What did California accuse Tesla Insurance of?
CDI said consumer complaints about auto claims began in 2022 and that complaints and violations continued despite repeated warnings and company commitments to improve. The Department alleged delays at every stage of claims handling, unreasonable denials and late full payment of valid claims, inadequate or unfair investigations, and failure to tell policyholders they could ask CDI to review a denial. The phrase “egregious delays in responding to policyholder claims in all steps of the claims handling process” is the Department’s characterization of one allegation—not an adjudicated finding. CDI’s October 3, 2025 announcement describes the claims.
Which companies were named?
The action names three separate legal entities: Tesla Insurance Services, Inc.; Tesla Insurance Company; and State National Insurance Company. CDI describes Tesla Insurance Services as an appointed agent for State National, which the Department identifies as an admitted insurer in California. “Tesla’s insurance arm” is convenient shorthand, but the allegations name these companies rather than a single undifferentiated business. The Department’s announcement describes their roles.
What do California’s complaint figures show?
CDI’s 2026 Consumer Complaint Study ranks Tesla Insurance Company 49th among 50 large auto insurers licensed in California for the 2025 complaint year. The study reports 372 justified complaints and a ratio of 142.2 justified complaints per 100,000 earned exposures. These are complaint-study measures—not claim-denial rates—and do not prove each allegation in the enforcement action.

The figures are for Tesla Insurance Company, not a combined total for all three named entities. CDI defines the ratio as justified complaints per 100,000 earned exposures; exposures include motorcycles and motor homes, and the study says exposure counts are approximate. The ratio therefore provides context for justified complaints relative to exposure, not a measure of how often claims were denied. Can California revoke Tesla Insurance’s license?
The October 3 announcement said the companies had 15 days to respond. CDI said that, unless the matters were resolved in policyholders’ favor beforehand, the companies would be ordered to a hearing before an administrative law judge. The hearing was to determine whether they could continue transacting insurance in California and whether monetary penalties should apply.

The Department described possible penalties of up to $5,000 per unlawful, unfair, or deceptive act and up to $10,000 per act determined to be willful. Those were potential consequences, not penalties the announcement says were imposed. The announcement does not establish that a license was revoked or that the companies were found liable.
The subsequent procedural outcome is not established by the announcement. CDI’s formal enforcement-action search describes the case documents available to search for later pleadings, decisions, or orders.

How can a California policyholder complain?
CDI directed current or former auto policyholders of Tesla Insurance Company or State National who believe their rights were violated to contact the Department. California also provides an online insurance complaint service. It is a route to seek regulatory assistance, not individualized legal advice.

The October 3, 2025 release set out a response deadline, but the cited announcement does not say what response the companies made or what happened after the deadline. A later filing or order in CDI’s formal enforcement-action records would be needed to establish that status.
