The Supreme Court’s 17 December 2025 order limits its age-based protection in Delhi-NCR to vehicles meeting BS-IV or a later emission standard. Owners of vehicles below BS-IV are not covered by that protection, so coercive action under existing age restrictions remains available. For protected vehicles, the order is narrow: it bars coercive steps on the specified age grounds, not every possible restriction on driving or registration.
What the Supreme Court ordered
In M.C. Mehta v. Union of India, W.P.(C) No. 13029/1985, the Supreme Court modified its 12 August 2025 order on 17 December 2025. The operative direction says that “no coercive steps be taken against the owners of the vehicles of BS-IV and later emission versions on the ground that they are 10 years old (in case of diesel engine) and 15 years old (in case of petrol engine).” The order was made after hearing Additional Solicitor General Aishwarya Bhati and listed the case for further hearing on 6 January 2026. In practical terms, the Court drew the protection line at BS-IV. Vehicles below BS-IV are outside the December order’s age-based protection, leaving the existing NCR age restrictions relevant to them. The order does not say that every older BS-IV-or-newer vehicle has unrestricted permission to ply, renew registration, or disregard other legal restrictions.
How the rule applies by fuel, age and emission standard
The Court’s stated age thresholds distinguish diesel and petrol vehicles. The “more than” thresholds below are the limits described in the order and official government material; the December modification protects only BS-IV-and-newer vehicles against coercive action on those age grounds.

The Court’s order does not determine a vehicle’s emission classification or resolve separate issues such as registration status, fitness, or a restriction imposed on other grounds. The Rajya Sabha’s 2026 answer recounts the age restrictions and confirms that the December modification applies to BS-IV and later vehicles.
Why this is not a new blanket ban
The age restrictions predate the December 2025 modification. In a 13 December 2023 parliamentary reply, the Ministry of Road Transport and Highways said the Supreme Court’s 29 October 2018 order directed NCR transport departments not to allow diesel vehicles more than 10 years old and petrol vehicles more than 15 years old to ply, following a 2015 National Green Tribunal order. The 17 December 2025 order narrowed the earlier age-based protection; it did not create the underlying age limits. Nor does the December order settle the full dispute. It records a further hearing date of 6 January 2026. The effect explained here is that of the 17 December order; the sources cited here do not establish whether a later order changed the position.
How to check a particular vehicle
For example, a Punjab-registered 2015 BS-IV diesel Dzire owner asking whether the car can be driven in Delhi should not treat the order as an unconditional yes. The cited order concerns Delhi-NCR vehicles and age-based coercive steps; it does not decide that specific car’s registration, classification records, or any separate restriction. - Confirm the fuel type and age. The thresholds differ: more than 10 years for diesel and more than 15 years for petrol.
- Verify the vehicle’s official emission-standard classification. The age-based protection in the December order is limited to BS-IV and later versions; the order does not classify individual vehicles.
- Check registration and fitness status separately. The Supreme Court’s age-ground direction does not itself renew a registration or establish fitness.
- Check for later court orders and any separate restriction in force. The December order does not grant unrestricted permission to drive, and it set the case for further hearing on 6 January 2026.
Keep the court order separate from fitness testing and fuel-denial measures
The national vehicle-scrapping framework and the Delhi-NCR age restrictions are related policy contexts, but they are not interchangeable. The Ministry describes fitness assessment for private vehicles through Automated Testing Stations. If a vehicle is found unfit, official material identifies Registered Vehicle Scrapping Facilities as a disposal route and describes Certificate of Deposit incentives. The Commission for Air Quality Management’s Direction No. 89 was a separate operational initiative concerning fuel denial and enforcement against end-of-life vehicles. A July 2025 amendment described planned dates of 1 November 2025 for Delhi and five high-vehicle-density NCR districts, and 1 April 2026 for the rest of NCR. In October 2025, CAQM said implementation was being kept in abeyance in light of the Supreme Court’s 12 August order. Both statements predate the 17 December modification, so they do not establish the current status of Direction No. 89. CAQM timeline reported on 8 July 2025; CAQM account dated 17 October 2025.
