The automaker announced DRIVE PILOT availability for selected S-Class and EQS Sedan vehicles in California and Nevada. This is conditional Level 3 automation—not a driverless car—and it works only within a narrow set of road, speed, weather and driver-readiness limits.
What Mercedes-Benz was first to do
On June 8, 2023, the California Department of Motor Vehicles said Mercedes-Benz was the first company authorized to sell or lease vehicles with an automated driving system to the public in California. The permit covered designated highways and specified operating conditions; it was not approval for unrestricted use on every road. California DMV’s announcement describes the milestone.
Mercedes-Benz later announced that U.S. customers could order DRIVE PILOT-equipped S-Class and EQS Sedan vehicles in California and Nevada. Its September 27, 2023 launch announcement said initial orders would be placed through participating dealers and that selected vehicles had the required hardware preinstalled. The two-state consumer launch does not mean the system can be used anywhere in either state: use depends on approved roads and current regulatory permissions.
What Level 3 means for the driver
SAE Level 3 is conditional driving automation. When the system is active within its operating domain, it performs the driving task without the driver continuously controlling the vehicle. The driver is still the fallback-ready user: they must remain in the driver’s seat, belted and able to take control when prompted. California DMV describes Level 3 as performing driving tasks without active human control under certain conditions, while requiring the driver to remain behind the wheel and take over when requested.

That distinction matters: DRIVE PILOT is not a license to sleep, leave the seat, or ignore the vehicle. Mercedes’ subscription terms require users to stay properly seated and belted, remain receptive to system prompts, and take control as soon as requested. Failure to respond within the specified period initiates an emergency-stop procedure, and dangerous behavior can result in the feature being disabled.
Where and when DRIVE PILOT can operate
Eligibility depends on the car being on an approved freeway and all operating conditions being met at once. A mapped road alone is not enough: Mercedes says DRIVE PILOT relies on high-definition maps and is limited to areas approved by the relevant regulator.

- Road: an approved freeway with clear lane markings; not a city or county street.
- Speed and traffic: moderate-to-heavy traffic below 40 mph. California’s permit sets a maximum operating speed of 40 mph; that is a California permitted limit, not a general U.S. capability claim.
- Time and visibility: daytime, clear weather, and conditions that allow the driver-monitoring camera to see the driver.
- Exclusions: construction zones, heavy rain or fog, flooded roads, and other weather that could affect performance.
The DMV identified covered areas including the Bay Area, Central Valley, Los Angeles, Sacramento, San Diego, and Interstate 15 toward Nevada. Mercedes describes availability on major California freeways and parts of Nevada, but the actual eligible segments and regulatory permissions can change. Check Mercedes’ DRIVE PILOT operating-condition information and in-vehicle availability before relying on a route.
Which vehicles and what it costs
Mercedes’ U.S. materials identify the S-Class and EQS Sedan as the relevant vehicle lines. The 2023 launch announcement said DRIVE PILOT activation started at $2,500 through the Mercedes me connect Store. That is a launch-era starting price, not a verified current price; Mercedes’ current terms do not state the current activation price or subscription duration. The sources also do not establish a complete current model-year and trim eligibility list.

For a specific vehicle, confirm compatible hardware, model year and trim with Mercedes-Benz or a participating authorized dealer, then check the Mercedes me connect Store for the current activation offer and term. The feature is sold per vehicle, cannot be transferred, and requires activation over cellular service, according to Mercedes’ subscription terms.
What an owner must do before using it
- Confirm compatibility and local availability. The vehicle must have compatible factory hardware, and DRIVE PILOT must be permitted and available for the relevant road segment.
- Activate the service. Mercedes says activation is handled through the Mercedes me connect Store and depends on cellular service.
- Review the safety material. California requires drivers to watch the instructional video before activation. Mercedes also requires review of the manual and other instructional materials.
- Use it only when every condition is satisfied. If the route, weather, speed, traffic, visibility or system status falls outside the operating domain, the driver must drive rather than rely on DRIVE PILOT.
- Respond promptly to takeover requests. Keep the seat belt fastened and remain ready to resume control; the system is not a substitute for an attentive, available driver.
What this milestone does—and does not—mean
DRIVE PILOT’s significance is that a U.S. automaker moved conditional Level 3 automation into consumer sales under state authorization. It does not establish that all Mercedes driver-assistance features are Level 3, that the car is autonomous in every situation, or that drivers can hand over responsibility whenever they choose. Mercedes’ assistance explainer distinguishes Level 2 driver assistance from Level 3 conditional automation; the exact feature and its active conditions matter.

Nor should a separate Nevada approval for automated-driving marker lights be confused with broader DRIVE PILOT authorization. Mercedes’ newsroom described those approvals as applying to marker lights, a communication feature, not as a new consumer Level 3 deployment approval.
