On March 18, 2026, the U.S. Securities and Exchange Commission’s Division of Enforcement told Faraday Future Intelligent Electric that it did not intend to recommend an enforcement action against the company, based on information available to the Division at that time. Faraday Future disclosed the notice in a Form 8-K filed March 23. It is a significant procedural step, but it does not amount to exoneration or rule out later action.
Did the SEC clear Faraday Future?
No. The notice said the Division did not intend to recommend an enforcement action against Faraday Future based on information available as of March 18, 2026. The SEC Division of Enforcement’s letter, as quoted in the company’s filing, cautioned that the notice “must in no way be construed as indicating that the party has been exonerated or that no action may ultimately result from the staff’s investigation.”
That distinction matters: the notice reports the Division’s position on whether to recommend enforcement at that point in the process. It does not establish that the underlying allegations were false, nor does it prevent the SEC from taking action later. The filing also says founder and Global Co-CEO Yueting (YT) Jia and Global President Jiawei (Jerry) Wang received similar notices in their individual capacities.
What was Faraday Future investigated for?
Faraday Future described the investigation in its March 22, 2026, press release as concerning “certain matters involving its 2021 PIPE and SPAC-related transactions.” The company also said it and certain executives had received Wells Notices, which it described as not being formal charges.

TechCrunch reported that the SEC examined statements tied to Faraday Future’s 2021 merger with a special purpose acquisition company, including disclosures about related-party transactions and founder YT Jia’s role. The outlet also reported that investigators examined whether the company faked sales of early vehicles in 2023. That sales claim was an allegation made by former employees, not a finding established by the March 2026 notice.

TechCrunch also described the matter as unusual because staff had reportedly recommended action the year before the eventual no-recommendation notice. That account of internal deliberations comes from sources familiar with the matter; it is not part of the March 2026 filing’s description of the notice.

What the notice does—and does not—tell the public
The filed notice establishes a limited procedural outcome: the Division did not intend to recommend enforcement against the company based on information it had on March 18, 2026. The sources cited here do not establish the SEC’s full reasoning or resolve the underlying allegations. They also do not provide a complete public account of the investigative record.
Faraday Future founder YT Jia responded in a statement, as reported by TechCrunch: “We can now put all our energy into strategy execution.” That is the company’s reaction, not an SEC statement. The enforcement notice itself is not a determination about Faraday Future’s business prospects or an investment recommendation.
