Maryland Private Car Sale: Bill of Sale vs. Title Assignment (2026 Rules)

In Maryland, the assigned original title transfers ownership; a VR-181 bill of sale documents the deal and may support purchase-price reporting. Here is the 2026 process, including the October 1 notarization change.

For a private Maryland car sale, the assigned Certificate of Title is the document that transfers ownership. The seller and buyer complete the title’s Assignment of Ownership, including the buyer’s information, sale price, odometer reading, date and signatures. A separate bill of sale (Maryland form VR-181) is a supporting record: it can document the deal and purchase price, and some buyers may need it when titling the vehicle. It does not replace a properly assigned original title. See the Maryland Motor Vehicle Administration (MVA) guidance for selling a vehicle and titling a private-party purchase.

Title assignment and bill of sale: what each document does

Maryland treats these as two different records. The title assignment changes the ownership record; the bill of sale records the transaction that led to that change.

Question Assigned Certificate of Title Bill of sale (VR-181)
Primary purpose Transfers the titled vehicle from seller to buyer. Records the agreed transaction and purchase-price details.
Where it is completed On the ownership-assignment section of the original Maryland title. On a separate MVA form, VR-181.
Information normally recorded Buyer name and address, sale price, odometer reading, sale date and seller signature(s), along with the vehicle and title information. Vehicle details, buyer and seller, agreed price, odometer information and signatures.
Can it stand alone? It is the essential ownership-transfer document, but the buyer still must complete the titling and registration process. No. A bill of sale does not substitute for the properly assigned original title.
Why keep it? It is the evidence that the title was assigned to the named buyer. It preserves a separate record and may support the buyer’s reported purchase price or titling file.

MVA describes a bill of sale as helpful because it protects both parties, while its buyer checklist requests proof of purchase price and a bill of sale when applicable. That means the safest private sale uses both documents: complete every applicable field on the title and give the buyer a signed copy of the bill of sale.

Maryland’s notarization rule effective October 1, 2026

An MVA bulletin dated September 15, 2026 says that, effective October 1, 2026, a notarized bill of sale is no longer required for a private-party sale involving a vehicle less than seven years old. This is the rule in effect as of October 17, 2026. The bulletin addresses the repealed notarization requirement; it does not eliminate the need to complete the title assignment or satisfy other transaction-specific requirements.

The current VR-181 form still contains older notary wording. Do not treat that boilerplate as overriding the later bulletin. Keep the form’s vehicle, price, odometer and signature information complete, and check the MVA’s current instructions if your transaction has an unusual ownership, lien or title circumstance. The bulletin is available at MVA’s September 15, 2026 notice; the form is linked from MVA’s materials at MVA media/form resources.

The seven-year qualification matters. Do not extend the no-notarization statement to vehicles outside the bulletin’s “less than seven years old” category, and do not assume that a different type of transfer follows the same rule.

What the seller must do before signing

Confirm that the title is usable

  • Have a valid Maryland title in your own name.
  • Check the vehicle identification number (VIN), owner names and address against the title and the vehicle.
  • Resolve an existing lien and correct title errors before handing over the vehicle.
  • Review the assignment section so you know which fields must be completed with the buyer present.

MVA’s selling guidance is at mva.maryland.gov/title-registration/buying-selling-or-gifting-vehicle/selling-vehicle. A mismatch in the VIN, owner name, lien status or signature can stop the buyer’s title application even when the parties have a signed bill of sale.

Prepare an accurate transaction record

Agree on the true sale price before completing either document. Record the actual odometer reading and the date of sale. Do not leave the buyer’s name, price, date or odometer field blank for someone else to fill in later. An incomplete assignment can be treated as an open title and may not be accepted for registration.

How to complete the title assignment

  1. Use the original title. The buyer should receive the original Certificate of Title, not only a photocopy or a bill of sale.
  2. Verify the vehicle and owner information. Compare the VIN and the titled owner details with the vehicle and the title record. Correct discrepancies before the sale.
  3. Enter the buyer’s full name and address. Write the information exactly as the buyer will use it for the title application.
  4. Enter the actual sale price. The amount should agree with the bill of sale and any other purchase-price evidence.
  5. Record the odometer reading and sale date. Complete any odometer disclosure that applies to the vehicle and transaction.
  6. Sign as every titled owner. All owners must sign unless the title specifically uses “OR,” which permits the ownership arrangement shown on that title.
  7. Review the completed section together. Make sure no assignment field is blank, altered or inconsistent with the bill of sale.
  8. Give the completed original to the buyer and retain copies. MVA recommends keeping copies of the completed title, front and back, for the seller’s records.

The assignment is the step that identifies the new owner on the ownership document. A separate VR-181 cannot cure a missing buyer assignment, an unsigned title or an open title.

How to use the bill of sale (VR-181)

Information to include

  • Vehicle identification details that match the title, including the VIN.
  • Seller and buyer names and addresses.
  • The agreed purchase price.
  • The odometer information requested by the form or required for the transaction.
  • The date of sale.
  • Signatures of the parties.

Use the same spelling, numbers and price on the title assignment and the bill of sale. Each party should keep a signed copy. A bill of sale is especially useful when the buyer later needs to explain the reported price or show what was agreed if a dispute arises.

What “helpful” means in practice

MVA does not describe the bill of sale as a replacement for the title. Instead, its guidance says a bill of sale helps protect buyer and seller, and the private-purchase titling checklist calls for proof of purchase price and a bill of sale if applicable. A buyer may therefore be asked for one even though the ownership transfer itself occurs through the assigned title.

Purchase price, NADA value and Maryland tax documentation

The September 2026 MVA bulletin describes a specific price-documentation procedure. The reported sale price is used when it is within $500 of the NADA value returned by the MVA system. If the reported price is more than $500 below that system value, the buyer may be taxed on the NADA value or provide documentation supporting the lower price.

The $500 figure is the bulletin’s threshold for that described procedure; it is not permission to report an inaccurate price. If the car sold for less because of condition, damage or another legitimate circumstance, preserve evidence that explains the amount. Examples identified by MVA include:

  • A vehicle advertisement showing the asking or agreed price.
  • Messages or other communications with the seller about the price.
  • A signed bill of sale showing the actual amount paid.

Keep the evidence with the title and bill-of-sale copies. The buyer should be prepared to present it with the titling application if MVA’s value comparison requires support for the lower reported amount.

Seller’s checklist after the sale

  1. Keep copies. Retain the front and back of the completed title and a signed bill of sale.
  2. Remove your license plates. Maryland MVA says the plates stay with the seller; do not leave them on the vehicle for the buyer.
  3. Return the plates to MVA. Follow MVA’s plate-return instructions rather than assuming the buyer will handle them.
  4. Protect your records. Keep the sale date, buyer information and price with your copies in case an agency, insurer or other party later asks when you transferred the vehicle.

Do not hand over a vehicle with an incomplete assignment on the assumption that the buyer can finish it later. The seller’s signatures and the completed buyer section are part of the transfer record.

Buyer’s titling and registration steps

  1. Take possession of the properly assigned original title. Check that the seller completed the assignment, all required owners signed and no unresolved lien remains.
  2. Complete form VR-005. Use the completed application to apply for a Maryland title.
  3. Assemble supporting documents. MVA’s private-party checklist can require the assigned original title, purchase-price evidence, a bill of sale if applicable, an odometer disclosure if applicable, a Maryland Safety Inspection Certificate, identification, a lien release when applicable, and the required taxes and fees.
  4. Arrange Maryland insurance before registration. MVA states that Maryland auto insurance is needed before the vehicle can be registered. Its buying-vehicle guidance is at mva.maryland.gov/title-registration/buying-selling-or-gifting-vehicle/buying-vehicle.
  5. Submit the title and registration application to MVA. Follow the current submission method and any transaction-specific instructions MVA gives for your vehicle.

The private-party purchase checklist and required-document details are published by MVA at title-vehicle/private-party-purchase. Requirements can differ when a lien, corrected title, unusual ownership wording or another special circumstance is involved, so resolve those issues with MVA rather than improvising on the title.

Common problems and how to prevent them

The buyer section is blank

A blank buyer assignment creates an open-title problem. Complete the buyer’s name and address before the seller signs and before the vehicle changes hands. If the title was already signed or altered incorrectly, ask MVA how to correct it; do not create a second assignment or overwrite the original without instructions.

The price is missing or differs between documents

Use the actual price on both the title and VR-181. A discrepancy can delay titling and make the buyer’s price documentation harder, particularly when the reported amount is more than $500 below the NADA value returned by MVA’s system.

A required owner did not sign

All titled owners must sign unless the title says “OR.” Obtain the missing signature before completing the sale. A bill of sale signed by one person does not replace the signature requirement on the ownership document.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The title shows a lien

Resolve the lien and obtain any required lien release before transferring the vehicle. The buyer should not assume that a bill of sale proves the lien has been cleared.

The VIN or owner details do not match

Stop and correct the discrepancy before signing. The title’s VIN and owner information must be consistent with the vehicle and the MVA record; an otherwise complete bill of sale cannot make an incorrect title safe to transfer.

Someone insists the bill must be notarized

For a private-party sale of a vehicle less than seven years old on or after October 1, 2026, the MVA bulletin says notarization is no longer required. The VR-181’s older notary language can cause confusion. Use the current MVA bulletin and obtain agency-specific guidance if your vehicle or transaction falls outside that rule.

The buyer wants to drive away on the seller’s plates

Maryland MVA says the seller keeps the plates. Remove them before handing over the car and return them according to MVA instructions. Registration and insurance are the buyer’s responsibility before driving the vehicle under Maryland requirements.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Worked examples

Routine private sale

A Maryland owner sells a vehicle that is less than seven years old. The parties verify the VIN, enter the buyer’s name and address, record the actual price and odometer reading, date the assignment and sign it. They also complete and sign VR-181. The seller keeps copies and removes the plates. The buyer submits the original assigned title, VR-005, the bill of sale or other price evidence as applicable, the inspection certificate, identification, insurance information and required fees and taxes.

Sale below the MVA system value

The parties agree on a price that is more than $500 below the NADA value returned by MVA’s system. The buyer reports the true price but keeps the signed bill of sale, the advertisement and the messages documenting the condition and negotiation. Under the bulletin’s described procedure, MVA may use the NADA value for taxation unless the buyer supplies documentation supporting the lower price.

Older vehicle with an old form’s notary wording

The seller uses VR-181 and sees a notary section. Because the bulletin’s no-notarization rule is limited to private-party sales involving vehicles less than seven years old, the parties should not assume the same treatment for an older vehicle. They should follow current MVA instructions for that transaction rather than relying solely on the form’s boilerplate.

Document handoff checklist

Seller gives or completes Buyer receives or prepares
Original Certificate of Title with every applicable assignment field completed Original assigned title
Seller signature(s), with all titled owners signing unless the title says “OR” VR-005 title application
Signed VR-181 bill of sale Purchase-price evidence and bill of sale if applicable
Accurate sale price, date and odometer information Maryland Safety Inspection Certificate and odometer disclosure if applicable
Copies of the title and bill of sale retained by the seller Identification, lien release if applicable, taxes and fees
License plates removed and returned by the seller Maryland insurance arranged before registration

Bottom line for a Maryland private sale

Complete the title assignment correctly because that is what transfers ownership. Use VR-181 as a separate, signed record of the sale and price, not as a substitute for the title. As of October 1, 2026, MVA says notarization is no longer required for private-party sales of vehicles less than seven years old, despite older notary wording that remains on the form. Keep copies, preserve price evidence when the reported amount is more than $500 below MVA’s system-returned NADA value, remove the seller’s plates and complete the buyer’s MVA title, insurance and registration requirements.
