A proposed class action filed in Delaware on July 8, 2025, alleges that engines in certain Nissan Rogue, Altima and Infiniti QX50 vehicles can suffer damage or fail. Separately, a federal safety investigation led to Nissan recall 25V-437, which calls for dealer inspections and, in some cases, engine replacement. The lawsuit is not a recall, and its allegations are not court findings.
What the lawsuit alleges
Vehicles and engines named in the complaint
In Becker et al. v. Nissan of North America, Inc. et al., case No. 1:25-cv-00845, plaintiffs allege defects in Nissan KR15DDT and KR20DDET variable-compression turbo engines. ClassAction.org’s report on the complaint identifies these proposed class vehicle ranges:

These are years alleged in the lawsuit report, not a finding that every vehicle in those ranges is defective or included in the federal recall. The complaint describes alleged problems with bearings, the variable-compression system, software, lower links, and materials or workmanship. Plaintiffs say symptoms may include knocking or a high-pitched whirring sound, hesitation, rough idle, oil consumption, power loss, or engine failure. A symptom by itself does not establish that a vehicle has the alleged defect.
What plaintiffs say about Nissan’s response
The complaint also challenges the adequacy of recall remedies and reimbursement. These are plaintiffs’ claims, not findings that Nissan violated the law. A lawsuit filing does not itself certify a class or establish that owners are entitled to compensation.

How the NHTSA investigation and recall differ
Investigation scope and safety concern
NHTSA’s Office of Defects Investigation opened preliminary evaluation PE23-023 on December 13, 2023, after receiving reports of engine failure and loss of motive power. Its investigation covered 2021–2023 Nissan Rogues, 2019–2021 Nissan Altimas, and 2019–2021 Infiniti QX50s equipped with the relevant engines. The agency’s summary says failures involving certain engine bearings or other components could damage an engine and cause a loss of motive power, increasing crash risk.
The investigation summary reports that Nissan provided 998 customer reports and 1,107 warranty claims related to the alleged defect in response to agency information requests. ODI and manufacturer data together identified 1,878 unique VINs with failures across the subject vehicles. The summary also records 12 allegations of engine-compartment fires, three of which were confirmed as directly related to engine failure. These are counts in the records described by the summary, not a failure rate for all vehicles on the road.

Recall population and dealer remedy
Nissan submitted recall 25V-437 on June 27, 2025. The PE23-023 investigation summary states that the recall population is 443,899 vehicles:

The summary says Nissan extends the warranty to 10 years or 120,000 miles for vehicles in the recall population after dealer inspection. That statement describes the recall population and process; it does not establish an individual vehicle’s eligibility.
How to check whether your vehicle is included
- Look up the vehicle identification number (VIN) using NHTSA’s recall lookup or ask a Nissan or Infiniti dealer to check it.
- If the VIN shows recall 25V-437, contact an authorized dealer to arrange the specified inspection and ask what remedy applies to your vehicle.
- If the engine is knocking, making a high-pitched whirring noise, hesitating, or losing power, contact a dealer and describe the symptoms. Those signs alone do not confirm the alleged defect, and a routine oil change is not a substitute for the recall inspection.
Do not infer coverage from model year alone. The lawsuit’s reported year ranges and the recall’s year ranges differ, particularly for Altima and QX50; the VIN-specific recall record is the relevant check for recall eligibility.

What is known about the lawsuit’s status
ClassAction.org’s report confirms the Delaware filing date and case number but does not establish the case’s subsequent procedural status. The available reporting does not confirm class certification, a settlement, an outcome, or a current process for owners to claim compensation. The recall and any lawsuit remedies are separate matters.
A separate Rogue fuel-fume case is not this engine lawsuit
A 2026 order in the Middle District of Tennessee in Elias et al. v. Nissan North America, Inc. concerns different allegations: that PCV-system components in certain 2022–2023 Rogues allowed fuel to seep through rubber components, producing gasoline fumes inside the vehicle. That case is distinct from the VC-Turbo bearing and engine-failure claims in Becker. The order considered pleadings at the motion-to-dismiss stage; it does not establish that every allegation is true.
