Lewis Hamilton vs. Hamilton Watches: What the EU Trademark Dispute Decided

44IP’s trademark challenge involving Lewis Hamilton and Hamilton watches was reportedly unsuccessful at EUIPO, not in court.

Lewis Hamilton’s company 44IP failed in a reported EU trademark dispute with Hamilton International, the watch brand. The decision described in available coverage came from the European Union Intellectual Property Office (EUIPO), not a court. The reporting says 44IP’s challenge to the watch company’s mark was unsuccessful; it does not establish whether the result was later appealed.

What was the dispute about?

Time+Tide reported that 44IP sought to register the name “Lewis Hamilton” as an EU trademark for goods that included watches, smartwatches and jewellery. Hamilton International, which sells watches under the Hamilton name, opposed that application. Time+Tide’s account, published 20 November 2020, describes the next step as 44IP seeking to have Hamilton International’s mark declared invalid on bad-faith grounds.

A 2022 legal-industry overview by Novagraaf recounts the same sequence: Hamilton International opposed the application, and a later bad-faith nullity challenge to its registration failed. Novagraaf’s overview, published 5 October 2022, corroborates the reported outcome.

Who ruled, and what was the reported outcome?

The decision described in the coverage was made by EUIPO, the EU’s intellectual-property office. It was an administrative trademark proceeding, not a court judgment. Time+Tide reports that EUIPO refused to cancel Hamilton International’s trademark and attributes this wording to the office: “The argument relating to the IP rights of the racing driver Lewis Hamilton fails.” That wording is reproduced in the secondary article; it has not been verified here against the original decision.

The practical result, as reported by both accounts, was that 44IP’s challenge to Hamilton International’s mark did not succeed. Neither source establishes what happened after that decision, so it should not be described as the final word or as a result that was, or was not, appealed.

Why did the Hamilton watch name matter?

Both accounts say the watch brand had used the Hamilton name since 1892, before Lewis Hamilton was born. That history is relevant context for a dispute over the same name, but the reporting does not provide the original EUIPO decision or enough detail to reconstruct its full legal reasoning.

Time+Tide also attributes this sentence to EUIPO: “There is no ‘natural right’ for a person to have his or her own name registered as a trademark, when that would infringe third parties’ rights.” It is reported wording from a secondary source, not a verified quotation from the original decision. It should not be taken to mean that people can never register their own names; the quoted point concerns a registration that would infringe another party’s rights.

What the coverage does—and does not—establish

  • Established by the cited accounts: 44IP sought an EU trademark for “Lewis Hamilton” covering goods including watches, smartwatches and jewellery; Hamilton International opposed it; and the subsequent bad-faith nullity challenge failed.
