statement required by a product-specific rule, or voluntary marketing wording on packaging or advertising. The applicable test can differ. The phrase “Made in Europe” alone does not identify which rule applies, and the general customs-origin rule should not be treated as a universal consumer-label standard.
The European Parliament’s 2013 briefing framed the consumer question as what country-of-origin (“Made in”) marking means for consumers: European Parliament briefing. It describes legislative debate, not a blanket rule in force for all consumer products.
How the general EU customs-origin test works
Articles 59–61 of Regulation (EU) No 952/2013, the Union Customs Code, address non-preferential origin, its scope and proof. Article 60 sets out the general rule: wholly obtained goods take the country where they were obtained. If production involves more than one country or territory, the goods are deemed to originate where they underwent their last substantial, economically justified processing or working, in an undertaking equipped for that purpose, resulting in a new product or representing an important stage of manufacture. In practical terms, the customs-origin inquiry asks:
- Was the good wholly obtained in one country or territory?
- If production crossed borders, where did the last substantial processing or working take place?
- Was that work economically justified and carried out in an undertaking equipped for it?
- Did it create a new product or constitute an important manufacturing stage?
- Which customs measure or other applicable rule makes the origin determination relevant?
The Code does not set one percentage-of-local-content threshold for all goods. Product-specific rules may apply, so a determination for an actual product requires its classification and the relevant rule. Customs authorities may require an importer to prove an indicated origin and, in circumstances described by the Code, seek additional evidence where there is reasonable doubt about submitted proof.

Why this is not automatically the test for a consumer label
European Parliament materials from 2013 and April 2014 discuss proposals for mandatory country-of-origin or “made-in” labelling for non-food consumer products. The 2013 briefing reports that the Commission withdrew an earlier 2005 proposal; neither document establishes that a general mandatory rule for all consumer goods became law. The practical implication is important: a customs-origin result may be relevant, but it does not, by itself, establish that a voluntary “Made in Europe” statement is permitted or required for every product. The product category, market, wording and current applicable law matter.

Product-specific rules can change the answer
A 2011 European Parliament textile legislative document described a proposed approach under which specified manufacturing stages would have to take place in a country for a textile product to be described on its label as entirely originating there. It also discussed legible, non-misleading origin wording. Because that document is legislative proposal history, its provisions should not be presented as binding current law without checking the rules that apply to the product and date. For a real product, assess the claim against the facts and rule that govern that product, rather than relying on the phrase alone:

- Purpose: Is the issue customs origin for a tariff or trade measure, a regulated label, or voluntary marketing?
- Product: What is the product category and, where relevant, its customs classification?
- Manufacturing history: Where did the inputs come from, and what work was done at each production stage?
- Claim wording: Does the statement refer to the finished product, a particular manufacturing stage, design, or assembly?
- Applicable rule and date: Which legal instrument and version govern the product, market and date of sale?
These are practical checks, not a substitute for an applicable product-specific legal rule. A definitive assessment needs the product classification, full manufacturing facts, market, exact claim wording and relevant current requirements.
