En 2018 resolvió que imponer sanciones mediante ese sistema no violaba la garantía de audiencia previa. Un tribunal colegiado examinó después una cuestión diferente: una regla ya derogada que responsabilizaba del pago al propietario aunque no condujera. Confundir esos dos asuntos lleva a una conclusión equivocada sobre el sistema actual.
¿La Corte quitó las fotomultas porque el dueño no iba manejando?
No. La resolución de la SCJN y la tesis sobre la responsabilidad del propietario corresponden a tribunales, fechas y problemas jurídicos distintos. Ninguna equivale a una decisión general que haya borrado las sanciones de tránsito captadas por cámaras en la CDMX.

Qué objetó el tribunal colegiado sobre los propietarios
La tesis aislada examinó la atribución automática de responsabilidad: bajo la regla discutida, el propietario podía tener que pagar aunque no hubiera cometido la infracción al volante. El tribunal razonó que la seguridad vial es un fin legítimo, pero que la sanción no debía recaer en una persona a quien no se atribuía la conducta. El problema era la falta de identificación del conductor y de una vía adecuada para que el propietario pudiera desligarse de esa responsabilidad.
La precisión temporal importa: el criterio se refiere al artículo 64, párrafo segundo, que dejó de estar vigente el 5 de diciembre de 2018. Además, se trata de una tesis aislada de un tribunal colegiado. No debe presentarse como la resolución de la SCJN de mayo de ese año ni como una cancelación automática de cualquier fotomulta actual.

Qué cambió con Fotocívicas y quién recibe sanciones
La Secretaría de Movilidad de la Ciudad de México (SEMOVI) informa que Fotocívicas reemplazó el esquema anterior y entró en vigor el 22 de abril de 2019. Conservó el uso de cámaras y radares, pero estableció un sistema distinto de sanciones. Según la información de SEMOVI sobre Fotocívicas, las sanciones cívicas por puntos corresponden a personas físicas con vehículos matriculados en CDMX; los vehículos de personas morales y los de otras entidades federativas reciben sanciones económicas.
En sus preguntas frecuentes, SEMOVI indica que, para las sanciones cívicas descritas, debe cumplir el propietario cuyo nombre aparece en la tarjeta de circulación. Esto describe a quién asigna la autoridad esas obligaciones dentro del programa; por sí solo, no convierte el criterio sobre la norma antigua en una anulación del sistema vigente.

Qué hacer si no estás de acuerdo con una infracción
La vía depende del tipo de infracción y del procedimiento aplicable. SEMOVI señala que puede presentarse electrónicamente un recurso de revisión para ciertas infracciones de tránsito captadas por sistemas tecnológicos. No debe confundirse ese recurso con la cancelación prevista en un supuesto específico del Reglamento de Tránsito.

Ese plazo pertenece a ese supuesto concreto: no es el plazo universal para impugnar fotomultas ni sustituye el recurso de revisión de Fotocívicas. Comprueba qué procedimiento corresponde a tu boleta y sigue las instrucciones oficiales aplicables a tu caso.
