Robotaxi vs. Rideshare: How Liability Differs After a Crash

Rideshare insurance can depend on app status. A driverless robotaxi changes which people and systems investigators may examine, but neither vehicle type makes liability automatic.

The key difference is who—and what—was controlling the vehicle when it crashed. A rideshare trip has a human driver, and the insurance that may apply can depend on the driver’s status in the app. A driverless robotaxi removes a human driver from the immediate chain of events, so investigators may also need to examine the fleet operator, vehicle owner, manufacturer, automated-driving system, and other road users. Neither setup makes one party automatically liable: fault, insurance, and the applicable state’s rules are separate questions.

What changes after a robotaxi crash?

In a conventional rideshare, a human driver is at the wheel. Investigators may ask what the driver did, what other road users did, and which insurance applied at that point in the trip. In a driverless robotaxi, there is no human driver controlling the vehicle at the moment of impact. That changes the evidence and the possible parties in the investigation; it does not, by itself, decide who owes compensation.

The National Highway Traffic Safety Administration (NHTSA) says higher automation removes a human driver from the chain of events that can lead to a crash. It also identifies liability and insurance as questions policymakers are working to address as automated driving systems mature. That is not a rule assigning liability to the passenger, fleet operator, software developer, automaker, or any other party in every crash.

Why rideshare app status can matter

Rideshare coverage is often described in trip periods. A driver who is simply online and waiting for a request may have different platform coverage from a driver who has accepted a match and is heading to pick someone up, or is carrying a passenger. The details vary by state, company, policy, and service.

California’s TNC period framework

The California Public Utilities Commission (CPUC) describes Period 2 as the time after a driver accepts a match but before the passenger is picked up, while the driver is on the way to the pickup. For liability arising from a participating driver’s use of the platform, California requires transportation network companies (TNCs) to maintain excess coverage of at least $200,000 per occurrence during this period. This is a California requirement for the described coverage, not a nationwide minimum or a finding about fault in an individual crash.

Uber’s published U.S. driver coverage

Uber’s U.S. driver insurance page describes the following coverage. These are platform-published terms; the applicable policy and coverage can depend on the state, service, and trip status.

Uber driver status Coverage described on Uber’s U.S. page
Online and available for a trip Third-party liability coverage of at least $50,000 per person and $100,000 per accident for injuries, plus $25,000 for property damage.
En route to a pickup or on a trip At least $1 million for property damage and injuries to riders and third parties.
Vehicle damage while en route or on a trip Contingent on the driver’s personal policy having comprehensive and collision coverage; Uber lists a $2,500 deductible, subject to a specified marketplace exception.

The California Department of Insurance separately says approved TNCs must maintain $1 million in liability insurance. Its notice says the TNCs described there are not required to provide certain optional first-party coverages, including medical payments, comprehensive, collision, and uninsured/underinsured motorist coverage. Liability insurance and optional coverage for a driver’s or passenger’s own losses are not the same thing.

Who could be investigated after a robotaxi crash?

A driverless vehicle broadens the factual questions. Depending on the crash and local law, relevant evidence may point toward one party or several; merely appearing on this list does not mean a party is legally responsible.

  • Fleet operator: The company operating the robotaxi, including evidence about its operation and the vehicle’s status at the time.
  • Vehicle owner: The owner may be relevant to questions about the vehicle and its use.
  • Manufacturer or automated-driving system supplier: The vehicle, system, or component may need examination if a defect or system performance is at issue.
  • Other road users: Another driver, cyclist, or pedestrian may have contributed to the collision.
  • Road and conditions: The roadway, visibility, and other circumstances may help explain what happened.
  • Human with a supervisory role: If a person had a legally relevant role in supervising or operating the vehicle, that role may matter under the applicable rules.

There is no single nationwide robotaxi liability allocation rule established by the sources cited here, and they do not identify a controlling judgment that resolves every kind of robotaxi crash. The vehicle’s automation status alone cannot establish who is liable.

Coverage is not the same as fault

An insurance policy can provide a route for paying covered losses without resolving who caused the crash. An insurer may assess coverage while the parties investigate whether the driver, another road user, a vehicle or system issue, or more than one cause contributed. Published policy limits are not a prediction of what an individual claimant will recover: the applicable policy, covered losses, evidence, and law all matter.

What crash reports can—and cannot—show

NHTSA’s Standing General Order (SGO) on crash reporting, first issued in 2021 and amended in 2021, 2023, and 2025, collects reports involving certain crashes with automated driving systems and advanced driver assistance systems. NHTSA warns that multiple entities may report the same crash, producing duplicate counts when reports cannot be matched. The agency also notes that access to detailed vehicle telemetry may differ between operators and people relying on complaints.

As a result, an SGO report is evidence to examine, not necessarily a unique crash count or a complete reconstruction. A report alone does not establish fault. The operator or other parties may have data that is not available in a public complaint or report, and the available information can be uneven.

California robotaxi rules are local examples, not a national template

California has its own autonomous-vehicle permitting, deployment, incident, and insurance frameworks. The California Department of Motor Vehicles (DMV) lists permit holders and says its deployment-authorizations roster is current as of November 21, 2025. It also provides an incident form for autonomous vehicles on California public roads and links to manufacturer collision reports for testing vehicles. These materials describe California processes and status; they do not establish rules for other states or determine liability in a particular crash.

For a specific incident, identify where it happened, which service and operator were involved, whether the vehicle was in autonomous operation, and what insurance disclosure and regulator or police records apply. Confirm the rules in that jurisdiction rather than assuming that California’s TNC or autonomous-vehicle framework governs elsewhere.

What to do if you are involved in a crash

  1. Prioritize safety and report the collision. Follow emergency and police-reporting requirements where the crash occurred.
  2. Record the vehicle and service details. Note whether it was a rideshare or robotaxi, the service or operator, the location and time, and—if available—the rideshare trip or app status or the robotaxi’s operating status.
  3. Preserve what you can access. Keep photographs, witness contact details, trip confirmations, messages, and insurance information. Do not assume you can access a robotaxi’s telemetry yourself.
  4. Ask which policy and reporting process apply. Request the relevant insurance information from the driver, rideshare company, robotaxi operator, or insurer, and keep copies of reports and claim communications.
  5. Check the local rules before drawing conclusions. Permit and incident-reporting procedures differ by jurisdiction; for a serious or disputed claim, consider advice from a qualified lawyer in the state where the crash occurred.
