Florida’s e-bike bill SB 382 passed the Senate and House unanimously, but it did not become law: Gov. Ron DeSantis vetoed it on June 25, 2026. The bill’s proposed pedestrian-yielding and 10-mph rules therefore did not take effect through SB 382. Riders should follow Florida’s existing e-bike statute and check local rules for each route.
What happened to Florida SB 382?
SB 382 cleared both chambers before the governor vetoed it. The official Florida Senate bill record lists the votes and veto:
- Florida Senate: 37 yeas, 0 nays, on February 25, 2026.
- Florida House: 112 yeas, 0 nays, on March 9, 2026.
- Governor: vetoed on June 25, 2026.
A unanimous vote in both chambers did not make the bill law. The veto means its proposed statewide rules and task-force requirements did not take effect under SB 382. The official record does not establish a reason for the veto, so no motive should be inferred.
What rules did the bill propose?
The Florida Senate’s bill summary describes proposed rules for e-bike operators in pedestrian areas:

- On certain shared pathways, operators would have had to yield to pedestrians and give an audible signal before overtaking and passing.
- On a sidewalk or other area designated for pedestrians, operators could not travel faster than 10 mph when a pedestrian was within 50 feet.
- A violation would have been treated as a noncriminal traffic infraction punished as a nonmoving violation.
These were provisions of the vetoed bill, not current requirements created by SB 382.
Proposed task force and reports
SB 382 also proposed a Micromobility Device Safety Task Force adjunct to the Department of Highway Safety and Motor Vehicles. Its proposed schedule called for a task-force report by October 1, 2026, crash data collection for incidents through September 20, 2026, and a department report by October 31, 2026. Because the bill was vetoed, those deadlines and structures are not active obligations created by SB 382.

What Florida law says about e-bikes now
The statewide baseline identified in the 2026 Florida Statutes, section 316.20655, remains in place. In general, it gives e-bikes and their operators the rights and duties of bicyclists, treats an e-bike as a vehicle to the same extent as a bicycle, and allows e-bike operation where bicycles are allowed, subject to statutory qualifications and local restrictions.
The statute also exempts e-bikes and their operators from specified motor-vehicle financial-responsibility, licensing, registration, title, off-highway motorcycle, and off-highway vehicle provisions. It addresses permanent manufacturer or distributor labels, certain modifications, bicycle equipment standards, and motor disengagement when the rider stops pedaling or applies the brakes.

Why local rules still matter
Florida’s statute preserves local government authority over e-bike operation on streets, highways, sidewalks, and sidewalk areas. Authorities responsible for paths, multiuse paths, trails, beaches, or dunes may also restrict or prohibit e-bike operation in those places.
Before riding, check the rules for the city or county and for the specific path or route. Permission to ride under the statewide baseline does not necessarily mean a particular local authority allows e-bikes there.
