Under current IRS guidance, the new, used and qualified commercial clean-vehicle credits are unavailable for vehicles acquired after September 30, 2025. The change removed an incentive that had applied to many Tesla models, but the available evidence does not establish that ending it caused a specific loss in Tesla sales or profit, let alone prove the law was a “disaster” for the company.
What happened to the EV tax credit?
The headline refers to a proposal discussed during Senate Republican negotiations over a budget bill in 2025. The proposal became law shortly afterward: Public Law 119-21, enacted July 4, 2025, accelerated the end of three federal clean-vehicle credits.
- New vehicles: The section 30D new clean-vehicle credit is unavailable for vehicles acquired after September 30, 2025.
- Previously owned vehicles: The section 25E credit is unavailable for vehicles acquired after that date.
- Qualified commercial vehicles: The section 45W credit is unavailable for vehicles acquired after that date.
Before the law changed the timeline, the maximum new-vehicle credit was $7,500, subject to vehicle, buyer and other eligibility requirements. In a July 1, 2025 article, Ars Technica reported that most Tesla vehicles then offered for sale in the United States qualified, subject to those rules. That describes the situation at the time; it does not mean the credit remains available for a qualifying vehicle acquired after the cutoff.
Can I still claim a credit if I bought my vehicle before September 30, 2025?
Possibly. IRS guidance generally treats an acquisition as timely when the buyer had both a written binding contract and made a payment by September 30, 2025. Taking delivery later does not by itself rule out eligibility, provided the acquisition met the deadline and the buyer, vehicle and transaction satisfy the other applicable requirements.

For an individual claim, consult the current IRS instructions for Form 8936 and its related schedule. If a credit was transferred to the dealer at the point of sale but the buyer ultimately does not qualify, repayment may be required. The deadline alone does not establish eligibility.
Will ending the EV tax credit hurt Tesla?
It removed a price incentive that had been available for many Tesla models, so it could make some purchases less attractive to some buyers. But the evidence available here does not quantify how many Tesla buyers used the credit, how much demand depended on it, or how the termination changed Tesla’s prices, deliveries, margins or profits. The policy change is real; a Tesla-specific financial “disaster” is not established by those facts.

On January 8, 2025, the Associated Press reported Elon Musk saying: “I think it would be devastating for our competitors and would hurt Tesla slightly.” That is Musk’s assessment of a prospective policy change, not a measurement of what happened after the law took effect.
Does the change affect Tesla more than other automakers?
The available evidence does not support a reliable ranking of which automaker was hurt most. A meaningful comparison would need to account for several factors together:

- How many models and buyers qualified under the rules then in force.
- Transaction prices and manufacturer discounts before and after the incentive ended.
- Changes in buyer demand and deliveries around the cutoff.
- Each automaker’s margins and ability to adjust prices.
- Other policy-related revenue, kept separate from consumer purchase credits.
Tesla’s regulatory-credit revenue is not the same thing as a consumer clean-vehicle credit received by a buyer. Tesla’s regulatory filings report the company’s regulatory-credit business as a distinct category; that revenue cannot by itself show the effect of ending the consumer purchase credit.

A separate federal provision may still apply. IRS guidance says qualified home charging or other alternative-fuel vehicle refueling property placed in service before July 1, 2026 may be eligible for the alternative-fuel vehicle refueling property credit, subject to that provision’s requirements. This is not an extension of the section 30D vehicle purchase credit, and eligibility should be checked against current IRS guidance.
