Tesla FSD Advertising Cases: What the California DMV Found and Where the Lawsuit Stands

The California DMV found Tesla’s former Autopilot and Full Self-Driving marketing violated state law, but did not suspend its dealer license after corrective action. A separate federal class action is stayed pending Tesla’s appeal of class certification.

California did not suspend Tesla’s sales license over its former Autopilot and Full Self-Driving marketing. The DMV adopted an administrative finding that the marketing violated state law, but after Tesla made corrective changes, the agency decided in February 2026 not to suspend its dealer license. Separately, a federal court certified limited California consumer classes over FSD representations. That case was stayed while Tesla appeals the certification order; the available sources do not establish the appeal’s outcome.

Did California suspend Tesla sales over FSD advertising?

No. The California DMV initially adopted a proposed decision that found violations and set out possible license suspensions, but it did not ultimately suspend Tesla’s dealer license.

On December 16, 2025, the DMV adopted the administrative law judge’s violation findings, permanently stayed a proposed suspension of Tesla’s manufacturer license, and gave Tesla 60 days to address its use of the term “Autopilot.” If Tesla did not address the issue, its dealer license faced a 30-day suspension. The DMV later reported that Tesla had taken corrective action and decided not to suspend the dealer license.

What did the DMV find about Tesla Autopilot and Full Self-Driving?

The DMV’s case concerned Tesla’s marketing in California, not a jury verdict or a finding in the separate consumer lawsuit. The agency said written marketing beginning in May 2021 used terms including “Autopilot” and “Full Self-Driving Capability,” as well as the statement that the system was “designed to be able to conduct short and long-distance trips with no action required by the person in the driver’s seat.”

The agency found that Tesla’s vehicles with those driver-assistance features could not operate as autonomous vehicles when the advertisements ran, and still could not do so when the DMV issued its decision. The DMV said its action was intended to address the marketing and state licensing issues. How the administrative case reached its outcome

  1. November 2023: The DMV filed accusations against Tesla’s manufacturer and dealer licenses over alleged false advertising.
  2. July 21–25, 2025: The Office of Administrative Hearings held the case before an administrative law judge.
  3. November 20, 2025: The judge issued a proposed decision recommending 30-day suspensions of both licenses.
  4. December 16, 2025: The DMV adopted the violation findings but modified the proposed remedy, staying the manufacturer-license suspension and giving Tesla 60 days to address “Autopilot” marketing before a possible dealer-license suspension.
  5. February 17–18, 2026: The DMV reported corrective action, including use of “Full Self-Driving (Supervised)” and cessation of Autopilot marketing in California; it decided not to suspend Tesla’s dealer license. DMV corrective-action update

Is the Tesla FSD class action moving forward?

The federal consumer case is separate from the DMV’s licensing proceeding. In In re Tesla Advanced Driver Assistance Systems Litigation, buyers allege claims under California’s Unfair Competition Law, Consumer Legal Remedies Act, and False Advertising Law, along with common-law fraud, negligence, and negligent misrepresentation theories.

The court described two central alleged representations: that Tesla vehicles had the hardware needed for full self-driving, and that a Tesla would be able to drive itself across the country within the following year. Those are plaintiffs’ allegations; class certification does not establish that Tesla is liable.

Judge Rita F. Lin certified limited California classes in an order signed August 18, 2025, and filed September 3. Tesla sought permission to appeal that certification order. The Ninth Circuit granted the petition on December 18, 2025, and the district court stayed the case on January 5, 2026, pending the appeal. Tesla’s 2025 annual filing said its opening brief was due March 12, 2026. The available sources do not establish a later Ninth Circuit ruling, so it would be inaccurate to describe the appeal as decided or the district case as actively proceeding without mentioning the stay. The DMV’s agency finding and the federal court’s class-certification decision answer different questions. The former addressed Tesla’s marketing under California licensing law; the latter determined that specified consumer claims could proceed on a class basis, subject to appellate review. Neither should be described as a final judgment of liability in the federal case.
