Tesla Threatened to Sue Buyers Who Resell Cybertruck Without Written Permission

Tesla’s 2023 Cybertruck purchase terms threatened an injunction or $50,000-or-sale-value damages for covered first-year resales without Tesla’s written consent. The clause was later reported removed, and current Tesla terms primarily restrict reservation transfers and suspected resale before delivery.

Tesla threatened to sue buyers who resell Cybertruck without written permission under a 2023 purchase clause covering the first year after delivery. The clause threatened an injunction or $50,000—or the sale value, whichever was greater—but was later reported removed; current Tesla terms mainly address suspected resale before delivery.

The controversy involved two different stages of ownership. Tesla’s historical Cybertruck-specific clause governed resale after delivery, while Tesla’s current reservation and order terms allow cancellation before delivery when Tesla suspects an order was placed for resale.

Key takeaways

  • Tesla’s November 2023 purchase terms said a Cybertruck buyer generally could not sell or even try to sell the vehicle during the first year after delivery.
  • The historical process required Tesla to approve an unforeseen-need exception, receive the first opportunity to buy the truck, and give written consent before a third-party sale if Tesla declined.
  • The reported clause threatened an injunction and liquidated damages of $50,000 or the sale-transfer value, whichever was greater; that was a contractual remedy Tesla said it could seek, not proof that Tesla had fined or sued an owner.
  • The clause appeared publicly in November 2023, was reported in at least one Foundation Series buyer agreement in December 2023, and was reported removed again in August 2024.
  • Tesla’s current retrieved US Motor Vehicle Order Agreement, labeled US v.20250904, still allows pre-delivery order cancellation when Tesla suspects resale intent, but it does not reproduce the former Cybertruck-specific $50,000 written-consent provision.

What did Tesla’s Cybertruck resale clause say?

Tesla’s 2023 Cybertruck purchase terms created a one-year post-delivery resale restriction. The terms said a buyer generally could not sell, or even attempt to sell, the vehicle during the first year after delivery without Tesla’s involvement.

The reported exception process applied when an owner had an unforeseen reason to sell. The owner had to ask Tesla to recognize the reason, notify Tesla, and give Tesla the first opportunity to buy the Cybertruck. The proposed buyback price was based on the Final Price Sheet amount, less $0.25 per mile, reasonable wear and tear, and repair costs. If Tesla declined, the owner still needed Tesla’s written consent before selling to someone else.

The reported agreement described the potential remedy this way: Tesla may seek injunctive relief to prevent the transfer of title of the Vehicle or demand liquidated damages from you in the amount of $50,000 or the value received as consideration for the sale or transfer, whichever is greater. The quotation is historical Tesla purchase-agreement language reproduced in Ars Technica’s November 2023 report.

In plain English, the clause threatened to ask a court to stop the title transfer or to demand the larger of $50,000 and the amount received for the transfer. The clause did not mean that Tesla had already won a lawsuit, imposed a fine, or collected $50,000 from every reseller.

Did Tesla really threaten to sue Cybertruck owners?

Yes—but the accurate description is that Tesla’s 2023 purchase terms threatened contractual legal remedies against a buyer who breached the special resale provision. The language described an injunction and liquidated damages; it was not evidence of a completed lawsuit.

The public clause drew attention in November 2023 and was removed from Tesla’s publicly available agreement shortly afterward, according to contemporaneous reporting by Ars Technica. In December 2023, Ars Technica reported that substantially similar language had returned in at least one agreement provided to a Foundation Series buyer.

That evidence supports saying the clause appeared in some early Cybertruck purchase documents. It does not support saying every Cybertruck buyer received identical terms. The number of buyers who received the clause, the number of owners Tesla allegedly blacklisted, and the number of blocked transactions have not been established by an independent published statistic in the reviewed material.

When did Tesla add and remove the Cybertruck no-resale clause?

The Cybertruck resale restriction changed over several stages rather than remaining a continuous, universally documented ban.

Period Document or report What the evidence shows Practical meaning
November 2023 Public Tesla Motor Vehicle Order Agreement Cybertruck-specific first-year restriction, exception process, Tesla first opportunity to buy, written consent, and threatened damages. A buyer covered by those terms faced a contractual resale restriction after delivery.
December 2023 Reported Foundation Series buyer agreement Ars Technica reported that the clause had returned in at least one early buyer agreement. Some Foundation Series buyers may have received the provision; universal coverage is not established.
August 2024 Reporting on Tesla’s purchase agreement Electrek reported that Tesla had removed the special no-resale clause as production and availability changed. The historical $50,000 written-consent clause was no longer reported as part of the agreement then reviewed.
Current agreement reviewed August 14, 2026 Tesla US Motor Vehicle Order Agreement, US v.20250904 The agreement addresses suspected resale intent before delivery but does not reproduce the former Cybertruck-only post-delivery clause. Current ordering restrictions should not automatically be treated as a current one-year ban on selling a delivered Cybertruck.

The August 2024 reporting also said, “As far as we know, the company hasn’t sued anyone over this issue.” That is a reporting-based negative finding, not a complete audit of every court docket. The careful conclusion is that no publicly documented lawsuit was identified in the reporting reviewed. Read Electrek’s August 2024 account of the reported removal for that qualification and its separate discussion of alleged blacklisting.

Does the Cybertruck no-resale clause still apply?

The retrieved current Tesla agreement does not reproduce the former Cybertruck-specific one-year, written-consent, and $50,000 language. However, whether a particular owner is bound by a historical clause depends on the exact purchase agreement accepted for that vehicle, its delivery date, and applicable law.

Tesla’s current US Motor Vehicle Order Agreement, identified as US v.20250904, contains a general “No Resellers; Discontinuation; Cancellation” provision. The provision allows Tesla to cancel an order before delivery when Tesla believes the order was made with a view toward resale, including when a third party is facilitating or brokering the sale. The agreement also says Tesla may retain specified order, deposit, and transportation fees. The current Tesla Motor Vehicle Order Agreement is the relevant document for current ordering language.

That current pre-delivery policy is different from the historical post-delivery clause. A reservation or order can be canceled before delivery because Tesla suspects resale intent; that fact alone does not establish that every delivered Cybertruck currently carries a one-year resale ban.

Can I resell a Cybertruck without Tesla’s permission?

There is no single answer for every Cybertruck because the answer depends on the agreement governing the purchase. The historical agreement required written consent for a covered third-party sale during the first year after delivery, while the current retrieved agreement does not show that same Cybertruck-specific restriction.

Before listing or transferring a Cybertruck, an owner should review the signed Motor Vehicle Order Agreement, delivery date, title documents, and any later amendment or buyer-specific terms. An owner who received an early Foundation Series agreement should not assume that the current online agreement replaced the terms accepted at purchase.

Tesla’s owner documentation separately provides an administrative way to remove ownership and transfer a vehicle to a new owner through the Tesla mobile app. Tesla’s Cybertruck ownership-transfer instructions explain how to complete that account and vehicle transfer. The availability of an app-based transfer function does not, by itself, decide whether a historical contract restriction applies.

What is the difference between Tesla’s historical resale clause and current policy?

The historical clause governed a particular post-delivery resale process, while Tesla’s current published language reviewed for this article primarily concerns reservations and orders before delivery.

Issue Historical Cybertruck clause Current Tesla language reviewed
Transaction stage After delivery, during the first year Before delivery, at the reservation or order stage
Who was covered Buyers whose purchase agreements contained the special provision; at least one Foundation Series agreement was reported to include it Customers placing orders under the current general order terms
Required action Seek an exception, notify Tesla, offer Tesla the first opportunity to buy, and obtain written consent for a third-party sale Tesla may cancel an order if it believes the order was made with a view toward resale
Potential remedy Injunction or $50,000 or sale-transfer value, whichever was greater Order cancellation and possible retention of specified fees
Evidence status Published or buyer-provided contract language and contemporaneous reports Current Tesla agreement and Cybertruck FAQ language

Tesla’s current Cybertruck FAQ states, No. Cybertruck reservations cannot be transferred. The same FAQ says Tesla and its affiliates may cancel reservations believed to have been made with a view toward resale, in bad faith, or in violation of the Order Agreement. The statement concerns reservations, not proof that every delivered Cybertruck has a current post-delivery resale prohibition; see Tesla’s Cybertruck FAQ.

What should a Cybertruck owner do before selling?

  1. Find the governing contract. Locate the purchase agreement accepted for the specific Cybertruck rather than relying only on a current web page.
  2. Check the delivery date. The reported historical restriction lasted for the first year after delivery, not indefinitely.
  3. Look for the special language. Search for references to resale, written consent, Tesla’s first opportunity to buy, injunctive relief, liquidated damages, or the $50,000 amount.
  4. Separate reservation rules from resale rules. A reservation-transfer prohibition and an order-cancellation right operate before delivery and are not automatically the same as a post-delivery title-transfer restriction.
  5. Ask Tesla for written clarification if the contract is unclear. Keep the response and transaction records with the vehicle documents.
  6. Get jurisdiction-specific legal advice for a disputed sale. Contract interpretation and the treatment of liquidated-damages clauses can depend on the agreement, facts, and governing law.

This is an informational explanation of reported contract terms, not a legal conclusion about whether a particular clause is enforceable in a particular state or country.

What is the bottom line on Tesla’s Cybertruck resale threat?

Tesla did threaten contractual action in 2023 against covered Cybertruck buyers who resold or tried to resell during the first year without following Tesla’s exception process and obtaining written permission. The reported clause threatened $50,000 or the sale value, whichever was greater, and an injunction to stop title transfer.

The clause was later reported in at least one Foundation Series buyer agreement and then reported removed again in August 2024. The current Tesla materials reviewed still restrict reservation transfers and allow pre-delivery cancellation when Tesla suspects resale intent, but they do not reproduce the former Cybertruck-only post-delivery damages clause. The decisive document for an owner remains the exact agreement accepted for that Cybertruck.

Frequently Asked Questions

Can I resell a Cybertruck?

Tesla’s 2023 purchase terms said covered Cybertruck buyers generally could not sell or attempt to sell during the first year after delivery without following Tesla’s exception process. Tesla later removed the special clause from the agreement reviewed in reporting, but an owner should check the exact agreement accepted for the vehicle.

What was the $50,000 Cybertruck resale clause?

The reported clause threatened liquidated damages of $50,000 or the value received for the sale or transfer, whichever was greater, and allowed Tesla to seek an injunction to prevent title transfer. The clause described a remedy Tesla could seek; it did not prove that Tesla had fined every reseller or won a lawsuit.

Does the Cybertruck no-resale clause still apply?

Tesla’s current Cybertruck FAQ says reservations cannot be transferred and allows Tesla to cancel reservations believed to have been made with a view toward resale. That reservation policy is different from the historical post-delivery resale clause and does not establish a current one-year ban on selling every delivered Cybertruck.

The Bottom Line

Bottom line: Tesla’s $50,000 Cybertruck resale threat was real contract language in 2023, but it was time-limited, not proof of an indefinite resale ban or completed lawsuit. The special clause was later reported removed, while current Tesla rules continue to address suspected resale intent before delivery. Review the specific purchase agreement before selling.
